Shane<\/a>, who is a legal scholar in residence at New York University and the author of <a class=\"css-yywogo\" href=\"https:\/\/cap-press.com\/books\/isbn\/9781531002596\/Separation-of-Powers-Law-Fourth-Edition\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a casebook on separation-of-powers law<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The order follows Mr. Trump\u2019s <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/29\/us\/politics\/trump-firings-officials-legal-test.html\" title=\"\">summary firings of leaders of independent agencies in defiance of statutes<\/a> that bar their removal without cause before their terms are up. Collectively, the moves constitute a major front in <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/05\/us\/trump-federal-law-power.html\" title=\"\">the president\u2019s assault<\/a> on the basic shape of the American government and his effort to seize some of Congress\u2019s constitutional power over it.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The directive applies to various executive branch agencies that Congress established and empowered to regulate aspects of the economy, structuring them to be run by officials the president would appoint to fixed terms but whose day-to-day actions he would not directly control.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Those agencies include the Securities and Exchange Commission, the Federal Trade Commission, the Federal Communications Commission and the National Labor Relations Board. Still, the order applies only partly to one particularly powerful agency, the Federal Reserve, covering issues related to its supervision and regulation of Wall Street, but exempting its decisions related to monetary policy, like raising and lowering interest rates.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump\u2019s order builds on <a class=\"css-yywogo\" href=\"https:\/\/ballotpedia.org\/Presidential_Executive_Order_12291_(Ronald_Reagan,_1981)\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a series of directives<\/a> that trace back to one issued in 1981 by President Ronald Reagan that also required agencies to submit proposed rules to the White House\u2019s Office of Management and Budget. That order, however, did not apply to agencies Congress set up to be independent of the White House.<\/p>\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/www.law.columbia.edu\/faculty\/peter-l-strauss\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Peter L. Strauss<\/a>, professor emeritus of law at Columbia University, said there should be no legal controversy over the order\u2019s requirement that independent agencies consult with the White House about their regulatory plans. Under the Constitution, he noted, the president \u201cmay require the opinion, in writing\u201d of senior officials related to the duties of their offices.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">But, Professor Strauss said, other aspects suggest that Mr. Trump views himself as having the power to direct agency actions \u2014 equivalent to how he can give the military orders as commander in chief \u2014 even if Congress has said otherwise. That, Professor Strauss argued, crosses a line in what has long been the mainstream understanding of the Constitution.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The order declared that the White House\u2019s director of the Office of Management and Budget, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/22\/us\/politics\/russell-vought-office-of-management-and-budget.html\" title=\"\">Russell T. Vought<\/a>, can withhold funding for any projects or initiatives that conflict with Mr. Trump\u2019s policies and priorities.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Specifically, it said, Mr. Vought will have the power to \u201cadjust such agencies\u2019 apportionments by activity, function, project, or object, as necessary and appropriate, to advance the president\u2019s policies and priorities,\u201d including by prohibiting them from expending funds on matters Mr. Trump does not like.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That power for Mr. Vought to restrict agencies\u2019 ability to spend funds that Congress has appropriated for them to use, the order says, is limited: He can do that only \u201cso long as such restrictions are consistent with law.\u201d But another section of the order says the agencies must accept the views of Mr. Trump and Attorney General Pam Bondi on what the law means.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cNo employee of the executive branch acting in their official capacity may advance an interpretation of the law as the position of the United States that contravenes the president or the attorney general\u2019s opinion on a matter of law, including but not limited to the issuance of regulations, guidance, and positions advanced in litigation\u201d without permission, it said.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump has <a class=\"css-yywogo\" href=\"https:\/\/www.donaldjtrump.com\/agenda47\/agenda47-using-impoundment-to-cut-waste-stop-inflation-and-crush-the-deep-state\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">taken the position<\/a> that a 1974 law, the Impoundment Control Act, is unconstitutional. Under that law, Congress restricted presidents\u2019 ability to refuse to spend money that lawmakers had appropriated for programs that the president did not like.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Justice Department has sought to establish that <a class=\"css-yywogo\" href=\"https:\/\/scholarship.law.wm.edu\/facpubs\/433\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">only the solicitor general may speak for the executive branch before the Supreme Court<\/a>. But Congress has also by statute given certain agencies independent litigating authority. The Trump administration apparently seeks to definitively end agencies\u2019 ability to decide what positions to take even in lower court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Since returning to office, Mr. Trump had already challenged a key legal plank of independent agencies by summarily firing the heads of several such organizations. That is in violation of statutes enacted by Congress that protect them from arbitrary termination and say that such officials may be removed before their terms are up only for a good cause, like misconduct.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">For example, he ousted a member of the N.L.R.B. The move disregarded a provision in the <a class=\"css-yywogo\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/29\/153\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">law that created the agency<\/a> that says, \u201cAny member of the board may be removed by the president, upon notice and hearing, for neglect of duty or malfeasance in office, but for no other cause.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He also dismissed a government lawyer who led <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/live\/2025\/02\/10\/us\/trump-news\/a-judge-blocked-trumps-firing-of-a-government-watchdog?smid=url-share\" title=\"\">an independent watchdog agency<\/a> that protects whistle-blowers, despite a similar statute. A judge ordered the official temporarily reinstated, and the Trump administration has <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/16\/us\/trump-supreme-court-special-counsel.html\" title=\"\">appealed to the Supreme Court<\/a>.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Last week, Sarah M. Harris, the acting solicitor general at the Justice Department, in a <a class=\"css-yywogo\" href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/movawxboava\/2025.02.12-OUT-Durbin-530D.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">letter<\/a> to Congress, wrote that the department would not defend the constitutionality of statutes that limit dismissing members of independent agencies before their terms were up.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Harris wrote that the Constitution should not be interpreted as allowing Congress to enact a law \u201cwhich prevents the president from adequately supervising principal officers in the executive branch who execute the laws on the president\u2019s behalf.\u201d She added that the Trump administration would try to get the Supreme Court to overturn <a class=\"css-yywogo\" href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/295us602\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a 1935 precedent<\/a> to the contrary.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ending the independence of such agencies and consolidating power over them in the White House has long been an aim of the conservative legal movement, which sees that goal as a means toward reducing regulations and rules the government has imposed on powerful business interests.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But the movement has lacked the votes to persuade Congress to simply rescind the statutes and abolish or curtail such agencies. Instead, since the Reagan administration, conservative lawyers have developed and pushed an ideology called the unitary executive theory, under which the Constitution should be reinterpreted as not allowing Congress to create any pockets of independence within the government from direct presidential control.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion
