The clinic\u2019s actions, which led to her losing custody of the baby after months of bonding with him, \u201chave left irreparable damage to my soul,\u201d <a class=\"css-yywogo\" href=\"https:\/\/www.nbcnews.com\/health\/health-news\/woman-sues-ivf-clinic-birthed-another-couples-baby-rcna192642\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">she said at a news conference<\/a> as reported by NBC News.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a statement issued on Wednesday, Coastal Fertility Specialists said that the clinic \u201cdeeply regrets the distress caused by an unprecedented error that resulted in an embryo transfer mix-up.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWhile this ultimately led to the birth of a healthy child, we recognize the profound impact this situation has had on the affected families, and we extend our sincerest apologies,\u201d the emailed statement said.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ms. Murray\u2019s is among <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/25\/magazine\/ivf-clinic-mixup.html\" title=\"\">a handful of stories<\/a> regarding mix-ups after in vitro fertilization, a procedure that is widely used by people seeking to have children and that has come under new scrutiny with <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/06\/24\/us\/roe-wade-overturned-supreme-court.html\" title=\"\">the repeal of Roe v. Wade<\/a> and the anticipation of President Trump\u2019s policies on reproductive rights. Mr. Trump has said that he hopes to expand the practice and lower its cost, a move that could irk people in more conservative circles.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Stories of <a class=\"css-yywogo\" href=\"https:\/\/www.fertstertreports.org\/action\/showPdf?pii=S2666-3341%2820%2930039-8\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">I.V.F. mix-ups are exceedingly rare<\/a>. Still, those that do occur are harrowing for all involved, often leading to gut-wrenching decisions about a child\u2019s future, sometimes years after the child has been raised by people who are not the biological parents.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe laws on this are not particularly clear, and there aren\u2019t that many of them,\u201d said Mary Ziegler, a law professor at the UC Davis School of Law. \u201cThere have been other mix-up cases like this, but finding clear precedent is challenging.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">According to court documents, Ms. Murray, a single woman, sought out the services of Coastal Fertility Specialists to conceive a child with a chosen sperm donor. Ms. Murray underwent an embryo transfer in May 2023.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Murray said she knew as soon as the child was born, in December 2023, that something hadn\u2019t gone as planned: Ms. Murray, who was described in the lawsuit as a fair-skinned Caucasian woman, had selected a sperm donor who \u201cphysically resembled\u201d her, the lawsuit said. But the child was born with dark skin and appeared to be African American, according to the lawsuit.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ms. Murray said she realized that there had been a mistake at Coastal Fertility, and that she had likely been implanted with the wrong embryo.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Still, Ms. Murray took the child home and cared for him, breastfeeding him and taking him to doctor\u2019s appointments. She avoided friends and family, fearing the obvious conclusion that the child was not hers, and did not post any images on social media. At a family funeral, she draped a blanket over the child\u2019s carrier so no one could see him, according to court documents.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">After her request for a DNA test was denied by a hospital, Ms. Murray said that she took an at-home genetic test in January 2024, which proved her fear: The child she had birthed was not related to her. She let the clinic know and hoped it would inform the couple whose child she had unknowingly carried.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cPotentially, Ms. Murray thought, Coastal Fertility has transferred her embryo to that other couple,\u201d the lawsuit said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The couple who were found to be the biological parents sued Ms. Murray for custody. Despite wanting to keep the child, she gave the boy up to the couple in May 2024, after her lawyers advised that she would not win in a custody dispute, she said.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The statement from Coastal Fertility said that \u201call of Ms. Murray\u2019s embryos have been accounted for and are available to her at any time,\u201d adding it remains committed \u201cto supporting all impacted families with transparency and compassion.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Murray has not seen the child since she gave him up to the other couple in May.
