He has <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/kilmar-abrego-garcia-arraignment-human-trafficking\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">pleaded not guilty<\/a><\/span>.\u00a0<\/p>\n<p>His return came weeks after a federal judge in Maryland <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/maryland-father-deported-kilmar-abrego-garcia-cecot-administrative-error\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">ordered the Trump administration<\/a><\/span> to facilitate Abrego Garcia&#8217;s release from Salvadoran custody, which was affirmed by the Supreme Court. A U.S. immigration official had acknowledged Abrego Garcia&#8217;s <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/kilmar-abrego-garcia-el-salvador-deported-chris-van-hollen\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">deportation to El Salvador<\/a><\/span> was an administrative error, as he had been granted a legal status in 2019 that prevented the Department of Homeland Security from removing Abrego Garcia to his home country because of likely persecution by local gangs.<\/p>\n<p>After Abrego Garcia was brought back to the U.S. to face the human smuggling offenses, the Justice Department requested he remain detained while awaiting trial. But Holmes earlier this month <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/kilmar-abrego-garcias-release-ordered-remain-detained-ice\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">rejected that request<\/a><\/span> and said he should be granted pretrial release.<\/p>\n<p>The Justice Department appealed that decision, and a U.S. district judge set a hearing for July 16 on the request to revoke Holmes&#8217; release order.<\/p>\n<p>But during a hearing last week to review the conditions of Abrego Garcia&#8217;s release, lawyers for the Salvadoran man and the Justice Department acknowledged that he would likely be detained by the Department of Homeland Security and deported swiftly after being released from Justice Department custody, which would interfere with his criminal proceeding.\u00a0<\/p>\n<p>Holmes put off issuing her order of release, and Abrego Garcia&#8217;s lawyers <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/kilmar-abrego-garcia-remain-in-federal-custody-justice-department-agrees\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">asked her to delay<\/a><\/span> it further because of what they said are conflicting statements about whether he <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/kilmar-abrego-garcia-smuggling-charges-ice-deportation-trial\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">would be removed<\/a><\/span> to a third country \u2014 one other than El Salvador \u2014 if detained by immigration authorities while awaiting trial.<\/p>\n<p>Federal prosecutors did not oppose the request.<\/p>\n<p>&#8220;A short delay will prevent the government from removing Mr. Abrego and allow time for the government to provide reliable information concerning its intentions,&#8221; Abrego Garcia&#8217;s lawyers wrote in a filing to Holmes.<\/p>\n<p>The magistrate judge agreed to the request and said Abrego Garcia will remain in the custody of U.S. Marshals to allow for the July 16 hearing and a decision on the government&#8217;s bid to revoke his release order.<\/p>\n<p>Holmes said Abrego Garcia should be held separately from others waiting or serving sentences and given a &#8220;reasonable opportunity&#8221; to privately meet with his lawyers.\u00a0<\/p>\n<p>    <!-- data-recirc-source=\"queryly\" --><\/p>\n<aside class=\"component list recirculation component--type-recirculation \">\n<p><h3 class=\"component__title\">More from CBS News<\/h3>\n<\/p>\n<\/aside>\n<p>    <!-- tags --><\/p>\n<div class=\"content-author\">\n      <a href=\"https:\/\/www.cbsnews.com\/team\/melissa-quinn\/\" class=\"content-author__name\" data-invalid-url-rewritten-http=\"\">Melissa  Quinn<\/a><\/p>\n<div class=\"content-author__bio\">\n<div class=\"content-author__full-information\">\n<p class=\"content-author__text\">Melissa Quinn is a politics reporter for CBSNews.com.
