The 26-year-old faces federal murder and stalking charges and 11 state charges, including murder and terrorism charges, which are not eligible for the death penalty.\u00a0<\/p>\n<p>&#8220;After careful consideration, I have directed federal prosecutors to seek the death penalty in this case as we carry out President Trump&#8217;s agenda to stop violent crime and Make America Safe Again,&#8221; Bondi said in a statement Tuesday.<\/p>\n<figure class=\"embed embed--type-image is-image embed--float-none embed--size-medium\">\n<p>      <span class=\"img embed__content\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/assets3.cbsnewsstatic.com\/hub\/i\/r\/2025\/04\/01\/6f183e3c-0345-4af7-a9b8-759a559ebe24\/thumbnail\/1240x827\/12b1aee5bf90ce596099eed1967c2b81\/gettyimages-2200303122.jpg?v=653dd6912cdd8596c9bfea812c355f95#\" alt=\"Luigi Mangione Attends Hearing In State Court In New York City \" height=\"827\" width=\"1240\" loading=\"lazy\"\/><\/span><figcaption class=\"embed__caption-container\">\n<p>                  <span class=\"embed__caption\">Luigi Mangione appears at a hearing for the murder of UnitedHealthcare CEO Brian Thompson at Manhattan Criminal Court on Feb. 21, 2025 in New York City.\u00a0<\/span><\/p>\n<p>                  <span class=\"embed__credit\"><\/p>\n<p>                Getty Images<\/p>\n<p>                          <\/span><br \/>\n              <\/figcaption><\/figure>\n<p>Mr. Trump signed an executive order on his <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-energy-emergency-executive-orders-inflation\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">first day in office<\/a><\/span> directing the Department of Justice to seek the death penalty where applicable.\u00a0<\/p>\n<p>Attorneys for Luigi Mangione asked a judge to stop federal prosecutors from seeking the death penalty against their client, saying the U.S. government &#8220;intends to kill Mr. Mangione as a political stunt.&#8221;<\/p>\n<p>The motion filed 11 days after the death penalty announcement in the U.S. District Court of the Southern District said U.S. Attorney General Pam Bondi\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/newyork\/news\/luigi-mangione-doj-seeks-death-penalty\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">ordered<\/a><\/span>\u00a0the death penalty to &#8220;carry out President Trump&#8217;s agenda to stop violent crime and Make America Safe Again.&#8221;<\/p>\n<p>&#8220;This move is one in a series of moves for the Trump administration to &#8216;restore&#8217; the federal death penalty,&#8221; said Corinna Barrett Lain, death penalty expert and a law professor at the University of Richmond School of Law.<\/p>\n<p>The Mangione case is the first high-profile one to come under his administration&#8217;s directive, Lain said; however, the federal death row landscape has changed dramatically since Mr. Trump&#8217;s first term \u2014 and the appetite for executions nationwide has plummeted. In 2024, there were 26 new death sentences; in 2004, there were 125, she said.\u00a0<\/p>\n<p>New York State, where Mangione is charged, abolished the death penalty in 2007, according to the Death Penalty Information Center, a not-for-profit organization based in D.C. According to their tracking, although there were prisoners on New York&#8217;s death row in 2007,\u00a0<a href=\"https:\/\/deathpenaltyinfo.org\/state-and-federal-info\/state-by-state\/new-york\" target=\"_blank\" rel=\"nofollow noopener\">an execution<\/a> hasn&#8217;t taken place there since Eddie Mays in 1963.<\/p>\n<p>Federal prosecutors might find themselves in the same situation with Mangione, Lain said, who has written a book on lethal injection, as it can take a federal death penalty case at least two decades to wind its way through the legal system.<\/p>\n<h2>What is the federal death penalty?<\/h2>\n<p>The federal death penalty is in all 50 states and U.S. ter\u00adri\u00adto\u00adries but is used rel\u00ada\u00adtive\u00adly rarely compared to the use of capital punishment by states. How it is applied is decided by a policy the U.S. Department of Justice has written in its justice manual, Robin Maher, executive director of the Death Information Policy Center, told CBS News.\u00a0<\/p>\n<p>The manual details how \u2014 or why \u2014 federal prosecutors decide to seek a federal death sentence, said Maher.\u00a0<\/p>\n<p>&#8220;It&#8217;s not clear that that process has been followed with respect to this decision to seek death for Mr. Mangione,&#8221; Maher said.\u00a0<\/p>\n<p>The U.S. Department of Justice <a href=\"https:\/\/www.justice.gov\/usao\/justice-101\/sentencing#:~:text=The%20death%20penalty%20can%20only,or%20a%20Supreme%20Court%20justice.\" target=\"_blank\" rel=\"nofollow noopener\">said the death penalty<\/a> can only be imposed on defendants convicted of capital offenses, such as murder, treason, genocide, or the killing or kidnapping of a congressman, the president, or a Supreme Court justice. Mr. Trump expanded the scope in his <a href=\"https:\/\/www.justice.gov\/ag\/media\/1388561\/dl#:~:text=President%20Trump's%20Executive%20Order%20established,Memorandum%20entitled%20%22Moratorium%20on%20Federal\" target=\"_blank\" rel=\"nofollow noopener\">January executive order<\/a>, saying federal prosecutors will seek the death penalty &#8220;for the most serious, readily provable offenses.&#8221;<\/p>\n<p>Each case is autho\u00adrized by the Department of Justice headquarters in Washington, D.C., in con\u00adsul\u00adta\u00adtion with local U.S. Attorney offices, who prosecute the cases.\u00a0<\/p>\n<h2>What is a federal execution?<\/h2>\n<p>A num\u00adber of fed\u00ader\u00adal death sen\u00adtences were pros\u00ade\u00adcut\u00aded in states that have abol\u00adished the death penal\u00adty, the Death Information Policy Center said. Inmates who have received a federal death sentence are executed at the fed\u00ader\u00adal death cham\u00adber in the U.S. Penitentiary Terre Haute in Indiana.<\/p>\n<p>Most federal executions are carried out by lethal injection \u2014 until 2020, it was the sole method of execution. Methods were then expanded to include ones autho\u00adrized by the state in which the fed\u00ader\u00adal death sen\u00adtence was imposed. In some cases this could be by firing squad, such as the <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/south-carolina-firing-squad-execution-brad-sigmon\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">recent execution in South Carolina<\/a><\/span>, or by\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/alabama-nitrogen-gas-execution-alan-eugene-miller-secrecy-corrections-department\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">nitrogen gas<\/a><\/span>, which was used in Alabama and Louisiana.\u00a0<\/p>\n<p>Between the rein\u00adstate\u00adment of the fed\u00ader\u00adal death penal\u00adty in 1988 and 2024, 80 federal defen\u00addants <a href=\"https:\/\/deathpenaltyinfo.org\/state-and-federal-info\/federal-death-penalty\/background-on-the-federal-death-penalty\" target=\"_blank\" rel=\"nofollow noopener\">were sen\u00adtenced<\/a> to death and 16 were exe\u00adcut\u00aded.<\/p>\n<p>Under the first Trump administration, 13 people were executed over 6 months in 2020-2021, DPI confirmed to CBS News.\u00a0<\/p>\n<h2>Who is on federal death row?<\/h2>\n<p>Fed\u00ader\u00adal death row pris\u00adon\u00aders from all over the coun\u00adtry are housed in the Special Confinement Unit at U.S. Penitentiary Terre Haute in Indiana.<\/p>\n<p>Many death row inmates die from old age, Lain said, and many are never executed. Cases can take at least a decade to wind through court and millions of dollars to judge, &#8220;is this a life worth saving?&#8221; said Lain, who said each death row case has two trials, one for the crime and the other for sentencing. In effect, criminals are being sentenced to &#8220;life without parole with a random chance of execution,&#8221; and the government is paying millions for the prosecution, she said.\u00a0<\/p>\n<p>There are three prisoners currently on federal death row:\u00a0<a href=\"https:\/\/www.cbsnews.com\/pittsburgh\/tag\/robert-bowers\/\" target=\"_blank\" rel=\"nofollow\" data-invalid-url-rewritten-http=\"\">Roberts Bowers<\/a>, who was convicted in 2023 for the mass shoot\u00ading at Tree of Life Synagogue;\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/dylann-roof-appeal-conviction-death-sentence-in-charleston-massacre-today-2020-01-28\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Dylann Roof<\/a><\/span>, who was convicted in 2017 for the fatal shoot\u00ading of nine parish\u00adioners in a Black church in Charleston, South Carolina; and <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/boston\/news\/biden-death-penalty-clemency-boston-marathon-bomber\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Dzhokhar Tsarnaev<\/a><\/span>\u00a0for the 2015 Boston Marathon bomb\u00ading.<\/p>\n<p>Then-U.S. Attorney General Merrick Garland put a moratorium on federal executions in place shortly after taking office so that an internal DOJ review of execution policies and practices could take place, Maher said.
