It calls for the Trump administration to work with Congress to change a 2022 law in a way that could defang a negotiation program meant to reduce Medicare\u2019s spending on commonly used or costly drugs.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Such a change has the potential to increase costs for the government, because it would most likely delay the existing timetable for some drugs to become eligible for Medicare price cuts.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Depending on how it is structured, it could increase Medicare\u2019s drug spending by billions of dollars compared with outlays under the current law. The negotiation program was approved by a Democratic-controlled Congress and supported by former President Joseph R. Biden Jr.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The executive order says that changes to the Medicare price negotiation program should be \u201ccoupled with other reforms to prevent any increase in overall costs to Medicare and its beneficiaries.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Drug pricing experts said that with the exception of the Medicare negotiation proposal, other directives in the executive order had the potential to save money for patients and government programs. None of the actions represented major changes that would lead to huge savings.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One provision would lower the co-payments that some people on Medicare face when they undergo treatments like chemotherapy infusions at certain clinics and at outpatient hospital sites. Another would give certain lower-income people access to heavily discounted insulin and epinephrine injections.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Tuesday\u2019s executive order was the most prominent move Mr. Trump\u2019s second administration has made so far on drug pricing.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">It followed Mr. Trump\u2019s decision to <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/15\/health\/trump-tariffs-drug-imports-china-india-ireland.html\" title=\"\">move closer<\/a> to imposing tariffs on imported pharmaceuticals, which manufacturers are likely to try to pass on. That could force government programs, employers and patients to pay more for some medications and could exacerbate shortages of critical drugs.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Some of the directives, like changing the Medicare negotiation program, would require congressional approval. The pharmaceutical industry has fiercely opposed some of the ideas in the executive order while supporting others.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump has long <a class=\"css-yywogo\" href=\"https:\/\/www.donaldjtrump.com\/news\/b4deb8bb-15eb-4645-a1bb-e4cc2334b27f\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">complained<\/a> that the United States pays much more than other wealthy countries for the same drugs. Notably absent from the order was a reprise of a most favored nation pricing policy, which he <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2020\/11\/20\/upshot\/trump-drug-prices.html\" title=\"\">proposed in his first term<\/a> aimed at making U.S. drug prices closer to those that peer countries pay. Like several of Mr. Trump\u2019s first-term policies on drug prices, his most favored nation plan was halted by federal courts. Last fall, Mr. Trump\u2018s presidential campaign <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/08\/health\/drug-prices-kamala-harris-donald-trump.html\" title=\"\">walked back the proposal<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Here\u2019s a breakdown of some of the most notable parts of Mr. Trump\u2019s executive order.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-4a532127\">Eliminating the \u2018pill penalty\u2019<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The order directs Robert F. Kennedy Jr., the health secretary, to work with Congress to address a difference in how certain types of drugs are treated in the Medicare negotiation program.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Under the law, pills and other drugs produced through synthetic processes do not become eligible for price cuts until they have been on the market for nine years. Drugs known as biologics \u2014 created from living cells and often given as an infusion \u2014 would not be eligible for 13 years.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Drugmakers, who unsuccessfully sued the federal government over the program, bitterly call the difference a \u201cpill penalty.\u201d They say it discourages them from developing medications, because they have less time to build up sales before the price cuts kick in, depriving patients of new treatments. They have lobbied for pills to be exempted from the price cuts for 13 years instead of nine.<\/p>\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/guthrie.house.gov\/news\/documentsingle.aspx?DocumentID=388189#:~:text=The%20EPIC%20Act%20would%20help,molecule%20timeline%20of%2011%20years.\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Lawmakers<\/a> <a class=\"css-yywogo\" href=\"https:\/\/murphy.house.gov\/media\/press-releases\/murphy-introduces-legislation-eliminate-ira-pill-penalty-and-improve-small\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">have introduced<\/a> legislation that would change the law to treat the two types of drugs equally.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The president\u2019s order does not specify how many years each type of drug should be exempt from Medicare price cuts. <\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a statement on Tuesday, Alex Schriver, an official at the drug industry\u2019s main lobbying group, PhRMA, said that his organization would work with the Trump administration and Congress to \u201cadvance common sense solutions that lower costs and improve access for Americans.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Biden officials oversaw the first round of negotiations in the program, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/08\/15\/us\/politics\/drug-prices-medicare.html\" title=\"\">resulting in price cuts<\/a> that will go into effect in 2026. The Trump administration is overseeing negotiations this year for lower prices in 2027 for drugs including the blockbuster weight-loss medication sold as <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/17\/health\/medicare-prices-ozempic-wegovy.html\" title=\"\">Ozempic and Wegovy<\/a>.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The White House <a class=\"css-yywogo\" href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/04\/fact-sheet-president-donald-j-trump-announces-actions-to-lower-prescription-drug-prices\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">said in a fact sheet on Tuesday<\/a> that it wanted to capture more savings for the government with the Medicare negotiation program than the Biden administration did last year. That would be difficult to do if Congress reduces the time during which Medicare can obtain lower prices.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-6fd30d29\">Importing drugs from Canada<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The executive order directs the Food and Drug Administration to improve <a class=\"css-yywogo\" href=\"https:\/\/www.fda.gov\/about-fda\/reports\/importation-program-under-section-804-fdc-act#:~:text=FDA%20has%20developed%20a%20pathway,to%20public%20health%20and%20safety.\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the process<\/a> by which states can apply to import lower-cost drugs from Canada.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In his first term, Mr. Trump <a class=\"css-yywogo\" href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/importation-final-rule.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">created a pathway<\/a> enabling states to pursue these imports. Under the Biden administration, the F.D.A. approved one importation program, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/01\/05\/health\/drug-imports-canada-florida.html\" title=\"\">in Florida<\/a>. As of late last year, Florida had <a class=\"css-yywogo\" href=\"https:\/\/kffhealthnews.org\/news\/article\/florida-gov-desantis-canadian-drug-import-plan-goes-nowhere-after-fda-approval\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">not yet begun<\/a> importing drugs from Canada. The pharmaceutical industry opposes the idea because it would cut into its profits.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">If Mr. Trump follows through on imposing tariffs on pharmaceuticals, importing drugs from Canada would be unlikely to offer the same savings as in the past.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-263e1cb1\">Different co-pays at different clinics<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The order calls for rules to equalize the fees doctors are paid to administer drugs to patients across settings.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Currently, many medical practices owned by hospitals can <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2015\/02\/07\/upshot\/medicare-proposal-would-even-out-doctors-pay.html\" title=\"\">charge higher fees<\/a> to Medicare than independent practices can, even for the exact same services. Because Medicare beneficiaries are often responsible for a percentage of their medical bills, those higher costs for the visits are passed along in the form of co-payments.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Efforts to equalize such payments broadly have been under bipartisan discussion for years in Congress but have faced opposition from hospitals, who say they require the higher payments. Legislation <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2015\/10\/29\/upshot\/doctors-who-work-for-hospitals-charge-more-thats-set-to-change.html\" title=\"\">passed during the Obama administration<\/a> addressed some of these payment differences.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-5d04489\">Encouraging cheaper copycats<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump directed the F.D.A. to make recommendations for streamlining approvals for generic drugs and biosimilars, which are lower-priced copycats of biologic drugs.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The first biosimilar was approved in 2015, with dozens more approved since. There was widespread hope that biosimilars would displace patent-protected brand-name biologics, such as <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/01\/28\/business\/humira-abbvie-monopoly.html\" title=\"\">Humira<\/a> for conditions like arthritis, that sent drug costs soaring. But patients have been slow to switch over, and savings have not materialized as quickly as many wanted.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-293880d5\">Insulin for the poor<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump revived an <a class=\"css-yywogo\" href=\"https:\/\/trumpwhitehouse.archives.gov\/briefings-statements\/president-donald-j-trump-taking-action-lower-drug-costs-ensure-americans-access-life-saving-medications\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">executive order<\/a> from his first term directing community health clinics to provide insulin and epinephrine injections at heavily discounted prices to certain lower-income people, including the uninsured.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The clinics balked when Mr. Trump first proposed the idea in 2020.
