He either is or is not a billionaire, and may or may not have a sizable stake in his family\u2019s luxury brand, depending on when and where these matters come up.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A new lawsuit <a class=\"css-yywogo\" href=\"https:\/\/www.courtlistener.com\/docket\/69826023\/honor-america-capital-llc-v-puech\/?utm_source=www.courtwatch.news&amp;utm_medium=newsletter&amp;utm_campaign=120-real-housewives-face-real-talk&amp;_bhlid=3c6df5b346d0f5e2431c721dc7a418763f6d17cf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">filed in federal court late last month<\/a> says that Mr. Puech recently claimed he does hold that stake, about 5 percent of the company, and had signed a deal to sell more than six million shares in Herm\u00e8s to the royal family of Qatar. But Mr. Puech has also previously told courts in Switzerland, where he lives, that his shares had disappeared in the hands of a wealth manager.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The complaint in federal court in the District of Columbia, initially public but now under seal, accused Mr. Puech of failing to honor the sale, adding fresh intrigue to the enduring enigma of his wealth and offering a glimpse into the luxury ambitions of Qatar\u2019s monarchy. The original suit was rejected on a technicality by the court, and the plaintiff has refiled with a motion to keep it under seal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Puech, 82, is a great-grandson of Thierry Herm\u00e8s, a 19th-century saddle maker who turned his business into a fashion powerhouse <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/26\/style\/hermes-mens-wear-paris.html\" title=\"\">revered even by other fashion brands<\/a>. Herm\u00e8s \u2014 known, among other things, for the exclusive Birkin bags it sells only to insiders \u2014 was valued at <a class=\"css-yywogo\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2025-02-14\/hermes-crosses-300-billion-market-value-edging-closer-to-lvmh?embedded-checkout=true&amp;sref=zVYYYI5e\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">$300 billion in mid-February<\/a>, just days after Mr. Puech signed a deal to sell his shares, then worth over $15 billion, according to filings in the suit.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">It is not the first time Mr. Puech and his slice of the family fortune have been the subjects of great debate and litigation.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In 2023, he made waves after moving to adopt his middle-aged, married Moroccan gardener to bequeath him half his fortune, <a class=\"css-yywogo\" href=\"https:\/\/www.tdg.ch\/choc-chez-les-ultrariches-lheritier-dhermes-veut-leguer-ses-milliards-a-son-domestique-399075169273\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">prompting resistance from a charity<\/a> he had formed, which expected the inheritance.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The new lawsuit, filed by Honor America Capital, accuses Mr. Puech of breach of the contract to sell his shares, and asks the court to order him to make good on his pledge and to pay $1.3 billion in damages for \u201clost profits, opportunity costs, and reputational harm.\u201d The <a class=\"css-yywogo\" href=\"https:\/\/www.bizapedia.com\/dc\/honor-america-capital-llc.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">company was formed by the deputy emir of Qatar<\/a> in Washington in February, and court documents show it is backed by the emir himself.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A contract and letters filed with the complaint show the deal was discussed for months and signed on Feb. 10. A representative for Honor America Capital wrote to Mr. Puech\u2019s lawyer in Switzerland to \u201cconfirm that we have secured a full funding commitment from His Highness Sheikh Tamim bin Hamad Al Thani, Emir of the State of Qatar\u201d to close the deal.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">But Mr. Puech twice delayed the share transfer, based on letters sent by his representative and filed with the court. On March 19, his lawyer wrote to the monarchy\u2019s company to say that despite \u201cbest and repeated efforts,\u201d his client was \u201cunable\u201d to get his shares and had concluded it would be \u201cfutile\u201d to set another closing date.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for the parties did not respond to requests for comment. But Mr. Puech\u2019s past could not have been lost on the Qataris, who have an expansive portfolio of high-end retail and luxury brand holdings \u2014 including the Harrods and Printemps department stores \u2014 through their sovereign wealth fund and <a class=\"css-yywogo\" href=\"https:\/\/www.businessoffashion.com\/articles\/luxury\/mayhoola-inside-the-secretive-qatari-luxury-empire\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">investment vehicles backed by the royal family<\/a>. Still, the chances of getting a chunk of Herm\u00e8s, apparently outweighed any concerns about doing business with Mr. Puech, some experts suggest.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The share price of Herm\u00e8s has spiked more than 200 percent in five years, and the brand is increasingly hot, even as other luxury purveyors have faltered. Gaining a 5 percent stake would be \u201csuper valuable,\u201d said Eric Talley, a Columbia University professor specializing in corporate and transactional law.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It would be difficult to calculate damages, based on the structure of the deal and legal rules about remedies, Mr. Talley said, so rather than sorting it out, a judge could simply order Mr. Puech to complete the deal. Even if it turns out that Mr. Puech is correct and the shares are not immediately accessible, a ruling in their favor would give the Qataris legal leverage if his estate is eventually untangled and the shares resurface.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But prying loose those shares could prove extremely challenging.
