Khan, the chief prosecutor of the International Criminal Court, has been removed from his position, the court\u2019s oversight body announced on Friday, after a 20-month-long investigation into allegations that he sexually harassed a subordinate.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The decision came down to an assessment that Mr. Khan had committed \u201cserious misconduct\u201d and a breach of duty.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The I.C.C.\u2019s Assembly of States Parties, the governing body that brings together its 125 member nations, made the decision during a session in New York on Friday. A substantial majority of its members, 82, voted to remove Mr. Khan, according to an official statement released Friday afternoon in New York.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The decision is one that victims\u2019 rights groups and outside watchdogs have been pushing for, but will leave the criminal court searching for leadership at a difficult moment. The investigation into Mr. Khan left the institution without its most visible face for much of the past two years, damaging its credibility at the same time it has confronted <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/07\/13\/us\/politics\/trump-international-criminal-court.html\" title=\"\">attacks<\/a> from the Trump administration.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-155wybs-print\">\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Mr. Khan rocketed to global prominence after he issued an arrest warrant for President Vladimir V. Putin of Russia in 2023, and warrants for Hamas officials and Israeli leaders, including Prime Minister Benjamin Netanyahu, in 2024.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The United States, which is among the countries that have not signed onto the I.C.C., has objected to Mr. Khan\u2019s charges against Israeli officials, and the Trump administration earlier this month announced plans to <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/07\/13\/us\/politics\/trump-international-criminal-court.html\" title=\"\">\u201cdismantle\u201d<\/a> the court.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The removal of Mr. Khan could leave the court in limbo at a moment when it is working on several high-profile cases. Arrest warrants for Israeli leaders remain active; a case against the former president of the Philippines, Rodrigo Duterte, <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/04\/23\/world\/asia\/duterte-icc-trial-drug-war.html\" title=\"\">has been proceeding<\/a>; a Libyan militia commander <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.icc-cpi.int\/libya\/el-hishri\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">was arrested<\/a> earlier this year, and an application for an arrest warrant related to crimes against the Rohingya population in Myanmar has been <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/iimm.un.org\/en\/icc-situation-bangladeshmyanmar#:~:text=On%2027%20November%202024%2C%20the%20Office%20of,humanity%20of%20deportation%20and%20persecution%20of%20Rohingya.\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">under review<\/a>.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Mr. Khan has consistently denied the allegations against him, and his lawyers said <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/x.com\/tayab_ali_\/status\/2080744784704995650\/photo\/1\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">in a statement<\/a> on Friday that \u201cthe decision is unsupported by any lawful or properly reasoned finding.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Mr. Khan\u2019s lawyers pointed to \u201cserious defects\u201d in the process, arguing that the investigation did not prove that sexual misconduct had occurred and that Mr. Khan was not given a comprehensive chance to respond.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-155wybs-print\">\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cMr. Khan will challenge the lawfulness and fairness of the decision through all available legal mechanisms,\u201d they said.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Even so, some external legal experts greeted the decision as a chance for the court to move on at a time when its very existence is under threat.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cThe world in general has moved away from international institutions and solutions,\u201d said Alex Whiting, a professor at Harvard Law School, who said that he thought that the process was ultimately fair, if messy, and that the chance to appoint a new chief prosecutor would give the institution a fresh start.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">\u201cI think the court will be able to move past this,\u201d Mr. Whiting said.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">But closure may be difficult. A new chief prosecutor will need to be elected. Sarah, a lawyer from Malaysia who was then working as a special assistant to Mr. Khan, suggested to colleagues that she was being pressured to engage in sexual activities with Mr. Khan against her will, and they reported the situation internally.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Sarah declined to file a formal complaint so no formal investigation was started then. (Sarah has recently <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/07\/17\/world\/europe\/karim-khan-icc-accusations.html\" title=\"\">made her story public<\/a>, speaking to news outlets on condition of using only her first name.)<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">But by that autumn, <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.dailymail.com\/news\/article-13979123\/British-lawyer-called-Netanyahu-arrested-war-crimes-denies-misconduct-following-harassment-claims.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">newspapers<\/a> had <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.theguardian.com\/law\/2024\/oct\/27\/icc-prosecutor-karim-khan-allegedly-tried-suppress-sexual-misconduct-claims\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">begun<\/a> to report on the existence of the complaint and its fallout.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">After the allegations became public, the I.C.C.\u2019s governing body <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2024\/11\/11\/world\/middleeast\/icc-prosecutor-misconduct-investigation.html\" title=\"\">announced<\/a> an independent investigation.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-155wybs-print\">\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">A team from the United Nations was asked to look into the allegations. A panel of judges then reviewed the team\u2019s findings. Mr. Khan went on voluntary leave from his position after the investigation began and was later <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/06\/08\/world\/europe\/karim-khan-icc-suspended.html\" title=\"\">suspended<\/a> as it proceeded.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-155wybs-print\">\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">While the U.N. investigators said they found evidence that Mr. Khan engaged in \u201cnon-consensual sexual contact\u201d with Sarah, <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/03\/25\/world\/europe\/sexual-harassment-international-criminal-court-khan.html\" title=\"\">the judges determined<\/a> unanimously that it did not meet the \u201cbeyond a reasonable doubt\u201d legal standard for a finding of misconduct.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Despite that, the I.C.C.\u2019s executive body <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/www.nytimes.com\/2026\/07\/08\/world\/europe\/internal-file-finds-icc-prosecutor-engaged-in-sexual-harassment.html\" title=\"\">later concluded<\/a> that Mr. Khan had sexually harassed Sarah, finding \u201cbeyond a reasonable doubt\u201d that the prosecutor had engaged in a sexual relationship with her, and that \u201cin the context of that power imbalance a sexual relationship could never be appropriate.\u201d<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">In her talks with investigators through the years and in an interview last week with <a class=\"css-bhdv0x-linkClass\" href=\"https:\/\/edition.cnn.com\/2026\/07\/16\/europe\/icc-prosecutor-allegations-interview-un-investigation-amanpour-intl\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">CNN<\/a>, Sarah described how sexual attention from Mr. Khan escalated over time, starting after she began working for him as an assistant in 2023.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">She said Mr. Khan used their proximity on work trips to pursue a sexual relationship with her.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">The international court, officially established in 2002 and based in The Hague, has a mission to investigate and prosecute genocide, war crimes and other serious offenses.<\/p>\n<p class=\"css-aa8b97-Paragraph-baseStyles-paragraphTreatmentStyles-print evys1bk0\">Mr. Khan was elected by the I.C.C.\u2019s participating countries in 2021 to serve a nine-year term, and the investigation into his conduct has left the court in a state of extended uncertainty.
