Mr. Trump pleaded not guilty and denied any wrongdoing.<\/p>\n<figure class=\"embed embed--type-image is-image embed--float-none embed--size-medium\">\n<p>      <span class=\"img embed__content\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/assets3.cbsnewsstatic.com\/hub\/i\/r\/2025\/08\/26\/9a48921a-6ba2-4be2-bb01-903e8c2d465b\/thumbnail\/620x482g3\/78dc28adf09c61d5f28cf7700cb44f0d\/gettyimages-1573745034.jpg#\" alt=\"Special Prosecutor Jack Smith addresses reporters after his grand jury has issued more indictments of former President Donald Trump on August 01 in Washington, DC. \" height=\"482\" width=\"620\" class=\" lazyload\" srcset=\"https:\/\/assets3.cbsnewsstatic.com\/hub\/i\/r\/2025\/08\/26\/9a48921a-6ba2-4be2-bb01-903e8c2d465b\/thumbnail\/620x482g3\/78dc28adf09c61d5f28cf7700cb44f0d\/gettyimages-1573745034.jpg 1x, https:\/\/assets2.cbsnewsstatic.com\/hub\/i\/r\/2025\/08\/26\/9a48921a-6ba2-4be2-bb01-903e8c2d465b\/thumbnail\/1240x964g3\/eef6d542cabe73500dca45c3bfe154f6\/gettyimages-1573745034.jpg 2x\" loading=\"lazy\"\/><\/span><figcaption class=\"embed__caption-container\">\n<p>                  <span class=\"embed__caption\">File: Special Prosecutor Jack Smith addresses reporters after his grand jury has issued more indictments of former President Donald Trump  in<\/span><\/p>\n<p>                  <span class=\"embed__credit\"><\/p>\n<p>                Photo by Bill O&#8217;Leary\/The Washington Post via Getty Images<\/p>\n<p>                          <\/span><br \/>\n              <\/figcaption><\/figure>\n<p>Monday&#8217;s letter, a copy of which was obtained by CBS News, was the first response from Smith and his representatives after the independent federal agency confirmed that it had launched an investigation into Smith for potential violations of <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/what-is-the-hatch-act-violations-examples-penalty-government\/\" data-invalid-url-rewritten-http=\"\">the Hatch Act<\/a><\/span>, a federal law that &#8220;limits certain political activities of federal employees.&#8221;<\/p>\n<p>In a three-page letter to the acting head of the office, Jamieson Greer, Smith&#8217;s attorneys Lanny Breuer and Peter Koski, said there is &#8220;no basis&#8221; for an accusation that Smith violated the Hatch Act and that the allegations of wrongdoing are &#8220;wholly without merit.&#8221;\u00a0<\/p>\n<p>&#8220;Mr. Smith was fiercely committed to making prosecutorial decisions based solely on the evidence, he steadfastly followed applicable Department of Justice guidelines and the Principles of Federal Prosecution, and he did not let the pending election influence his investigative or prosecutorial decision-making,&#8221; Smith&#8217;s attorneys said.<\/p>\n<p>Smith was appointed by then-<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/garland-to-condemn-attacks-threats-against-justice-dept-employees\/\" data-invalid-url-rewritten-http=\"\">Attorney General Merrick Garland<\/a><\/span> in November 2022 to take over the two investigations, but <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/jack-smith-special-counsel-oversaw-trump-investigations-resigns-justice-department\/\" data-invalid-url-rewritten-http=\"\">resigned in January<\/a><\/span>, days before Mr. Trump returned to office.\u00a0<\/p>\n<p>GOP Sen. Tom Cotton of Arkansas called for an investigation into Smith&#8217;s conduct and alleged that Smith had pushed for a &#8220;rushed trial&#8221; of Trump before the 2024 presidential election.<\/p>\n<p>&#8220;They were the actions of a political actor masquerading as a public official,&#8221;<a href=\"https:\/\/x.com\/SenTomCotton\/status\/1950616831397642291\" target=\"_blank\" rel=\"nofollow noopener\"> Cotton wrote on X<\/a>. &#8220;That&#8217;s why I&#8217;ve asked this unprecedented interference in the 2024 election be immediately investigated by OSC.&#8221;<\/p>\n<p>Smith&#8217;s attorneys, however, argued that politics did not play a role in the prosecutions and that no laws prohibited Smith from continuing his prosecutions into Mr. Trump going into the home stretch of the campaign trail.<\/p>\n<p>&#8220;This investigation is premised on a partisan complaint that suggests the ordinary operation of the criminal justice system should be disrupted by the whims of a political contest. But the notion that justice should yield to politics is antithetical to the rule of law,&#8221; Smith&#8217;s attorneys wrote. &#8220;Moreover, the suggestion that the Hatch Act can be violated by taking routine procedural steps to prosecute a case involving a candidate for public office is unprecedented and risks interfering with the enforcement of our federal criminal laws.&#8221;<\/p>\n<p>Smith&#8217;s actions, the attorneys said, &#8220;were consistent with the decisions of a prosecutor who has devoted his career to following the facts and the law, without fear or favor and without regard for the political consequences, not because of them.&#8221;<\/p>\n<p>In May, Mr. Trump chose right-wing podcast host and MAGA loyalist<a href=\"https:\/\/www.cbsnews.com\/baltimore\/video\/trump-nominates-paul-ingrassia-to-lead-u-s-office-of-special-counsel\/\" rel=\"nofollow\" data-invalid-url-rewritten-http=\"\"> Paul Ingrassia<\/a> to lead the Office of Special Counsel, but his nomination is stalled in the Senate.
