After Mr. Carlock suffered years of sexual abuse by one of the camp\u2019s directors, he reached a financial settlement to compensate him for his trauma, but at a suffocating price: He could never tell anyone about what had happened.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Carlock, a neuroscience researcher, cycled in and out of more than a dozen hospitals and treatment centers, and tried electroconvulsive therapy. He became increasingly detached from family and friends, and took his own life in August 2019. He was 28.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cTrey told a therapist, \u2018They will always control me, and I\u2019ll never be free,\u2019\u201d said Ms. Phillips, who added that the family still had no idea what his nondisclosure agreement had dictated, or what truly had happened to him. \u201cHe called his settlement dollars blood money, because taking that money in exchange for an NDA felt like a bribe.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">She added, \u201cHe was silenced to his grave.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Thanks to the efforts of Ms. Phillips and other victims\u2019 relatives, Texas and Missouri are among several states now aiming to ban such nondisclosure agreements in cases of childhood sexual assault.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">To critics, the agreements impose a lifetime gag order and deny survivors the ability to heal by sharing their trauma. They also shield perpetrators and the institutions that effectively protect them, allowing abusers to prey upon more unknowing children.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Companies <a class=\"css-yywogo\" href=\"https:\/\/www.investopedia.com\/terms\/n\/nda.asp\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">have long used nondisclosure agreements<\/a> in different contexts to protect trade secrets, confidential data and intellectual property. In civil cases, confidential settlements can resolve matters that might have taken years to go to trial, by allowing those accused of wrongdoing to minimize any publicity.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In recent years, many companies and institutions have used nondisclosure agreements when settling workplace claims of sexual harassment and assault, especially those involving high-profile figures. Yet few such agreements are as potentially fraught as those tied to childhood sexual abuse, involving victims struggling with self-doubt who may have needed <a class=\"css-yywogo\" href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0145213418304551\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">decades to come forward<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Statute of limitations provisions act as another barrier to victims of childhood sexual abuse, with the legal window for filing claims often closing by the time victims reach adulthood and truly understand the damage done.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The extent of the potential liability became clear last week, with <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/07\/us\/los-angeles-county-abuse-settlement.html\" title=\"\">a proposed $4 billion legal settlement in California<\/a> for plaintiffs who said they were sexually abused as children in Los Angeles County\u2019s juvenile detention and foster care systems, in cases dating to the late 1950s.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">This year, lawmakers in Texas and Missouri, led by a number of conservative Republicans, have introduced more than 20 bills related to childhood sexual abuse. Some seek to void existing NDAs and outlaw future ones, allowing victims past and present to disclose what happened and who was responsible. Others aim to loosen the statute of limitations to give survivors more time to file civil lawsuits.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cTo me it\u2019s clear \u2014 you either stand with victims, or you stand with the people who harmed them,\u201d said State Representative Jeff Leach of Texas, the chair of the state\u2019s House Judiciary Committee, who is sponsoring <a class=\"css-yywogo\" href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=HB748\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">one of the bills<\/a>.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">To date, only <a class=\"css-yywogo\" href=\"https:\/\/www.capitol.tn.gov\/Bills\/110\/Bill\/HB2523.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Tennessee<\/a> has enacted similar NDA legislation. But four bills have cleared committees in Texas and Missouri, with the Texas House set to vote on one on Tuesday. Lawmakers in Oklahoma and Oregon have also expressed interest.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">All the while, <a class=\"css-yywogo\" href=\"https:\/\/www.usatoday.com\/story\/news\/investigations\/2022\/05\/27\/sex-abuse-kanakuk-christian-camp-missouri-peter-newman\/9907577002\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Pete Newman, a charismatic camp director<\/a>, was grooming and abusing Mr. Carlock from age 7 to 16, according to court documents. Mr. Newman <a class=\"css-yywogo\" href=\"https:\/\/baptistnews.com\/article\/kanakuk-sex-abuser-pete-newman-denied-parole\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">pleaded guilty in 2010 to sexual abuse<\/a>, and others were also accused. The prosecutor who handled the case has told reporters there were probably <a class=\"css-yywogo\" href=\"https:\/\/thedispatch.com\/article\/new-witnesses-allege-kanakuk-kamps\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">hundreds of victims<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A few years later, Mr. Carlock was among <a class=\"css-yywogo\" href=\"http:\/\/www.news-leader.com\/apps\/pbcs.dll\/article?AID=\/201002191606\/BREAKING01\/100219033\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">dozens of camp attendees<\/a> who either sued or reached settlements with Mr. Newman and Kanakuk using John Doe pseudonyms, on the condition that they stay mum. Several former Kanakuk campers have died by suicide, according to Ms. Phillips and other advocates for victims of childhood sexual abuse.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-7\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ms. Phillips, a 37-year-old Dallas entrepreneur who runs a <a class=\"css-yywogo\" href=\"https:\/\/phillipsfdtn.org\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">family foundation<\/a>, cautioned that people may not always know what drove their loved ones to suicide. But she said that the enforced silence required by the NDA her brother signed had added to his despair.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Kanakuk and its lawyers did not respond to requests to discuss the litigation and legislation. But camp officials acknowledged <a class=\"css-yywogo\" href=\"https:\/\/kanakuk.com\/our-response\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">in a statement<\/a> that \u201cwe were wrong in our understanding of the language of many of these agreements, and we failed to recognize the restrictions \u2014 both real and perceived \u2014 that many victims are under,\u201d and said that they were \u201cdeeply regretful and apologetic.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Still, Kanakuk said that while they \u201csupport the right of victims to share their stories in pursuit of healing,\u201d insurers may insist that the specific terms of any settlement \u201cmust remain confidential.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One supporter of the proposed new legislation in Texas is State Senator Angela Paxton, a Republican from McKinney, north of Dallas. In an interview at her State Capitol office, she said she had been heartbroken upon learning from Ms. Phillips that a former student from Senator Paxton\u2019s days as a high school math teacher had been abused at Kanakuk. He had signed a nondisclosure agreement under duress, he had told Ms. Phillips, and later had become so despondent that he thought about killing himself.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThere are a handful of issues that people really come together over, and I believe this is one that has,\u201d said Senator Paxton, who is the wife of Ken Paxton, Texas\u2019 attorney general.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-8\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Then, she reached for a Bible on her desk, and found a passage in Deuteronomy 30:19 urging people to \u201cchoose life, so that it may go well for you and your children,\u201d as she put it.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThis is why God brought me here \u2014 this legislation, this package around protecting children from future sexual abuse,\u201d she said, tearing up.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-9\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Lawmakers in Missouri have also been supportive and, like their counterparts in Texas, are calling the NDA bill <a class=\"css-yywogo\" href=\"https:\/\/treyslaw.org\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">\u201cTrey\u2019s Law\u201d<\/a> in memory of Mr. Carlock.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">At a hearing in the <a class=\"css-yywogo\" href=\"https:\/\/www.kmbc.com\/article\/missouri-senate-considers-historic-child-sex-abuse-reforms-heart-of-the-matter\/64321776\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Missouri Senate<\/a>, Senator Brad Hudson, a Republican who represents Branson and is also a pastor, said if the bills were not adopted, \u201cwe are siding with abusers and perpetrators in making Missouri a sanctuary state for pedophiles.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-10\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">No one at the hearing opposed the NDA bill, though three business lobbyists <a class=\"css-yywogo\" href=\"https:\/\/www.ky3.com\/2025\/03\/28\/treys-law-would-make-it-easier-missouri-child-sexual-abuse-survivors-prosecute-perpetrators\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">criticized a statute of limitations bill<\/a>, wary of the costs.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIf you had an unlimited liability for an unknown amount of years for an unknown amount of money, how would you as a company be able to set that insurance rate?\u201d said Richard AuBuchon, executive director of the <a class=\"css-yywogo\" href=\"https:\/\/www.mcjrc.org\/about.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Missouri Civil Justice Reform Coalition<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Three <a class=\"css-yywogo\" href=\"https:\/\/house.mo.gov\/bill.aspx?bill=HJR58&amp;year=2025&amp;code=R\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">bills in Missouri<\/a>, and <a class=\"css-yywogo\" href=\"https:\/\/www.legis.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=HJR120\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">three<\/a> in <a class=\"css-yywogo\" href=\"https:\/\/www.legis.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=HJR25\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Texas<\/a>, call for constitutional amendments that, if approved by voters, would allow for retroactive laws for civil actions related to sexual abuse of children. That means victims of past abuse, and not just future ones, could file a claim.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">State Representative Ann Johnson, a Houston Democrat and a former prosecutor, said she had gotten more <a class=\"css-yywogo\" href=\"https:\/\/www.wfaa.com\/article\/news\/politics\/inside-politics\/texas-politics\/democrat-wants-to-remove-restrictive-timeline-for-child-sexual-abuse-survivors\/287-7d7c8ca9-f62b-411f-999e-b9bc4c104b9f\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">traction than during the previous two sessions when she had introduced similar legislation<\/a>. Indeed, she said, someone she has known for decades recently grabbed her by the arm while they were in the courthouse.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cHe told me that he was a victim, and that he had not yet dealt with the issue,\u201d she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Representative Leach\u2019s wife is a survivor as well: She was sexually abused by a family member, and after her <a class=\"css-yywogo\" href=\"https:\/\/www.texastribune.org\/2019\/05\/24\/texas-bill-extending-amount-time-child-sex-abuse-victims-can-sue-passe\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">emotional testimony in 2019<\/a>, in front of Representative Leach\u2019s committee, the legislature extended, to age 48, the deadline by which future survivors of sexual abuse could sue.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-11\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Representative Leach, who represents a district north of Dallas, is now sponsoring the Trey\u2019s Law bill.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWhen Texas leads in areas like this \u2014 when we take some risk and we\u2019re stepping out into uncharted legislative territory \u2014 other states will follow,\u201d he said. \u201cThat\u2019s my hope.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He pointed to a sign in his office, which read, \u201cDo Right and Fear No Man.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He explained: \u201cWhen you know this is the right thing to do, then you know what?
