{"id":92249,"date":"2026-08-04T00:08:38","date_gmt":"2026-08-04T00:08:38","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/justice-dept-moves-to-dismiss-jan-6-class-action-lawsuit\/"},"modified":"2026-08-04T00:08:38","modified_gmt":"2026-08-04T00:08:38","slug":"justice-dept-moves-to-dismiss-jan-6-class-action-lawsuit","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/justice-dept-moves-to-dismiss-jan-6-class-action-lawsuit\/","title":{"rendered":"Justice Dept. moves to dismiss Jan. 6 class action lawsuit"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div id=\"article-0\">\n  <!-- lil observer --><br \/>\n      <span class=\"content__observer-marker content__observer-marker--fixed lazyload\"\/><\/p>\n<section class=\"content__body\">\n<p>The Justice Department moved Monday to dismiss a class action lawsuit brought by Jan. 6 defendants under the Federal Tort Claims Act, arguing that the claims brought by the rioters are prohibited because they were filed after the statute of limitations had expired.<\/p>\n<p>&#8220;All the claims in the Complaint are &#8216;forever barred&#8217; due to the failure to timely file the administrative claim with the agency,&#8221; the <a href=\"https:\/\/www.courtlistener.com\/docket\/73101995\/24\/sullivan-v-united-states\/\" target=\"_blank\" rel=\"noopener\">Justice Department said in its filing<\/a>.<\/p>\n<p>The plaintiffs complained of injuries they had suffered on <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/feature\/assault-on-the-us-capitol\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Jan. 6, 2021<\/a><\/span>, due to &#8220;excessive police force.&#8221; The Justice Department said that the plaintiffs submitted forms that &#8220;were only partially completed&#8221; and said some lacked signatures and supporting documentation. \u00a0<\/p>\n<p>Also, under the FTCA, plaintiffs have two years to bring a lawsuit, and there are a few additional deadlines that must be met in order to sue the federal government under the FTCA. The Justice Department noted that the plaintiffs alleged &#8220;that they were injured by the police actions that occurred on January 6, 2021.&#8221; Therefore, the department said in its filing, the rioters had until Jan. 6, 2023, to sue the federal government under the Act.<\/p>\n<p>The Justice Department pointed out that the &#8220;earliest claim of the Named Plaintiffs was dated July 29, 2025,&#8221; well beyond two-year period allowed under the FTCA.<\/p>\n<p>The department argued that the plaintiffs &#8220;knew that they were injured and knew who injured them, but they instead chose to wait until well past the deadline to file the claims.&#8221;\u00a0<\/p>\n<p>On Sunday evening, Acting Attorney General Todd Blanche issued an order rescinding a $1.8 billion &#8220;anti-weaponization&#8221; fund that was meant to compensate allies of President Trump. The order, however, does not include language that would bar government restitution or payouts to convicted Jan. 6 rioters.\u00a0<\/p>\n<p>A former Justice Department lawyer said Blanche&#8217;s unilateral rescission of the &#8220;anti-weaponization&#8221; fund has no legal effect and doesn&#8217;t prevent the fund from being revived in the future.<\/p>\n<section
