Jeanine Pirro wrote Monday that the &#8220;government has determined in its prosecutorial discretion that dismissal of this criminal case is in the interests of justice.&#8221; She asked a judge to <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.237437\/gov.uscourts.dcd.237437.207.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">dismiss the indictment<\/a> against Bannon with prejudice, meaning it cannot be refiled. Pirro added that Bannon did not oppose the move.<\/p>\n<p>Bannon, a media personality and former White House chief strategist, was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/steve-bannon-verdict-jan-6-criminal-contempt-congress-trial\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">convicted<\/a><\/span> of contempt of Congress after he declined to comply with a subpoena from the House Jan. 6 panel for testimony and documents. He spent about <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/steve-bannon-released-prison\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">four months in prison<\/a><\/span> in 2024.<\/p>\n<p>Lawmakers on the committee had <a href=\"https:\/\/docs.house.gov\/meetings\/IJ\/IJ00\/20211019\/114156\/HMTG-117-IJ00-20211019-SD001.pdf\" target=\"_blank\" rel=\"nofollow noopener\">subpoenaed Bannon<\/a> as part of a sweeping investigation into the events leading up to the Jan. 6 riot, including the alleged push by President Trump and his allies to overturn the results of the election. Bannon was not formally a part of Mr. Trump&#8217;s team at the time, but he was a vocal supporter of the president&#8217;s efforts. In its subpoena, the committee <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/steve-bannon-criminal-contempt-january-6-subpoena-house-vote\/\" data-invalid-url-rewritten-http=\"\">pointed to Bannon&#8217;s remarks<\/a><\/span> on Jan. 5, 2021, that &#8220;all hell is going to break loose tomorrow.&#8221;<\/p>\n<p>Bannon <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/steve-bannon-subpoena-january-6-select-committee\/\" data-invalid-url-rewritten-http=\"\">did not comply<\/a><\/span> with the subpoena, telling the committee the information that lawmakers wanted was subject to executive privilege, a legal doctrine that allows presidents to withhold certain information. The House \u2014 which had a Democratic majority at the time \u2014 <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/steve-bannon-criminal-contempt-january-6-subpoena-house-vote\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">voted to recommend charging Bannon with contempt of Congress<\/a><\/span> in 2021, and the Justice Department <a href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/stephen-k-bannon-indicted-contempt-congress\" target=\"_blank\" rel=\"nofollow noopener\">brought charges against him<\/a> soon after that.<\/p>\n<p>Days before his mid-2022 jury trial, Bannon&#8217;s attorneys <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/steve-bannon-january-6-committee-testify-subpoena\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">changed course<\/a><\/span> and said he would be willing to testify, writing that &#8220;circumstances have now changed&#8221; and Mr. Trump had chosen to waive executive privilege. Bannon was still found guilty by a D.C.-based jury and sentenced to jail time.<\/p>\n<p>Despite finishing his prison sentence in October 2024, Bannon is still challenging his conviction, asking <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-453\/379338\/20251010090054995_USSC%20Petition%20for%20Writ%20of%20Certiorari.pdf\" target=\"_blank\" rel=\"nofollow noopener\">the Supreme Court<\/a> to take up his case last year. Bannon <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/steve-bannon-verdict-jan-6-criminal-contempt-congress-trial\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">has argued<\/a><\/span> that he didn&#8217;t willfully defy the subpoena, and instead was following his lawyers&#8217; advice to hold off on complying until executive privilege issues could be worked out. He has also cast his contempt case as politically motivated.<\/p>\n<p>On Monday, the Justice Department <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-453\/395803\/20260209141144273_25-453_Bannon_cert_resp_file.pdf\" target=\"_blank\" rel=\"nofollow noopener\">asked the Supreme Court<\/a> to <a href=\"https:\/\/d3i6fh83elv35t.cloudfront.net\/static\/2024\/05\/bannon.pdf\" target=\"_blank\" rel=\"nofollow noopener\">vacate an appellate ruling<\/a> that upheld Bannon&#8217;s conviction and send the matter back to the district court.<\/p>\n<p>The Justice Department&#8217;s efforts to toss out Bannon&#8217;s case come amid another high-profile debate over contempt of Congress.<\/p>\n<p>Lawmakers on the House Oversight Committee <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/house-oversight-committee-bill-hillary-clinton-contempt-vote-epstein-investigation\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">voted to recommend<\/a><\/span> holding Bill and Hillary Clinton in contempt last month after the former president and secretary of state refused to testify in an investigation into Jeffrey Epstein. Shortly before the full House was set to take up the issue, the Clintons said they were <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/clintons-house-oversight-subpoena-contempt-deal-testimony\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">willing to appear for depositions<\/a><\/span>. The oversight panel&#8217;s chair, Republican Rep. James Comer of Kentucky, <a href=\"https:\/\/oversight.house.gov\/release\/chairman-comer-announces-the-clintons-caved-will-appear-for-depositions\/\" target=\"_blank\" rel=\"nofollow
