The states are among 29 that\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/meta-sued-facebook-instagram-children-teens-harm-mental-health\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">sued the tech giant in 2023<\/a><\/span> over child safety and privacy. The other 25 states will go to trial later. The company also faces lawsuits in state courts.<\/p>\n<p> The lawsuit accuses the social media giant of contributing to the youth mental health crisis by knowingly and deliberately designing features that addict children to its platforms. It also argues that Meta routinely collects data on children under 13 without their parents&#8217; consent, in violation of federal law.<\/p>\n<p> &#8220;This week, we&#8217;re in court with the largest consumer protection lawsuit in American history. We&#8217;ll show a jury that Meta concealed what it knew about the harm its products cause young people because looking away was more profitable,&#8221; Kentucky Attorney General Russell Coleman said in a written statement.<\/p>\n<p> Meta said it believes it has a strong case.<\/p>\n<p> &#8220;We are proud of our record in protecting teens on our platforms and the amount of effort that we&#8217;ve put into developing protections over the years, even before these cases were ever filed, and continuing to the present day. We look forward to showing the judge and the jury those facts in court,&#8221; the company said in a written statement.<\/p>\n<p> U.S. District Judge Yvonne Gonzalez Rogers in Oakland will oversee the proceedings, which are expected to last six to eight weeks and include testimony from Meta CEO <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/mark-zuckerberg-ai-essay-takeaways\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Mark Zuckerberg <\/a><\/span>and other executives and former employees. Gonzalez Rogers, appointed to the bench by former president Barack Obama in 2011, has overseen a bevy of complex, high-profile cases involving Big Tech. These include Elon Musk&#8217;s <a href=\"https:\/\/www.cbsnews.com\/news\/musk-openai-lawsuit-dismissed-jury-recommendation\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">lawsuit <\/a>against OpenAI and its founders as well as Epic Games&#8217; <a href=\"https:\/\/www.cbsnews.com\/news\/epic-apple-lawsuit-what-we-learned\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">lawsuit<\/a>\u00a0against Apple over its app store.<\/p>\n<p> If Meta loses the trial, the court would have wide discretion over the size of any financial penalty, and legal experts say anything close to $1.4 trillion would be unlikely.<\/p>\n<p> The trial is the latest in an avalanche of lawsuits against Meta Platforms and other social media companies including Google&#8217;s YouTube, TikTok and Snap, over arguments that their platforms harm young people, illegally collect their data and are deliberately designed to addict them.<\/p>\n<p>Earlier this month, a U.S. federal appeals court denied Meta&#8217;s appeal, <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/social-media-addiction-lawsuits-court-rules\/\" data-invalid-url-rewritten-http=\"\">clearing the way<\/a><\/span> for thousands of lawsuits alleging that its social media platforms encourage addictive usage can proceed.<\/p>\n<p>In March, Meta and YouTube were\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/meta-youtube-social-media-addiction-lawsuit-verdict\/\" data-invalid-url-rewritten-http=\"\">held legally liable<\/a>\u00a0for creating products that led to harmful and addictive behavior by young users. TikTok and Snapchat parent Snap were named in the original complaint, but settled before the trial began in late January.
