{"id":20837,"date":"2025-04-25T05:46:30","date_gmt":"2025-04-25T05:46:30","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/ice-deportation-notices-a-form-in-english-and-only-hours-to-act\/"},"modified":"2025-04-25T05:46:30","modified_gmt":"2025-04-25T05:46:30","slug":"ice-deportation-notices-a-form-in-english-and-only-hours-to-act","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/ice-deportation-notices-a-form-in-english-and-only-hours-to-act\/","title":{"rendered":"ICE Deportation Notices: A Form in English and Only Hours to Act"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">On April 7, the Supreme Court <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/07\/us\/politics\/supreme-court-trump-venezuelan-deportations.html\" title=\"\">ruled<\/a> that the government must give Venezuelan migrants notice \u201cwithin a reasonable time\u201d and the chance to legally challenge their removal before being deported to a maximum-security prison in El Salvador.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Exactly how much notice the Trump administration considered appropriate in response to the Supreme Court\u2019s edict was revealed in a document unsealed during a hearing on Thursday in Federal District Court in Brownsville, Texas.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Before Saturday, when the Supreme Court issued a second order, which <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/19\/us\/politics\/supreme-court-deportation-protocol-venezuela.html\" title=\"\">blocked the deportation<\/a> of a group of Venezuelan migrants under the Alien Enemies Act of 1798, detainees slated for deportation were given a <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.2000771\/gov.uscourts.txsd.2000771.49.1_2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">one-page form<\/a> that stated \u201cif you desire to make a phone call, you will be permitted to do so,\u201d according to the unsealed document, a <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.2000771\/gov.uscourts.txsd.2000771.49.0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">four-page declaration<\/a> by an official from Immigration and Customs Enforcement.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">They then had \u201cno less than 12 hours\u201d to \u201cexpress an intent\u201d to challenge their detention, and another 24 hours to file a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/live\/2025\/04\/20\/us\/trump-news\/due-process-habeas-corpus-trump\" title=\"\">habeas corpus petition<\/a> asking for a hearing before a judge, the declaration said. The form itself is written in English, but \u201cit is read and explained to each alien in a language that alien understands.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The hearing was part of a case whose plaintiffs are three Venezuelan men being held at El Valle Detention Facility, roughly 50 miles from Brownsville.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for detainees held elsewhere, who have sued in the Northern District of Texas, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/19\/us\/politics\/trump-deportation-courts-venezuelan-migrants-texas.html\" title=\"\">have disputed<\/a> the government\u2019s claims about being given notice. They also have said that the form was not explained to detainees and that they were simply told to sign the document, which the ICE declaration identified as Form AEA-21B.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The details about notice came during a two-hour hearing before Judge Fernando Rodriguez Jr., who unsealed the ICE declaration after rejecting the government\u2019s stance that it should remain sealed because it contained sensitive law-enforcement details.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Rodriguez also some expressed skepticism about President Trump\u2019s assertion in <a class=\"css-yywogo\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/invocation-of-the-alien-enemies-act-regarding-the-invasion-of-the-united-states-by-tren-de-aragua\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">an executive order<\/a> that the men could be deported under the <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/article\/alien-enemies-act-trump.html\" title=\"\">Alien Enemies Act<\/a>, a wartime law, because of claims by the government that they are members of a gang. The government tried to defend <a class=\"css-yywogo\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/invocation-of-the-alien-enemies-act-regarding-the-invasion-of-the-united-states-by-tren-de-aragua\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Mr. Trump\u2019s wording<\/a> that activity by Tren de Aragua amounted to \u201can invasion\u201d and \u201cpredatory incursion,\u201d but it was unable to provide what the judge requested: documentation from the time the act was passed that supported that argument.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cYou\u2019re giving me your view of what the words mean,\u201d he said. \u201cWhat I\u2019m looking for is what the words meant at the time.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Immediately after the hearing, Lee Gelernt of the A.C.L.U., one of the lawyers for the three plaintiffs, said the notice given to his clients was insufficient.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cTwelve hours is obviously too short to find out who to contact, and 24 hours to file a habeas corpus petition is obviously inconsistent with any notion of due process, or the Supreme Court\u2019s ruling,\u201d he said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Rodriguez is one of at least five district court judges who have issued temporary restraining orders barring the administration from deporting individuals from their districts under the Alien Enemies Act. He and another of those five judges were appointed by Mr. Trump.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">At the end of the hearing on Thursday, Judge Rodriguez extended his restraining order by one
