A.I. technologies now compete with The Times as a source of information, the news outlet argued in its suit.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The Times claimed in its suit that OpenAI and Microsoft infringed on its copyrights. The media company also accused Microsoft of \u201ccontributory\u201d infringement, in part because it provided the computing power that OpenAI used to build its A.I. technologies.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">In a filing in the U.S. District Court for the Southern District of New York on Thursday, The Times accused Microsoft of encouraging OpenAI to train its A.I. systems using copyrighted articles from The Times and of providing services designed to help with this training.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-140ip4z e1me5xab0\">The Times also dropped a claim from its original lawsuit, filed in 2023, accusing OpenAI of \u201csecondarily\u201d infringing on its copyrights because it did not prevent consumers and businesses from generating copyrighted material using A.I.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">\u201cAs we have long alleged, Microsoft actively encouraged OpenAI to steal our copyrighted works. Beyond amending that claim and streamlining the case to its most potent arguments, our core claims remain the same from the day we filed this lawsuit,\u201d Graham James, a Times spokesman, said in a statement.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">OpenAI and Microsoft did not immediately respond to requests for comment. OpenAI and Microsoft have previously denied wrongdoing, saying they respect the rights of content creators. OpenAI has also <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/02\/27\/technology\/openai-new-york-times-lawsuit.html\" title=\"\">argued in a court filing<\/a> that ChatGPT is not a substitute for a Times subscription.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">The Times was the first major American media company to sue OpenAI over copyright issues related to its written works. <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/09\/20\/books\/authors-openai-lawsuit-chatgpt-copyright.html\" title=\"\">Novelists<\/a>, computer programmers and <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/07\/10\/arts\/sarah-silverman-lawsuit-openai-meta.html\" title=\"\">other groups<\/a> have also filed copyright suits against OpenAI and other companies that build A.I. technologies. There are now more than <a class=\"css-yywogo\" href=\"https:\/\/chatgptiseatingtheworld.com\/2025\/08\/27\/latest-map-of-copyright-suits-v-ai-companies-2-cases-tentatively-settle-aug-27-2025\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">40 cases around the country<\/a>.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">In a settlement last September, Anthropic, one of OpenAI\u2019s primary rivals, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/09\/05\/technology\/anthropic-settlement-copyright-ai.html\" title=\"\">agreed to pay $1.5 billion<\/a> to a group of authors and publishers after a judge ruled it had illegally downloaded and stored millions of copyrighted books.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-140ip4z e1me5xab0\">In December, The Times <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/12\/05\/technology\/new-york-times-perplexity-ai-lawsuit.html\" title=\"\">filed another lawsuit<\/a> claiming that its copyrights were repeatedly violated by Perplexity, an A.I. start-up that has built an internet search engine.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">Like other A.I. companies, OpenAI built its technologies by feeding them enormous amounts of digital data, some of which is copyrighted. A.I. companies have long claimed that they can legally use copyrighted material to train their systems without paying for it because they transformed the material for a different use.<\/p>\n<p class=\"css-140ip4z e1me5xab0\">In accusing OpenAI of infringing on its copyrights on Thursday, The Times cited several examples of an OpenAI chatbot providing users with near-verbatim excerpts from
