They admit that they did. Instead, the focus of the case has long been on why they did it. They say they killed out of fear and in self-defense after a lifetime of physical, emotional and sexual abuse suffered at the hands of their parents. But then, about six months after the crime, in March 1990, police got a tip from an unlikely source: Judalon Smyth, the girlfriend of a psychologist who Lyle and Erik Menendez had been talking to. Alan Andersen, Lyle and Erik&#8217;s cousin, was one of those witnesses.<\/p>\n<p>While Andersen never saw Lyle and Erik Menendez being sexually abused, he did recall something he says was odd. They pointed to money as the motive and argued the killings were premeditated since the brothers purchased shotguns days in advance. Ultimately, it will be up to a judge to decide whether the convictions should be vacated. If they are, then it would be up to the D.A&#8217;s office as to whether they would retry the case. As Lyle Menendez <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/menendez-brothers-await-decision-they-hope-will-free-them-48-hours\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">awaits a judge&#8217;s ruling<\/a><\/span>, he spoke to &#8220;48 Hours&#8221; contributor Natalie Morales.<\/p>\n<p>He told Morales that when he heard about the new evidence, he was happy. &#8220;&#8216;Cause it&#8217;s a burden to be telling what happened to you and just have so much doubt in the public air,&#8221; he said.<\/p>\n<h2>Menendez case under review by DA&#8217;s office<\/h2>\n<p>On Oct 3, 2024, Los Angeles County District Attorney George Gasc\u00f3n said the <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/losangeles\/news\/menendez-murder-case-will-be-reviewed-amid-potential-new-evidence-los-angeles-da-says\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Men\u00e9ndez murder case<\/a><\/span> is being reviewed by his office, naming two new factors that prosecutors are looking at. Gasc\u00f3n said that there could be potential for resentencing or possibly even a new trial.<\/p>\n<h2>Prosecutors recommend resentencing of the Menendez brothers<\/h2>\n<p>On Oct. 24, 2024, Gasc\u00f3n announced he will\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/menendez-brothers-murder-case-sentencing-george-gascon-recommendation\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">ask the court for resentencing<\/a><\/span>\u00a0in the case of Erik and Lyle Menendez, decades after the brothers were sentenced to life without parole for the 1989 killings of their parents in Beverly Hills. If the judge accepts his recommendation, the brothers would be immediately eligible for parole, he said. \u00a0<\/p>\n<p>Gasc\u00f3n said he will ask the judge to consider resentencing the brothers to 50 years to life. Because they committed the crimes when they were under the age of 26 years old, they would be eligible for parole, he said. Gasc\u00f3n said the final decision will be made by the judge, and then it would go before a parole board, which will determine if the brothers should be released.\u00a0<\/p>\n<h2>New DA asks court to deny their petition seeking a new trial<\/h2>\n<p>On Feb. 21, 2025, Los Angeles County District Attorney Nathan Hochman filed a response to the\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/losangeles\/news\/menendez-brothers-case-update-to-be-given-by-la-county-da-hochman\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Menendez brothers&#8217; habeas petition<\/a><\/span>\u00a0urging a judge to deny it. It is unclear when a ruling will be made in the case.<\/p>\n<h2>Menendez brothers resentenced<\/h2>\n<p>In May 2025, the brothers were resentenced to 50 years to life with the possibility of parole.
