It reflects a rule older than the common law: heads of state are exempt from the criminal process of any national court but their own.&#8221; <\/p>\n<p>Maduro and his wife are scheduled to go on trial on drug trafficking charges next June 1. Judge Alvin K. Hellerstein has set oral arguments for Nov. 17 on motions to dismiss the indictment. <\/p>\n<p>Maduro, 63, and his wife, Cilia Flores, 69, have been held at a Brooklyn jail since <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/u-s-officials-reveal-new-details-on-the-covert-operation-to-capture-maduro\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">U.S. forces seized them<\/a><\/span> from their Caracas home in a middle-of-the-night raid in early January and brought them to New York. <\/p>\n<p>In separate papers filed Wednesday, lawyers for Flores said she too has immunity from U.S. prosecution on sovereign immunity grounds. <\/p>\n<p>&#8220;It is an attribute of Venezuela&#8217;s sovereignty, and only Venezuela may surrender it,&#8221; her lawyers wrote.  <\/p>\n<p>Maduro&#8217;s lawyers said that even if Maduro were not entitled to sovereign immunity as the head of state, the case against him must be dismissed because he is also entitled to conduct-based sovereign immunity. <\/p>\n<p>Meanwhile, the lawyers argued, Maduro &#8220;vehemently denies the allegations against him.&#8221; <\/p>\n<p>&#8220;If this case were to proceed to trial, it would be apparent that he has been falsely accused,&#8221; they said. <\/p>\n<p>Both have pleaded not guilty in a criminal case first brought six years ago against numerous alleged co-conspirators. They face potential life prison sentences if a jury agrees that they were part of a conspiracy to send cocaine into the U.S. <\/p>\n<p>Federal prosecutors are scheduled to file a response to the arguments later this month. <\/p>\n<p>President Trump&#8217;s administration has defended the raid to capture Maduro as a &#8220;surgical law enforcement operation.&#8221; Maduro has called himself a prisoner of war and his capture a kidnapping. <\/p>\n<p>U.S. prosecutors say Maduro carried out a conspiracy to move thousands of tons of cocaine into the U.S. by colluding with Venezuelan law enforcement to help drug kingpins.<\/p>\n<p>Maduro has remained defiant. On Sunday, he <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/nicolas-maduro-photos-new-york-prison\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">posted pictures of himself from prison<\/a><\/span> on social media, saying he was &#8220;standing firm.&#8221;<\/p>\n<p>&#8220;I send these photos as a small gift to all my grandsons and granddaughters, to the boys and girls, and to all the noble people who love us,&#8221; <a href=\"https:\/\/x.com\/NicolasMaduro\/status\/2094048867662565583\" target=\"_blank\" rel=\"noopener\">he wrote<\/a>.<\/p>\n<p>&#8220;I want you to know that we stand firm, with our hearts full of your love, that love that reaches us transformed into prayer, into constant action, into solidarity and true support. Infinite thanks for every word, for every gesture, for every blessing,&#8221; <a href=\"https:\/\/x.com\/NicolasMaduro\/status\/2094048874381938718\" target=\"_blank\" rel=\"noopener\">he went on to say<\/a>.<\/p>\n<p>On the Telegram messaging service, he added, &#8220;We will remain strong, calm and confident: God is with us. God will provide.
