Mr. Martin has been <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/16\/us\/politics\/martin-caputo-prosecutor-confirmation.html\" title=\"\">criticized for using his office<\/a> to target opponents of the administration.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">His letters accused the publications of being \u201cpartisans in various scientific debates\u201d and asked a series of accusatory questions about bias and the selection of research articles.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Do they accept submissions from scientists with \u201ccompeting viewpoints\u201d? What do they do if the authors whose work they published \u201cmay have misled their readers\u201d? Are they transparent about influence from \u201csupporters, funders, advertisers and others\u201d?<\/p>\n<p class=\"css-at9mc1 evys1bk0\">News of the letter to N.E.J.M. was <a class=\"css-yywogo\" href=\"https:\/\/www.statnews.com\/2025\/04\/23\/new-england-journal-of-medicine-us-attorney-letter-scientific-journals\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">reported<\/a> earlier by STAT, a health news outlet.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Martin also asked about the role of the National Institutes of Health, which funds some of the research the journals publish, and the agency\u2019s role \u201cin the development of submitted articles.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Amanda Shanor, a First Amendment expert at the University of Pennsylvania, said the information published in reputable medical journals like N.E.J.M. is broadly protected by the Constitution.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In most cases, journals have the same robust rights that apply to newspapers \u2014 the strongest the Constitution provides, she added.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThere is no basis to say that anything other than the most stringent First Amendment protections apply to medical journals,\u201d she said. \u201cIt appears aimed at creating a type of fear and chill that will have effects on people\u2019s expression \u2014 that\u2019s a constitutional concern.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">It\u2019s unclear how many journals have received these letters or the criteria that Mr. Martin used to decide which publications to target. The U.S. attorney\u2019s office in Washington did not respond to a request for comment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\"><strong class=\"css-8qgvsz ebyp5n10\">\u201c<\/strong>Our job is to evaluate science and evaluate it in an unbiased fashion,\u201d Dr. Rubin said. \u201cThat\u2019s what we do and I think we do it well. The questions seem to suggest that there\u2019s some bias in what we do \u2014 that\u2019s where the vaguely<strong class=\"css-8qgvsz ebyp5n10\"> <\/strong>threatening part comes in<em class=\"css-2fg4z9 e1gzwzxm0\">.\u201d<\/em><\/p>\n<p class=\"css-at9mc1 evys1bk0\">Jeremy Berg, the former editor in chief of the journal Science, said he thought the letters were designed to \u201cintimidate journals to bend over backward\u201d to publish papers that align with the administration\u2019s beliefs \u2014 on climate change and vaccines, for example \u2014 even if the quality of the research is poor.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Robert F. Kennedy Jr., the nation\u2019s health secretary, singled out N.E.J.M in <a class=\"css-yywogo\" href=\"https:\/\/www.youtube.com\/watch?v=rQedKOpJM-0\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">an interview with the \u201cDr. Hyman Show\u201d podcast last year<\/a> as an example of a medical journal that has participated in \u201clying to the public\u201d and \u201cretracting the real science.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Andrew Nixon, a spokesman for the Health and Human Services Department, declined to comment on whether Mr. Kennedy had any involvement with the letters.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the interview, Mr. Kennedy said he would seek to prosecute medical journals under federal anti-corruption laws.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI\u2019m going to litigate against you under the racketeering laws, under the general tort laws,\u201d he said. \u201cI\u2019m going to find a way to sue you unless you come up with a plan right now to show how you\u2019re going to start publishing real science.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Dr. Jay Bhattacharya, the new director of N.I.H., has <a class=\"css-yywogo\" href=\"https:\/\/x.com\/DrJBhattacharya\/status\/1770549549096169882\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">vigorously criticized the leadership of scientific journals<\/a>. Recently he <a class=\"css-yywogo\" href=\"https:\/\/www.science.org\/content\/article\/new-journal-co-founded-nih-nominee-raises-eyebrows-misinformation-fears\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">co-founded a new journal<\/a> as an alternative to traditional scientific publishing. It has published contrarian views on Covid.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Other prominent journals said they had not received the letter. On Friday, The Lancet, which is based in Britain, published a <a class=\"css-yywogo\" href=\"https:\/\/www.thelancet.com\/journals\/lancet\/article\/PIIS0140-6736(25)00814-1\/fulltext\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">scathing editorial<\/a> in solidarity, calling the letters \u201can obvious ruse to strike fear into journals and impinge on their right to independent editorial oversight.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cScience and medicine in the U.S.A. are being violently dismembered while the world watches,\u201d the editorial said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One of Mr. Martin\u2019s letters was sent to the journal <a class=\"css-yywogo\" href=\"https:\/\/journal.chestnet.org\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Chest<\/a>, a low-profile publication that publishes highly technical studies on topics like lung cancer and pneumonia. The <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/18\/health\/trump-martin-us-attorney-medical-journals.html\" title=\"\">New York Times reported last week<\/a> that at least two other publishers had received nearly identically worded letters.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">They declined to speak publicly for fear of retribution from the Trump administration.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Dr. Rubin said he, too, was worried about political backlash. Scientific journals rely on public funds in several indirect ways \u2014 for example, universities often use federal grants to pay for subscriptions.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cAre we concerned? Of course we are,\u201d he said. \u201cBut we want to do the right thing.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Martin gave the journals until May 2 to respond to his questions. N.E.J.M. has already responded to Mr. Martin with a statement that pushes back against his characterization of the journal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWe use rigorous peer review and editorial processes to ensure the objectivity and reliability of the research we publish,\u201d the statement read. \u201cWe support the editorial independence of medical journals and their First Amendment rights to free expression.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">This is not the N.E.J.M\u2019s first brush with a Trump administration.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In 2020, the journal <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2020\/10\/07\/health\/new-england-journal-trump.html\" title=\"\">published an editorial<\/a> condemning the president\u2019s response to the pandemic \u2014 the first time the journal had supported or condemned a political candidate in its 208-year history.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Dr. Rubin said he doubted Mr. Martin\u2019s letter was related to the editorial. The journal Chest didn\u2019t write about Trump\u2019s first term yet received a letter, he noted.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><script
