{"id":24049,"date":"2025-05-07T21:07:42","date_gmt":"2025-05-07T21:07:42","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/trump-administration-invokes-state-secrets-privilege-in-kilmar-abrego-garcia-case\/"},"modified":"2025-05-07T21:07:42","modified_gmt":"2025-05-07T21:07:42","slug":"trump-administration-invokes-state-secrets-privilege-in-kilmar-abrego-garcia-case","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/trump-administration-invokes-state-secrets-privilege-in-kilmar-abrego-garcia-case\/","title":{"rendered":"Trump administration invokes state-secrets privilege in Kilmar Abrego Garcia case"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div id=\"\">\n<p><em>Washington \u2014 <\/em>The Trump administration appears to have invoked the state-secrets privilege to withhold information in the case involving the mistaken removal of <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/kilmar-abrego-garcia-el-salvador-deported-chris-van-hollen\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Kilmar Abrego Garcia<\/a><\/span> to El Salvador and any efforts by the Trump administration to return him to the United States.<\/p>\n<p>The administration&#8217;s assertion of the privilege was revealed in an <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.115.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">order<\/a> from U.S. District Judge Paula Xinis, which asked lawyers for Abrego Garcia and the Justice Department to file additional legal papers about the administration&#8217;s &#8220;invocations of privilege, principally the state secrets and deliberative process privileges.&#8221;<\/p>\n<p>Xinis gave the two sides until Monday to submit the filings &#8220;addressing the legal and factual bases for the invocation of those privileges,&#8221; including a request from Abrego Garcia&#8217;s lawyers for the court to conduct a review of &#8220;the withheld documents.&#8221; The judge also set a hearing for May 16 at the courthouse in Greenbelt, Maryland.<\/p>\n<p>The Justice Department had indicated that it would invoke certain privileges to protect information regarding Abrego Garcia&#8217;s removal from the U.S. last month, citing in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.65.0.pdf\" target=\"_blank\" rel=\"nofollow noopener\">filing<\/a> the attorney-client privilege, state secrets privilege and certain executive privileges.<\/p>\n<p>Xinis told a lawyer with the administration during a hearing last month that if they do so, they must provide justifications for each claim, and she will make a determination as to whether they can stand.<\/p>\n<p>The judge had ordered the Trump administration to turn over documents to Abrego Garcia&#8217;s lawyers and allowed them to conduct depositions with certain administration officials. Some of the records were initially due last month, but Xinis <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/judge-kilmar-abrego-garcia-stay\/\" data-invalid-url-rewritten-http=\"\">agreed to push back<\/a><\/span> her deadlines after the Trump administration filed information with the court under seal. One day earlier, Xinis had <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/maryland-trump-administration-kilmar-abrego-el-salvador-questions-deported\/\" data-invalid-url-rewritten-http=\"\">accused the administration<\/a><\/span> of showing a &#8220;willful and bad faith refusal to comply with discovery obligations.&#8221;<\/p>\n<p>Under the judge&#8217;s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.107.0_1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">latest order<\/a>, the Trump administration had until Monday to answer and respond to outstanding discovery requests and provide information about their invocation of privileges. Depositions of four Homeland Security and State Department officials are to be completed by Friday, according to the order.<\/p>\n<p>Xinis <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/kilmar-abrego-garcias-court-trump-deportation-el-salvador-president\/\" data-invalid-url-rewritten-http=\"\">allowed the expedited discovery process<\/a><\/span> to begin last month after Abrego Garcia&#8217;s legal team accused the Trump administration of failing to follow her order to facilitate his return to the U.S. The Supreme Court had <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-maryland-man-deported-to-el-salvador\/\" data-invalid-url-rewritten-http=\"\">agreed that the administration<\/a><\/span> had to facilitate Abrego Garcia&#8217;s release from Salvadoran custody and &#8220;ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.&#8221;<\/p>\n<p>President Trump and other top administration officials have repeatedly said it is up to El Salvador whether to release Abrego Garcia, who was being held at the country&#8217;s notorious Terrorism Confinement Center, or CECOT. As of April 21, he was being held at<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/baltimore\/news\/kilmar-abrego-garcia-transferred-el-salvador-maryland-van-hollen\/\" data-invalid-url-rewritten-http=\"\">\u00a0a lower-security facility<\/a><\/span>\u00a0in Santa Ana, according to a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.578815\/gov.uscourts.mdd.578815.97.0_1.pdf\" target=\"_blank\" rel=\"nofollow noopener\">declaration<\/a> from a State Department official.<\/p>\n<p>Abrego Garcia, who was born in El Salvador, entered the U.S. illegally in 2011 and has been living in Maryland since then. He was granted a withholding of removal, a legal status, in 2019 that prevented the government from deporting him back to his home country of El Salvador because of a risk of persecution by local gangs.<\/p>\n<p>But Abrego Garcia was among the hundreds of migrants <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/venezuelans-deported-el-salvador-names\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">sent by the Trump administration<\/a><\/span> to CECOT in March.<\/p>\n<p>A federal immigration official acknowledged that his removal to El Salvador was an &#8220;administrative error,&#8221; but the administration has since declined to return him to the U.S. Instead, top administration officials <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-claim-kilmar-abrego-garcias-finger-tattoos-ms-13\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">have claimed<\/a><\/span> Abrego Garcia is a member of the gang MS-13, citing allegations from a confidential informant.
