Guns drawn, they set off a flash-bang grenade and charged inside.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The couple who lived there, Hilliard Toi Cliatt and Curtrina Martin, barricaded themselves in a closet. The agents dragged Mr. Cliatt out at gunpoint and handcuffed him. They told Ms. Martin to keep her hands up as she pleaded to see her 7-year-old son, who had been asleep in another room.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">As they questioned Mr. Cliatt, he gave his address. It was different from the one the agents had a warrant to enter.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One of the agents, Lawrence Guerra, had earlier identified the correct house, which he said looked similar and was nearby, on a different street. He said he had been misdirected on the morning of the raid by his GPS device.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The couple sued for false arrest, false imprisonment, assault, battery and other claims but lost in the lower courts on a variety of grounds, notably that government officials\u2019 actions are protected from lawsuits when they perform a duty that involves discretion.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The legal questions in the case heard by the Supreme Court on Tuesday were a tangled series of exceptions and provisos involving the Federal Tort Claims Act, which only sometimes allows suits against the government notwithstanding the doctrine of sovereign immunity.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Much of the argument was technical, and the court seemed headed for a modest ruling that would send the case back to the lower courts for further consideration.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But several justices seemed incredulous when Frederick Liu, a lawyer for the federal government, said the raid did not violate any policy.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cNo policy says don\u2019t break down the wrong door?\u201d Justice Neal M. Gorsuch asked. \u201cDon\u2019t traumatize the occupants? Really?\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Liu clarified his position. \u201cIt\u2019s the United States\u2019 policy to execute the warrants at the right house,\u201d he said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI should hope so,\u201d Justice Gorsuch responded.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Liu nonetheless said that the agents\u2019 discretion in planning the raid was \u201cfilled with policy considerations\u201d including \u201cweighing public safety considerations, efficiency considerations, operational security.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The plaintiffs sought to second-guess those judgments, he said, by saying, for example, that the agents should have checked the house number.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Justice Gorsuch said, \u201cYeah, you might look at the address of the house before you have knocked down the door.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Mr. Liu said that \u201cchecking the house number at the end of the driveway means exposing the agents to potential lines of fire.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Justice Gorsuch continued. \u201cHow about making sure you\u2019re on the right street?\u201d he asked. \u201cChecking a street sign \u2014 is that asking too much?\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Liu said the agents had made a \u201creasonable mistake.\u201d He added that a 1974 amendment to the Federal Tort Claims Act seeking to make it easier to sue over wrong-house raids after notorious ones in Collinsville, Ill., did not apply to the one in Atlanta.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Justice Sonia Sotomayor was unpersuaded. \u201cThat is so ridiculous,\u201d she said. \u201cCongress is looking at the Collinsville raid and providing a remedy to people who have been wrongfully raided, and you\u2019re now saying, \u2018no, they really didn\u2019t want to protect them fully.\u2019\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Patrick M. Jaicomo, a lawyer with the Institute for Justice, which represents the plaintiffs in the case, Martin v. United States, No. 24-362, said \u201cthere\u2019s no question that there was no policy here.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cAs my friend said,\u201d he added, referring to Mr. Liu, \u201cthe government\u2019s policy is to raid the right house. They didn\u2019t do that. The preparation is kind of immaterial to the ultimate result here. If you really, really meant to drop the pizza off at the right address, it doesn\u2019t matter. You still need to give a refund if you drop it off at the wrong address.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><script async
