The main question in the new case is whether the First Amendment permits \u2014 or even requires \u2014 states to sponsor and finance religious charter schools, which are public schools with substantial autonomy.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Oklahoma school, St. Isidore of Seville Catholic Virtual School, is to be operated by the Archdiocese of Oklahoma City and the Diocese of Tulsa and aims to incorporate Catholic teachings into every aspect of its activities.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A ruling in favor of the school could affect laws in 45 other states that authorize charter schools. It would also blur a line established in earlier Supreme Court cases distinguishing between government money provided to parents to spend on private schools, including religious ones, and government support provided directly to religious schools.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The dispute is the third major case dealing with religion to be argued before the justices in the space of about a month. In March, the court seemed <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/31\/us\/supreme-court-catholic-charity.html\" title=\"\">poised to rule<\/a> that a Catholic charity in Wisconsin was entitled to a tax exemption that had been denied by a state court on the grounds that the charity\u2019s activities were not primarily religious. Last week, the court signaled that it was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/22\/us\/politics\/supreme-court-lgbtq-books.html\" title=\"\">likely to rule<\/a> that parents with religious objections may withdraw their children from classes in which storybooks with L.G.B.T.Q. themes are discussed.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">After Oklahoma\u2019s charter school board <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/06\/05\/us\/oklahoma-first-religious-charter-school-in-the-us.html\" title=\"\">approved the proposal<\/a> to open St. Isidore, the state\u2019s attorney general, Gentner Drummond, a Republican, sued to stop it. Mr. Drummond said a religious public school would violate the First Amendment\u2019s prohibition of government establishment of religion and the State Constitution\u2019s ban on spending public money to support religious institutions.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He said the school crossed a line drawn by Chief Justice William H. Rehnquist in <a class=\"css-yywogo\" href=\"https:\/\/www.law.cornell.edu\/supct\/html\/00-1751.ZD2.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a 2002 Supreme Court decision<\/a> that distinguished \u201cbetween government programs that provide aid directly to religious schools\u201d as opposed to \u201cprograms of true private choice, in which government aid reaches religious schools only as a result of the genuine and independent choices of private individuals.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for St. Isidore countered in <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-394\/351350\/20250305181244391_24-396%2024-394%20Brief%20for%20Petitioner.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a court filing<\/a> that it \u201chopes to offer another educational <em class=\"css-2fg4z9 e1gzwzxm0\">option<\/em> for Oklahomans, and no student will be compelled to attend St. Isidore.\u201d They added that \u201cthe school will receive students, and state funding, only through the private choices of families.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The school said it would welcome students of \u201cdifferent faiths or no faith.\u201d It was less categorical about teachers, saying that all Oklahoma charter schools are free to adopt their own personnel policies.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The state\u2019s Supreme Court <a class=\"css-yywogo\" href=\"https:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=496522\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ruled against the school<\/a>, with the majority saying it would \u201ccreate a slippery slope\u201d that could lead to \u201cthe destruction of Oklahomans\u2019 freedom to practice religion without fear of governmental intervention.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cSt. Isidore is a public charter school,\u201d the majority said, noting that the state law allowing such schools requires them to be nonsectarian. \u201cUnder both state and federal law,\u201d the majority ruled, \u201cthe state is not authorized to establish or fund St. Isidore.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2022\/06\/21\/us\/politics\/supreme-court-maine-religious-schools.html\" title=\"\">the most recent decision<\/a> from the U.S. Supreme Court about government support for religious schools, <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1088_dbfi.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Carson v. Makin<\/a> in 2022, the majority ruled that Maine could not exclude religious schools from a state tuition program.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Chief Justice John G. Roberts Jr., writing for the majority, said that \u201cMaine may provide a strictly secular education in its public schools.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In dissent, Justice Stephen G. Breyer, who retired that year, said that even Maine\u2019s program, limited to private schools, was problematic.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cMembers of minority religions, with too few adherents to establish schools, may see injustice in the fact that only those belonging to more popular religions can use state money for religious education,\u201d Justice Breyer wrote. \u201cTaxpayers may be upset at having to finance the propagation of religious beliefs that they do not share and with which they disagree.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Justice Amy Coney Barrett recused herself from the Oklahoma case, <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/24-394.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Oklahoma Statewide Charter School Board v. Drummond<\/a>, No. 24-394, but has not said why. She was a law professor at Notre Dame, whose religious liberty clinic <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-394\/351350\/20250305181244391_24-396%2024-394%20Brief%20for%20Petitioner.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">represents the charter school<\/a>, and is close friends with Nicole Garnett, a professor there who has assisted St. Isidore.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\"
