{"id":20881,"date":"2025-04-25T11:04:17","date_gmt":"2025-04-25T11:04:17","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/judge-in-idaho-murders-case-rules-death-penalty-is-possible-punishment-for-bryan-kohberger-despite-autism-diagnosis\/"},"modified":"2025-04-25T11:04:17","modified_gmt":"2025-04-25T11:04:17","slug":"judge-in-idaho-murders-case-rules-death-penalty-is-possible-punishment-for-bryan-kohberger-despite-autism-diagnosis","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/judge-in-idaho-murders-case-rules-death-penalty-is-possible-punishment-for-bryan-kohberger-despite-autism-diagnosis\/","title":{"rendered":"Judge in Idaho murders case rules death penalty is possible punishment for Bryan Kohberger despite autism diagnosis"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div id=\"\">\n<p>A judge ruled Thursday that prosecutors can pursue the death penalty against <a href=\"https:\/\/www.cbsnews.com\/news\/bryan-kohberger-idaho-student-killings-bushy-eyebrows\/\" rel=\"nofollow\" data-invalid-url-rewritten-http=\"\">Bryan Kohberger<\/a>\u00a0if he is convicted of murdering four <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/idaho-student-murders-suspect-arrested-pennsylvania\/\" data-invalid-url-rewritten-http=\"\">University of Idaho students<\/a><\/span> in 2022, despite the defendant&#8217;s recent autism diagnosis.<\/p>\n<p>Kohberger, 30, is <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/bryan-kohberger-charged-suspect-idaho-murders\/\" data-invalid-url-rewritten-http=\"\">charged in the stabbing deaths<\/a><\/span> of Ethan Chapin, Xana Kernodle, Madison Mogen and Kaylee Goncalves at a rental home near campus in Moscow, Idaho, on Nov. 13, 2022.<\/p>\n<p>Prosecutors have said they intended to seek the death penalty if Kohberger is convicted at his trial, which is set to\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/bryan-kohberger-university-of-idaho-murders-trial-delayed\/\" data-invalid-url-rewritten-http=\"\">begin August 11<\/a><\/span>,<\/p>\n<p>But his attorneys asked Judge Steven Hippler to remove the death penalty as a possible punishment, citing Kohberger&#8217;s diagnosis of autism spectrum disorder. They have also filed several other motions challenging the death penalty, including one based on purported violations by the state in providing evidence.<\/p>\n<p>&#8220;Mr. Kohberger&#8217;s autism spectrum disorder (ASD) reduces his culpability, negates the retributive and deterrent purposes of capital punishment, and exposes him to the unacceptable risk that he will be wrongfully convicted and sentenced to death,&#8221; defense attorneys wrote in court papers.<\/p>\n<p>They argued that executing someone with autism would constitute cruel and unusual punishment under the Eighth Amendment to the U.S. Constitution.<\/p>\n<p><span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/bryan-kohberger-hearing-idaho-murders-trial-rules\/\" data-invalid-url-rewritten-http=\"\">Prosecutors argued<\/a><\/span> that under U.S. Supreme Court precedent, the only mental disability that precludes imposition of the death penalty is an intellectual disability &#8211; and Kohberger&#8217;s diagnosis was of mild autism &#8220;without accompanying intellectual &#8230; impairment.&#8221;<\/p>\n<p>The judge agreed.<\/p>\n<p>&#8220;Not only has Defendant failed to show that ASD is equivalent to an intellectual disability for death penalty exemption purposes, he has not shown there is national consensus against subjecting individuals with ASD to capital punishment,&#8221; Hippler wrote. &#8220;ASD may be mitigating factor to be weighed against the aggravating factors in determining if defendant should receive the death penalty, but it is not (a) death-penalty disqualifier.&#8221;<\/p>\n<p>Kohberger was a criminal justice graduate student at Washington State University, in Pullman, about 10 miles from Moscow, at the time of the killings. He was <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/idaho-murders-bryan-kohberger-arrest-suspect-weeks-fear-frustration\/\" data-invalid-url-rewritten-http=\"\">arrested in Pennsylvania<\/a><\/span> weeks later. Investigators said they matched his DNA to genetic material recovered from a knife sheath found at the crime scene.<\/p>\n<p>Autopsies showed the four victims were all likely asleep when they were attacked, some had defensive wounds and each was stabbed multiple times.<\/p>\n<p>Following Kohberger&#8217;s arrest, his attorneys had him examined by a clinical neuropsychologist, Dr. Rachel Orr, who diagnosed him with with &#8220;Autism Spectrum Disorder, level 1, without accompanying intellectual or language impairment.&#8221;<\/p>\n<p>In a separate ruling Thursday, the judge agreed that jurors will likely be able to hear much of the <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/audio-of-911-call-released-in-idaho-college-student-murders-case\/\" data-invalid-url-rewritten-http=\"\">911 call<\/a><\/span> made from outside the house by two surviving roommates roughly eight hours after the killings, as they realized one of their roommates wasn&#8217;t waking up.<\/p>\n<p>However, statements made during that call by an unidentified woman who relayed information she had not observed first-hand will be barred from the trial, Hippler said.<\/p>\n<p>Jurors will also be able to see <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/911-call-texts-roommates-university-of-idaho-student-murders\/\" data-invalid-url-rewritten-http=\"\">text messages<\/a><\/span> the two surviving roommates sent around the time of the attack, after 4 a.m., when one reported seeing a masked man in the house, the judge said, assuming prosecutors can lay a foundation for the admission of the evidence.<\/p>\n<p>Last November, Kristi and Steve Goncalves, the parents of Kaylee Goncalves, said the details of the case show the\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/idaho-murders-death-penalty-hearing-bryan-kohberger\/\" data-invalid-url-rewritten-http=\"\">death penalty<\/a><\/span>\u00a0 is merited.<\/p>\n<p>&#8220;You&#8217;ve got four victims, all in one house \u2014 that&#8217;s more than enough,&#8221; Steve Goncalves said.<\/p>\n<p>Kristi Goncalves said she talked to the coroner and knows what happened to her daughter.<\/p>\n<p>&#8220;If he did anything like he did to our daughter to the others, then he deserves to die,&#8221; she said.<\/p>\n<p>Steve Goncalves\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/idaho-murders-victim-kaylee-goncalves-mother-says-evidence-shows-she-was-trapped\/\" data-invalid-url-rewritten-http=\"\">told &#8220;48 Hours&#8221;<\/a><\/span>\u00a0 last year that &#8220;there&#8217;s evidence to show that she awakened and tried to get out of that
