{"id":70661,"date":"2026-03-17T02:00:20","date_gmt":"2026-03-17T02:00:20","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/alleged-capitol-hill-pipe-bomber-argues-charges-should-be-tossed-out-under-trump-pardons\/"},"modified":"2026-03-17T02:00:20","modified_gmt":"2026-03-17T02:00:20","slug":"alleged-capitol-hill-pipe-bomber-argues-charges-should-be-tossed-out-under-trump-pardons","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/alleged-capitol-hill-pipe-bomber-argues-charges-should-be-tossed-out-under-trump-pardons\/","title":{"rendered":"Alleged Capitol Hill pipe bomber argues charges should be tossed out under Trump pardons"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div id=\"\">\n<p>A man who was accused of <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/brian-cole-jr-dc-pipe-bomb-case-plea\/\" data-invalid-url-rewritten-http=\"\">planting pipe bombs<\/a><\/span> outside the Republican National Committee and Democratic National Committee headquarters on the eve of the Jan. 6 attack in 2021 is asking a judge to dismiss the criminal charges against him, arguing he is covered by President Trump&#8217;s sweeping pardons of alleged Jan. 6 rioters.<\/p>\n<p>Monday&#8217;s motion from lawyers for Brian Cole Jr. marks the latest twist in a case that remained unsolved for years \u2014 and the latest test of how extensively the Jan. 6 pardons could apply.<\/p>\n<p>His attorneys <a href=\"https:\/\/www.courtlistener.com\/docket\/72099987\/56\/united-states-v-cole\/\" target=\"_blank\" rel=\"nofollow noopener\">argued<\/a>\u00a0that the charges against Cole, who has pleaded not guilty, are &#8220;inextricably and demonstrably tethered&#8221; to the events of Jan. 6. \u00a0<\/p>\n<p>They pointed to <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.288124\/gov.uscourts.dcd.288124.17.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">filings by prosecutors that say<\/a> Cole told the FBI he had traveled to Washington, D.C., to attend a 2020 election-related protest, which suggests he was part of &#8220;the same political controversy that animated the January 6 crowd.&#8221; And they note that, even though the bombs were allegedly planted on Jan. 5, they were discovered on the following afternoon.<\/p>\n<p>&#8220;The Pardon\u2014like it or not\u2014applies to Mr. Cole, based on the ordinary and plain meaning of the Pardon&#8217;s language as applied to the relevant facts in this case,&#8221; Cole&#8217;s lawyers wrote.<\/p>\n<p>Cole was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/brian-cole-jr-dc-pipe-bomb-case-plea\/\" data-invalid-url-rewritten-http=\"\">charged late last year<\/a><\/span> with interstate transportation of explosives and malicious attempt to use explosives, after federal authorities were unable to identify a suspect in the case for almost five years. The bombs did not detonate, but the FBI has said they were viable. Trump administration officials had described solving the case as a top priority.<\/p>\n<p>CBS News has reached out to the Justice Department for comment.\u00a0<\/p>\n<p>The Jan. 6 pardons, issued hours after Mr. Trump returned to the White House last year, granted relief to <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-jan-6-pardons\/\" data-invalid-url-rewritten-http=\"\">around 1,500 riot defendants<\/a><\/span> who were accused of everything from trespassing to assaulting police. The president wiped away criminal convictions for all but 14 of those who were convicted of Jan. 6-related offenses, and directed the Justice Department to seek to dismiss charges against those who had not yet been convicted.<\/p>\n<p>It&#8217;s not clear whether Mr. Trump&#8217;s pardon order applies to Cole. The <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/granting-pardons-and-commutation-of-sentences-for-certain-offenses-relating-to-the-events-at-or-near-the-united-states-capitol-on-january-6-2021\/\" target=\"_blank\" rel=\"nofollow noopener\">order says<\/a> the pardons apply to &#8220;offenses related to events that occurred at or near the United States Capitol on January 6, 2021&#8221; \u2014 and Cole is accused of planting the bombs one day beforehand.<\/p>\n<p>Cole&#8217;s lawyers argue that the phrase &#8220;related to&#8221; could apply to offenses that did not take place on Jan. 6, 2021, as long as they were linked to the events of that day.<\/p>\n<p>This isn&#8217;t the first criminal case that has tested the limits of the Jan. 6 pardons.<\/p>\n<p>In several cases, authorities searched the homes of Jan. 6 defendants and allegedly <a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/kentucky-man-pleads-guilty-felony-conspiracy-charge-actions-during-jan-6-capitol-breach?bm-verify=AAQAAAAM_____1pWSFlsM_USY17smWmYv_UgZeUfbQ8xuwIJRh4Y3rIqymT_h4GYTm5DSDX6RV_-d3seUjFoh1drfDfgxzwCW0lmZESVyPPzoVJ3ldqHx5M3mFI7XJWusqgFJoQ0gxUciXYn7qUNC_jvKHRmo0o_26ZFUIo4bqIEqRK4B98Kf2ZYxqzX6HB1-TxYO5Fg73PTdBllaLgNd0ApM2as5VsbEVVWRQFeKJrzKFDUb37w1u0ymoW6KQSYSBc_k6LzJxZomLOPdMLcp6G0v65NF-QqVB08CTv9uqn9KET6uBM-lrSBnhgl1DStiEAgrRSOXxqBMAzq6Vd2GjoqTzRTbbGD3WmQZQcmfm20mBp1LRPRy-vNFmoS4jPIXyn6b--J4s3gJ9c_7namfWvR7QkPIA\" target=\"_blank\" rel=\"nofollow noopener\">found<\/a> <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/dan-wilson-donald-trump-january-6-capitol-attack-pardon\/\" data-invalid-url-rewritten-http=\"\">unlawful<\/a><\/span> <a href=\"https:\/\/apnews.com\/article\/trump-pardons-capitol-riot-jeremy-brown-4a06a284fd2f8a2bd723b1a26970a2e7\" target=\"_blank\" rel=\"nofollow noopener\">firearms<\/a>, leading the accused rioters to face both Jan. 6 and weapons possession charges. The government <a href=\"https:\/\/apnews.com\/article\/trump-pardons-capitol-riot-jeremy-brown-4a06a284fd2f8a2bd723b1a26970a2e7\" target=\"_blank\" rel=\"nofollow noopener\">has argued in some of those cases<\/a> that the pardons issued by Mr. Trump should cover all charges against them, not just the ones directly tied to the Capitol riot. One defendant was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/dan-wilson-donald-trump-january-6-capitol-attack-pardon\/\" data-invalid-url-rewritten-http=\"\">granted a second pardon<\/a><\/span> to cover his gun charges.<\/p>\n<p>Another rioter, Edward Kelley, was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/edward-kelley-january-6-pardon-life-in-prison-conspiracy-civil-war\/\" data-invalid-url-rewritten-http=\"\">charged separately with<\/a><\/span> both entering the Capitol on Jan. 6 and threatening the FBI agents who investigated him. In his case, federal prosecutors <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.tned.107879\/gov.uscourts.tned.107879.95.0_1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">argued<\/a> Mr. Trump&#8217;s pardon did not cover the charges related to threats against the FBI, pushing back on Kelley&#8217;s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.tned.107879\/gov.uscourts.tned.107879.94.0_1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">motion to dismiss<\/a>. He was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/edward-kelley-january-6-pardon-life-in-prison-conspiracy-civil-war\/\" data-invalid-url-rewritten-http=\"\">sentenced to life in
