The president has long insisted \u2014 without evidence \u2014 that he lost the 2020 race due to fraud, claims that were <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/mesa-county-election-fraud-tina-peters\/\" data-invalid-url-rewritten-http=\"\">promoted by Peters<\/a><\/span>, a onetime candidate for Colorado secretary of state.<\/p>\n<p>Colorado Secretary of State Jena Griswold said in a statement Thursday that &#8220;Tina Peters was convicted by a jury of her peers for state crimes in a state Court. Trump has no constitutional authority to pardon her. His assault is not just on our democracy, but on states&#8217; rights and the American constitution.&#8221;<\/p>\n<p>&#8220;One of the most basic principles of our constitution is that states have independent sovereignty and manage our own criminal justice systems without interference from the federal government,&#8221; Colorado Attorney General Phil Weiser said in a separate statement. &#8220;The idea that a president could pardon someone tried and convicted in state court has no precedent in American law, would be an outrageous departure from what our constitution requires, and will not hold up.&#8221;<\/p>\n<p>A former Mesa County clerk, Peters was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/tina-peters-convicted-colorado-election-case\/\" data-invalid-url-rewritten-http=\"\">convicted in state court<\/a><\/span> last year on seven charges, including three counts of attempting to influence a public servant and one count of conspiracy to commit criminal impersonation. She was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/former-mesa-county-clerk-tina-peters-sentenced-colorado-election-interference-case\/\" data-invalid-url-rewritten-http=\"\">sentenced<\/a><\/span>\u00a0in October 2024.\u00a0<\/p>\n<p>Prosecutors have <a href=\"https:\/\/www.documentcloud.org\/documents\/21402023-indictment\/\" target=\"_blank\" rel=\"nofollow noopener\">alleged that in 2021<\/a>, Peters and others &#8220;devised and executed a deceptive scheme&#8221; to cause an unauthorized person to access Mesa County voting machines. Images from the county&#8217;s voting equipment later showed up online. Prosecutors <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/tina-peters-convicted-colorado-election-case\/\" data-invalid-url-rewritten-http=\"\">said that<\/a><\/span> Peters \u2014 who was aligned with national figures who have falsely claimed that voting machines were rigged in 2020 \u2014 became &#8220;fixated&#8221; on alleged voting problems.<\/p>\n<p>At a sentencing hearing late last year, Judge Matthew Barrett called Peters a &#8220;charlatan&#8221; and &#8220;as defiant as a defendant as this court has ever seen.&#8221; Peters has <a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-steve-bannon-voting-donald-trump-a56558112632ff2bfb21667e512c84c9\" target=\"_blank\" rel=\"nofollow noopener\">denied wrongdoing<\/a>, and she <a href=\"https:\/\/apnews.com\/article\/tina-peters-colorado-clerk-election-vote-fraud-b456ce4f80dc97f4b967eb6297311a51%5D\" target=\"_blank\" rel=\"nofollow noopener\">insisted before her sentencing<\/a> that she had &#8220;never done anything with malice to break the law.&#8221;<\/p>\n<p>Earlier this week, a federal magistrate judge <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/tina-peters-colorado-judge-denies-bid\/\" data-invalid-url-rewritten-http=\"\">rejected Peters&#8217; request<\/a><\/span> to be released while she appeals her conviction.<\/p>\n<p>Mr. Trump has taken an interest in Peters&#8217; case, <a href=\"https:\/\/www.cpr.org\/2025\/08\/21\/trump-repeats-demand-tina-peters-released-from-prison\/\" target=\"_blank\" rel=\"nofollow noopener\">warning in August<\/a> that he would take &#8220;harsh measures&#8221; if she wasn&#8217;t let out of state custody. The Federal Bureau of Prisons asked the state of Colorado last month to transfer her to federal custody, <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/colorado\/news\/colorado-gov-jared-polis-transfer-tina-peters\/\" data-invalid-url-rewritten-http=\"\">drawing pushback from state officials<\/a><\/span> and calls for Democratic Gov. Jared Polis to deny the request.<\/p>\n<p>Meanwhile, an attorney representing Peters <a href=\"https:\/\/tinapeters.us\/wp-content\/uploads\/2025\/12\/Sup._Cover_Letter_for_Application_for_Pardon_for_Tina_Peters.pdf\" target=\"_blank\" rel=\"nofollow noopener\">argued in a letter<\/a>\u00a0last week that Mr. Trump may have the power to pardon the former Mesa County clerk.\u00a0<\/p>\n<p>Under the Constitution, the president&#8217;s pardon power <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artII-S2-C1-3-1\/ALDE_00013316\/\" target=\"_blank\" rel=\"nofollow noopener\">applies<\/a> to &#8220;Offences against the United States,&#8221; which is almost universally understood not to include state crimes. But Peters&#8217; lawyer, Peter Ticktin, <a href=\"https:\/\/coloradonewsline.com\/wp-content\/uploads\/2025\/12\/Sup.-Cover-Letter-for-Application-for-Pardon-for-Tina-Peters.pdf\" target=\"_blank\" rel=\"nofollow noopener\">laid out<\/a> a theory that the power could extend to the states. Ticktin acknowledged that the issue &#8220;has never been raised in any court.&#8221;<\/p>\n<p>CBS News has reached out to the White House and Ticktin for comment.<\/p>\n<p>Mr. Trump has intervened on behalf of others who back his false election fraud claims. Shortly after his inauguration in January, Mr. Trump <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-jan-6-pardons\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">offered pardons or commutations<\/a><\/span> to everybody convicted in the Capitol riot on Jan. 6, 2021.\u00a0<\/p>\n<p>The president <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-pardons-dozens-overturn-2020-election-results-false-electors\/\" data-invalid-url-rewritten-http=\"\">also granted pardons last month<\/a><\/span> to dozens of people accused in state court of trying to overturn his 2020 election loss, including &#8220;alternate state electors&#8221; and his former personal lawyer Rudy Giuliani.<\/p>\n<section
