It sought to deny automatic citizenship to children born in the United States to parents who were not legal residents. Such bills have been introduced from time to time, and they have never gone anywhere.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Citizenship Reform Act of 1995 was notable mostly because it provoked <a class=\"css-yywogo\" href=\"https:\/\/www.justice.gov\/file\/147026-0\/dl?inline=\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a remarkable statement<\/a> on the deeper meaning of birthright citizenship from one of the witnesses who testified against the bill, a lawyer named Walter Dellinger. A constitutional scholar then in charge of the Office of Legal Counsel, the elite unit of the Justice Department that advises the executive branch on the law, Mr. Dellinger first addressed a question he thought barely worth discussing.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cMy office grapples with many difficult and close issues of constitutional law,\u201d he said. \u201cThe lawfulness of this bill is not among them. This legislation is unquestionably unconstitutional.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That statement anticipated <a class=\"css-yywogo\" href=\"https:\/\/www.seattletimes.com\/seattle-news\/politics\/judge-in-seattle-blocks-trump-order-on-birthright-citizenship-nationwide\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">one on Thursday<\/a> from <a class=\"css-yywogo\" href=\"https:\/\/www.fjc.gov\/history\/judges\/coughenour-john-c\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Judge John C. Coughenour<\/a> of the Federal District Court in Seattle. At a hearing before issuing a temporary restraining order blocking Mr. Trump\u2019s order, Judge Coughenour said: \u201cI\u2019ve been on the bench for over four decades. I can\u2019t remember another case where the question presented is as clear as this one. This is a blatantly unconstitutional order.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">If birthright citizenship is to be revoked, Mr. Dellinger said in 1995, it will require a constitutional amendment. That led to his larger point, which was that changing the rules would be a catastrophic betrayal of American values forged in the Civil War.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cTo adopt such an amendment would not be technically unlawful,\u201d he said, \u201cbut it would flatly contradict our constitutional history and our constitutional traditions.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The idea that children born in the United States automatically become citizens of the United States has deep roots in the common law. But it was not adopted in the constitutional text until 1868, in the first sentence of <a class=\"css-yywogo\" href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the 14th Amendment<\/a>: \u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That sentence overturned <a class=\"css-yywogo\" href=\"http:\/\/www.law.cornell.edu\/supremecourt\/text\/60\/393\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Dred Scott<\/a>, the 1857 Supreme Court decision that affirmed slavery and helped prompt the Civil War.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That history has heft, said Mr. Dellinger, who <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/02\/16\/us\/walter-dellinger-dead.html\" title=\"\">died in 2022<\/a> after a long career in the government and the legal academy and as a leading member of the Supreme Court bar.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cIn its most monumentally erroneous decision, the Supreme Court created a monstrous exception to the common law rule that birth on American soil to a free person was sufficient for American citizenship,\u201d he said. \u201cThe court held that no persons of African descent \u2014 including free persons of African descent \u2014 and none of their descendants for all time to come could ever be citizens of the United States regardless of their birth in America.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cFrom our experience with Dred Scott,\u201d Mr. Dellinger added, \u201cwe had learned that our country should never again trust to judges or politicians the power to deprive from a class born on our soil the right of citizenship.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Dred Scott decision helped lead to the rise of the Republican Party and one of the ruling\u2019s most bitter critics, Abraham Lincoln.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The right should embrace that legacy, <a class=\"css-yywogo\" href=\"https:\/\/www.law.berkeley.edu\/our-faculty\/faculty-profiles\/john-yoo\/#tab_profile\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">John Yoo<\/a>, a law professor at the University of California, Berkeley, and a former official in the George W. Bush administration, <a class=\"css-yywogo\" href=\"https:\/\/www.aei.org\/articles\/settled-law-birthright-citizenship-and-the-14th-amendment\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">wrote in 2018<\/a>, after Mr. Trump first started talking about his opposition to birthright citizenship.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cConservatives should reject Trump\u2019s nativist siren song,\u201d he wrote, \u201cand reaffirm the law and policy of one of the Republican Party\u2019s greatest achievements: the 14th Amendment.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump and his allies focus on a phrase in the 14th Amendment that limits birthright citizenship to those \u201csubject to the jurisdiction\u201d of the United States.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That phrase has a straightforward meaning, <a class=\"css-yywogo\" href=\"https:\/\/www.fjc.gov\/history\/judges\/ho-james-c\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">James C. Ho<\/a>, a lawyer who later became a federal judge, wrote in a careful and thorough <a class=\"css-yywogo\" href=\"https:\/\/www.gibsondunn.com\/wp-content\/uploads\/documents\/publications\/Ho-DefiningAmerican.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">2016 article<\/a> in <a class=\"css-yywogo\" href=\"https:\/\/www.greenbag.org\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">The Green Bag<\/a>, a legal journal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt excludes those persons who, for some reason, are immune from, and thus not required to obey, U.S. law,\u201d he wrote. \u201cMost notably, foreign diplomats and enemy soldiers \u2014 as agents of a foreign sovereign \u2014 are not subject to U.S. law, notwithstanding their presence within U.S. territory.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Aside from those narrow exceptions, he wrote, birthright citizenship \u201cis protected no less for children of undocumented persons than for descendants of Mayflower passengers.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Judge Ho, who sits on the U.S. Court of Appeals for the Fifth Circuit and has been mentioned as a candidate for the Supreme Court, seemed to recede from that broad view in <a class=\"css-yywogo\" href=\"https:\/\/reason.com\/volokh\/2024\/11\/11\/an-interview-with-judge-james-c-ho\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">an interview in November<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cBirthright citizenship obviously doesn\u2019t apply in case of war or invasion,\u201d he told <a class=\"css-yywogo\" href=\"https:\/\/www.stcl.edu\/profile\/josh-blackman\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Josh Blackman<\/a>, a conservative law professor (and <a class=\"css-yywogo\" href=\"https:\/\/www.wsj.com\/articles\/birthright-citizenship-is-a-constitutional-mandate-1541025952\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a supporter of birthright citizenship<\/a>). \u201cNo one to my knowledge has ever argued that the children of invading aliens are entitled to birthright citizenship.
