{"id":23935,"date":"2025-05-07T10:13:56","date_gmt":"2025-05-07T10:13:56","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/what-happened-when-trump-altered-the-deal-with-law-firms-and-universities\/"},"modified":"2025-05-07T10:13:56","modified_gmt":"2025-05-07T10:13:56","slug":"what-happened-when-trump-altered-the-deal-with-law-firms-and-universities","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/what-happened-when-trump-altered-the-deal-with-law-firms-and-universities\/","title":{"rendered":"What Happened When Trump Altered the Deal With Law Firms and Universities"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">A few weeks ago, several prominent American universities and law firms found themselves in what seemed to be a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/1986\/06\/17\/science\/prisoner-s-dilemma-has-unexpected-applications.html\" title=\"\">classic prisoner\u2019s dilemma<\/a>, courtesy of President Trump.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">His campaign of retribution against law firms that represented or hired his political opponents, and against universities that engaged in \u201cwoke\u201d policies or purportedly fostered antisemitism, was forcing them to make an unappealing choice.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Those who capitulated and struck an early deal with the White House, it seemed, might be spared the worst of Mr. Trump\u2019s wrath, but at the cost of <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/09\/us\/politics\/trump-law-firms-orders.html\" title=\"\">jeopardizing their independence<\/a>. Standing up to the president risked even harsher punishment, particularly if other institutions stayed silent.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Columbia University made a deal with the administration. So did some of the largest law firms in the country. Recent changes, however, suggest that the dilemma is starting to look very different.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Last month, Harvard became the first university to announce that it <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/14\/us\/harvard-trump-reject-demands.html\" title=\"\">would not comply<\/a> with the administration\u2019s demands, which it called \u201cillegal.\u201d Other universities moved from collective silence to unified opposition: \u201cWe speak with one voice against the unprecedented government overreach and political interference now endangering American higher education,\u201d more than 400 university leaders said in a <a class=\"css-yywogo\" href=\"https:\/\/www.aacu.org\/newsroom\/a-call-for-constructive-engagement\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">statement<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Several large law firms sued to block the executive orders targeting them, winning temporary injunctions. Hundreds of other firms signed on in support of the effort. And on Thursday, Microsoft dropped a law firm that cut a deal with the White House, and hired one of dissenting firms to represent it in a high-profile case.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The previous dynamics are no longer holding true. So what changed?<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe had been thinking about this as the prisoners\u2019 dilemma, but we were wrong,\u201d said Tom Pepinsky, a political scientist at Cornell University.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-5e88521d\">An untrustworthy jailer<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">In the famous prisoner\u2019s dilemma thought experiment, two \u201cprisoner\u201d players \u2014 unable to communicate with each other \u2014 must decide whether to cooperate for mutual benefit, or betray each other for individual gain. If neither confesses to a crime, both get light sentences. If one confesses, that prisoner goes free while the other gets a long sentence. And if both confess, then both serve mid-length sentences.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Even though cooperation with each other \u2014 silence rather than confession \u2014 leads to the greatest collective benefits, the most rational individual decision is to take the jailer\u2019s offer, and confess.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">But crucially, one assumption in the prisoner\u2019s dilemma is that the jailer is trustworthy. There is an explicit promise that confessing will allow prisoners to avoid the longest sentence.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the real world, however, instead of rewarding those who capitulated early, the Trump administration pressured them even more.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Columbia University, for example, agreed to concessions that included imposing new oversight over its Middle Eastern studies department and creating a security force empowered to make arrests. But that was not enough to restore the more than $400 million in grants that the Trump administration had canceled, or to prevent the administration from making even more demands.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Law firms like Paul Weiss, which thought they had escaped punishment by agreeing to do pro bono work for uncontroversial causes, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/16\/us\/politics\/law-firms-deals-trump.html\" title=\"\">discovered<\/a> that Mr. Trump saw their agreements as a blank check for them to do his bidding.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">As my colleagues have reported, the law firms discovered that they had agreed to deals that \u201cdid little to insulate them from his whims.\u201d One expert at Yale Law School said the \u201cadministration seems to think that they have subjected these firms to indentured servitude.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Elizabeth Saunders, a political science professor at Columbia, likened the Trump administration\u2019s stance to <a class=\"css-yywogo\" href=\"https:\/\/www.youtube.com\/watch?v=3D8TEJtQRhw\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a famous line from Darth Vader<\/a> in \u201cThe Empire Strikes Back\u201d: \u201cI am altering the deal. Pray I do not alter it any further.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cCapitulation has a track record,\u201d said Ms. Saunders, \u201cand it\u2019s not pretty.\u201d<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-33fbb526\">The expectations game<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">History shows that when the risk-benefit calculus of collective action changes, the consequences can be seismic.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the famous academic paper \u201c<a class=\"css-yywogo\" href=\"https:\/\/www.cambridge.org\/core\/journals\/world-politics\/article\/abs\/now-out-of-never-the-element-of-surprise-in-the-east-european-revolution-of-1989\/B947420222BF565D0B2D93099E704BF2\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Now out of Never<\/a>,\u201d Timur Kuran, a political scientist and economist at Duke University, asked how the 1989 revolutions that brought down communist regimes in Eastern Europe managed to take nearly everyone, including the revolutionaries themselves, by surprise.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The answer, he argued, was that the revolutions were the result of the governments themselves behaving unexpectedly. Their response to protesters was less harsh than had been anticipated and feared, which caused people to reassess the costs of participating in the opposition. And because there was already a large reservoir of silent discontent with the status quo, uprisings grew very rapidly when people stopped hiding their true feelings.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Similarly, when the \u201cdeal\u201d on offer in exchange for capitulating to authority becomes substantially worse, collective action starts to look like a better option.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In Poland, the pro-democracy movement and the Catholic Church made an <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2020\/12\/07\/world\/europe\/poland-abortion-protests.html\" title=\"\">implicit bargain<\/a>: The church would support the movement, in exchange for women giving up some of the reproductive freedoms they had under communism. But years later, when the far-right Law and Justice government came in, it changed the deal, rolling back democracy and also ramping up restrictions on abortion to a near-total ban.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">As a result, people who might once have grudgingly tolerated the government poured into the streets in protest, in the <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2020\/10\/30\/world\/europe\/poland-abortion-women-protests.html\" title=\"\">largest demonstrations<\/a> in Poland since the fall of communism.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-6040c127\">Lawyers in the streets<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Some law firms and universities appeared to be making a similarly rapid shift in their risk-reward calculus in recent weeks.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-7\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">On May 1, about 1,500 demonstrators, many of them lawyers in business attire, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/05\/01\/nyregion\/national-law-day-courthouse-protests.html?smid=nytcore-ios-share&amp;referringSource=articleShare&amp;sgrp=c&amp;pvid=4FED241B-9DF5-406C-9BC4-4F5C9478B1BE\" title=\"\">protested outside Manhattan\u2019s federal courthouse<\/a> as part of the National Law Day of Action \u2014 one of around 50 similar actions around the nation.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The costs of staying silent in the hope of avoiding the administration\u2019s ire may also have been growing. In \u201cNow out of Never,\u201d Kuran wrote about the personal cost of what he calls \u201cpreference falsification\u201d \u2014 suppressing what one truly believes or wants for reasons of self-interest or self-preservation.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe suppression of one\u2019s wants entails a loss of personal autonomy, a sacrifice of personal integrity,\u201d he wrote. \u201cIt thus generates lasting discomfort, the more so the greater the lie.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lynn Pasquerella, the president of the American Association of Colleges and Universities, said she has observed \u201cburgeoning moral distress\u201d among her membership in recent months. \u201cCampus leaders feel like they\u2019re being coerced into making decisions they believe are unethical, but they feel they have no choice,\u201d she said. \u201cIn many instances, that moral distress has morphed into a moral injury that results from the continual erosion of a moral compass.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">And at the same time, the rewards of opposition have become clearer.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cHarvard\u2019s brand has never been stronger in the 25 years I\u2019ve been here than it is right now,\u201d said Steven Levitsky, a Harvard political scientist who coauthored an <a class=\"css-yywogo\" href=\"https:\/\/www.thecrimson.com\/article\/2025\/3\/6\/enos-levitsky-harvard-trump-democracy-fight\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">op-ed<\/a> in March calling on Harvard and other universities to publicly defend democratic freedoms.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-8\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThey worried that their brand was in so much trouble that if they spoke out, Trump would win the battle politically,\u201d he added. \u201cBut it\u2019s been the opposite.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-9\">\n<div class=\"css-53u6y8\">\n<hr class=\"css-7ad88g e1mu4ftr0\"\/>\n<p class=\"css-at9mc1 evys1bk0\"><strong class=\"css-8qgvsz ebyp5n10\">Thank you for being a subscriber<\/strong><\/p>\n<p class=\"css-at9mc1 evys1bk0\">Read past editions of the newsletter <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/column\/the-interpreter\" title=\"\">here<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">If you\u2019re enjoying what you\u2019re reading, please consider recommending it to others.
