A legal expert says it could be days before they come to a decision in the Massachusetts murder case.<\/p>\n<p>Jurors have deliberated for 10 and a half hours since the prosecution and defense made their <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/boston\/live-updates\/lindsay-clancy-trial-live-updates-closing-arguments\/\" data-invalid-url-rewritten-http=\"\">closing arguments<\/a><\/span> in Plymouth Superior Court Thursday. They will decide whether Clancy is criminally responsible for killing her three children &#8211; 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan. The defense says she was overmedicated and suffering from <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/lindsay-clancy-trial-postpartum-psychosis\/\" data-invalid-url-rewritten-http=\"\">postpartum psychosis<\/a><\/span> at the time, while prosecutors argued she planned the murders and knew right from wrong.<\/p>\n<p>&#8220;I don&#8217;t think we&#8217;re seeing a verdict before Monday or Tuesday of next week,&#8221; WBZ-TV legal analyst Jennifer Roman said.<\/p>\n<p>Roman said that jurors usually take a straw poll when they start deliberations, even though they&#8217;re not technically supposed to, to see how everyone is leaning.<\/p>\n<p>&#8220;Just by the sheer fact that they didn&#8217;t come back [Thursday] at 4:20 means they are not unanimous,&#8221; she said. &#8220;Even if it&#8217;s not guilty by reason of insanity, it has to be unanimous.&#8221;<\/p>\n<p>Roman pointed out that jurors have to consider testimony from 85 witnesses in their deliberations, and &#8220;it just takes time.&#8221;<\/p>\n<p>&#8220;It&#8217;s not like <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/boston\/news\/karen-read-trial-timeline-john-okeefe\/\" data-invalid-url-rewritten-http=\"\">Karen Read<\/a><\/span> where there&#8217;s a lot of physical evidence they had to go through,&#8221; Roman said. &#8220;They have a lot of medical reports and notes and her journals. Although there&#8217;s not much of it, it&#8217;s going to take a while for them to get through it, and then they&#8217;re going to have to parse that out with the actual testimony.&#8221;<\/p>\n<p>On Friday morning, jurors asked to see pill bottles and the knife that was in evidence, according to defense attorney Kevin Reddington.<\/p>\n<h2>Lindsay Clancy jury<\/h2>\n<p>After alternates were randomly drawn Thursday, the jury was whittled from 18 jurors to 12 &#8211; nine women and three men. Judge William Sullivan named an older woman as foreperson.<\/p>\n<p>Roman said the gender disparity &#8220;could work for either side, really.&#8221;<\/p>\n<p>&#8220;Sometimes I think that women can be harsher on other women and hold them to a higher standard,&#8221; she said.<\/p>\n<p>But more women on the jury means some of them could relate to what Clancy went through, Roman said.<\/p>\n<p>&#8220;Presumably some of them are mothers or are grandmothers,&#8221; she said. &#8220;They may have had somebody in their life, including themselves, who may have suffered postpartum depression following a pregnancy or known someone who has and that could also color their perspective too.&#8221;<\/p>\n<h2>Lindsay Clancy verdict options<\/h2>\n<p>Jurors have five choices on their verdict slips. The state hospital and authorities will review her case every six months or so and decide whether or not it&#8217;s safe for her to be released, Roman said.<\/p>\n<p>&#8220;Even if she&#8217;s found not guilty by reason of insanity, she&#8217;s not walking,&#8221; Roman said.<\/p>\n<p>A conviction of first-degree murder, second-degree murder or manslaughter would mean Clancy goes to prison.<\/p>\n<p>&#8220;I think that&#8217;s really why this case ended up going to trial was because nobody could guarantee her that she would be in the state hospital as opposed to a population in a prison if she pleaded guilty,&#8221; Roman said.<\/p>\n<p>The lesser charge of manslaughter could be a &#8220;compromise position&#8221; for a jury that is struggling in its deliberations, Roman said.<\/p>\n<p>&#8220;Maybe they don&#8217;t find that it was premeditated. Maybe they find that she was off, she was struggling, but she could still conform her conduct to the law,&#8221; she said. &#8220;That&#8217;s your manslaughter charge.
