The lawsuit was initially filed against Meta \u2014 then called Facebook \u2014 in 2020, during Mr. Trump&#8217;s first term, before being amended in 2021. In its\u00a0<a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/cases\/ecf_75-1_ftc_v_facebook_public_redacted_fac.pdf\" target=\"_blank\" rel=\"nofollow noopener\">complaint<\/a>, the FTC accuses Meta of &#8220;anticompetitive conduct,&#8221; alleging that the company&#8217;s ownership of Instagram and WhatsApp has extended the company&#8217;s grip on the social media market too far.\u00a0<\/p>\n<p>&#8220;There&#8217;s nothing wrong with Meta innovating,&#8221; said Daniel Matheson, lead attorney for the FTC in his opening statements for the agency Monday, &#8220;It&#8217;s what happened next that is a problem.&#8221;\u00a0<\/p>\n<p>Purchased in\u00a0<a href=\"https:\/\/about.fb.com\/news\/2012\/04\/facebook-to-acquire-instagram\/\" target=\"_blank\" rel=\"nofollow noopener\">2012<\/a>\u00a0and\u00a0<a href=\"https:\/\/about.fb.com\/news\/2014\/02\/facebook-to-acquire-whatsapp\/\" target=\"_blank\" rel=\"nofollow noopener\">2014<\/a>, respectively, Instagram and WhatsApp have grown into social media powerhouses.<\/p>\n<p>In order to restore competition, the company, which is owned by Mark Zuckerberg, must part ways with Instagram and WhatsApp to restore competition, the government agency says in\u00a0<a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/cases\/ecf_75-1_ftc_v_facebook_public_redacted_fac.pdf\" target=\"_blank\" rel=\"nofollow noopener\">court filings<\/a>, arguing that Meta&#8217;s ownership of the two has extended the company&#8217;s grip on the social media market too far. The FTC also asks that Meta provide prior notice for any future mergers and acquisitions. The outcome of the case <strong>could <\/strong>determine whether Zuckerberg&#8217;s Meta empire will be forced to break apart.\u00a0<\/p>\n<p>With the landmark trial underway, here&#8217;s what you need to know.<\/p>\n<h2><strong>How long will the trial last and who will testify?<\/strong><\/h2>\n<p>The trial, which begins Monday in federal court in Washington, D.C., is expected to last several weeks.\u00a0<\/p>\n<p>U.S. District Judge James Boasberg will preside over the case which could see a range of witnesses including Meta CEO and founder Zuckerberg; former Meta Chief Operating Officer Sheryl Sandberg; former Meta Chief Technology Officer Mike Schroepfer, Instagram co-founder Kevin Systrom, and executives from rival social media platforms.<\/p>\n<h2><strong>What is happening in court today?<\/strong><\/h2>\n<p>The FTC and Meta made their opening arguments this morning, with witness testimony expected to start this afternoon.<\/p>\n<p>In his opening statements, lead FTC attorney Matheson said that Meta was struggling to compete with the fast-growing WhatsApp and Instagram platforms and in buying them, the tech giant was &#8220;eliminating immediate threats,&#8221; to their market.<\/p>\n<p>Meta, for its part, said the company &#8220;did nothing wrong,&#8221; by acquiring Instagram and WhatsApp. Mark Hansen, the attorney for Meta Inc., said in opening statements, that the two apps have grown substantially under the tech giant&#8217;s ownership and that there is no evidence to prove that Meta is a monopoly.\u00a0<\/p>\n<p>Monopoly power, said Hansen, would mean cornering the market on prices above the competitive level. But in Meta&#8217;s case, its services are free. &#8220;How can the FTC maintain this monopolization case when it has never charged users a cent,&#8221; Hansen said.<\/p>\n<h2><strong>What&#8217;s at stake?<\/strong><\/h2>\n<p>The showdown is the largest legal challenge brought against Meta in the company&#8217;s roughly 20-year history. If the FTC is successful, Meta could be forced to divest Instagram and WhatsApp \u2014 which could mean substantial drops in revenue. Instagram, which Meta has owned for over a decade, makes up half of the company&#8217;s overall advertising revenue.<\/p>\n<p>&#8220;Instagram has also been picking up the slack for Facebook on the user front, particularly among young people, for a long time,&#8221; Emarketer analyst Jasmine Enberg <a href=\"https:\/\/apnews.com\/article\/meta-ftc-antitrust-instagram-whatsapp-facebook-f602a09e86c9eb4538949572f72e8380\" target=\"_blank\" rel=\"nofollow noopener\">told<\/a> the AP.\u00a0<\/p>\n<p>&#8220;The trial also comes as Meta is trying to bring back OG Facebook in an effort to appeal to Gen Z and younger users as they join social media. Social media usage is far more fragmented today than it was in 2012 when Facebook acquired Instagram, and Facebook isn&#8217;t where the cool college kids hang out anymore. Meta needs Instagram to continue growing, especially as more advertisers think Instagram-first with their Meta budgets,&#8221; she added.<\/p>\n<p>Meta, headquartered in Menlo Park, California, <a href=\"https:\/\/www.statista.com\/statistics\/277229\/facebooks-annual-revenue-and-net-income\/\" target=\"_blank\" rel=\"nofollow noopener\">earned<\/a> over $164 billion in revenue in 2024. Facebook and Instagram are the two <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/cases\/ecf_75-1_ftc_v_facebook_public_redacted_fac.pdf\" target=\"_blank\" rel=\"nofollow noopener\">most profitable<\/a> social media platforms in the world.<\/p>\n<p>In a statement issued Sunday, April 13, Meta <a href=\"https:\/\/about.fb.com\/news\/2025\/04\/ftcs-weak-case-against-meta-ignores-reality\/\" target=\"_blank\" rel=\"nofollow noopener\">said<\/a> the &#8220;stakes could not be higher in this trial for U.S. consumers and businesses.&#8221;<\/p>\n<h2><strong>What is Meta saying?<\/strong><\/h2>\n<p>The social media company has <a href=\"https:\/\/about.fb.com\/news\/2025\/04\/ftcs-weak-case-against-meta-ignores-reality\/\" target=\"_blank\" rel=\"nofollow noopener\">called<\/a> the FTC&#8217;s case &#8220;weak&#8221; and said it &#8220;ignores reality,&#8221; adding that it faces stiff competition from TikTok and YouTube. Both platforms outrank Facebook and Instagram in terms of how long users spend on each.<\/p>\n<p>&#8220;Ultimately, an ill-conceived lawsuit like this will make companies think twice before investing in innovation, knowing they may be punished if that innovation leads to success,&#8221; Meta&#8217;s <a href=\"https:\/\/about.fb.com\/news\/2025\/04\/ftcs-weak-case-against-meta-ignores-reality\/\" target=\"_blank\" rel=\"nofollow noopener\">statement <\/a>reads. &#8220;On top of it, this weak case is costing taxpayers millions of dollars.&#8221;<\/p>\n<p>&#8220;The FTC&#8217;s lawsuit against Meta defies reality,&#8221; a Meta spokesperson told CBS MoneyWatch. &#8220;The evidence at trial will show what every 17-year-old in the world knows: Instagram, Facebook and WhatsApp compete with Chinese-owned TikTok, YouTube, X, iMessage and many others. More than 10 years after the FTC reviewed and cleared our acquisitions, the Commission&#8217;s action in this case sends the message that no deal is ever truly final. Regulators should be supporting American innovation, rather than seeking to break up a great American company and further advantaging China on critical issues like AI.&#8221;\u00a0<\/p>\n<p>The FTC did not immediately reply to a request for comment.<\/p>\n<h2><strong>How did this start?<\/strong><\/h2>\n<p>The history of the Meta case stretches back several years. The FTC initially filed the suit in 2020, during President Trump&#8217;s first term in office.\u00a0<\/p>\n<p>In June 2021, U.S. District Judge James Boasberg <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/facebook-antitrust-ftc-lawsuits\/\" data-invalid-url-rewritten-http=\"\">dismissed<\/a><\/span> the antitrust lawsuit brought by the FTC claiming the lawsuits were &#8220;legally insufficient&#8221; and did not supply sufficient evidence to prove Facebook was a monopoly.
