last.<\/p>\n<p>Delta would be shelling out approximately $2.3 million in total if all 76\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/minnesota\/news\/passenger-delta-plane-flips-upside-down-reaction-toronto\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">passengers<\/a><\/span> that were on its subsidiary Endeavor Air&#8217;s CRJ-900 aircraft took its offer, but one Texas man says he deserves more.\u00a0<\/p>\n<p>In a newly-filed lawsuit, the passenger says being &#8220;suspended upside down&#8221; and &#8220;drenched with jet fuel&#8221; caused him &#8220;severe emotional distress and mental anguish.&#8221; He says he also suffered &#8220;significant injuries to his head, neck, back, knees and face.&#8221;<\/p>\n<p>There may be more lawsuits to come due to the\u00a0<a href=\"https:\/\/www.iata.org\/en\/programs\/passenger\/mc99\/\" target=\"_blank\" rel=\"nofollow noopener\">Montreal Convention<\/a>, an international treaty that governs how airlines are liable for passenger injuries, baggage damage and cargo loss.\u00a0<\/p>\n<figure class=\"embed Passengers have two years to file a lawsuit under the treaty.<\/p>\n<p>Twenty-one people were hospitalized following <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/minnesota\/news\/videos-minneapolis-plane-crash-landing-toronto\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">the crash landing<\/a><\/span>\u00a0of the flight that originated at Minneapolis-St. Paul International Airport. On Thursday, Delta CEO Ed Bastian announced <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/minnesota\/news\/all-passengers-injured-delta-toronto-plane-crash-released-from-hospital\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">all have since been released<\/a><\/span>.<\/p>\n<p>Upon the company&#8217;s offer of $30,000 for each passenger who was aboard the flight, a spokesperson for Delta Care Team informed passengers that &#8220;this gesture has no strings attached and does not affect rights.&#8221;<\/p>\n<p>On Thursday, <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/minnesota\/news\/delta-plane-crash-toronto-pilot\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Delta also released more information on the flight&#8217;s captain and first officer<\/a><\/span> amid false online rumors that both had failed training events.
