The justices instead issued a narrow procedural <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/interactive\/2025\/04\/07\/us\/supreme-court-venezuelan-migrants.html\" title=\"\">ruling<\/a>, saying that the migrants\u2019 lawyers had filed their lawsuit in the wrong court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The justices said it should have been filed in Texas, where the Venezuelans are being held, rather than a court in Washington.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">All nine justices agreed that the Venezuelan migrants detained in the United States must receive advance notice and the opportunity to challenge their deportation before they could be removed, Justice Brett M. Kavanaugh wrote in a concurrence.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The split among the court was over where \u2014 and how \u2014 that should happen.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe detainees are confined in Texas, so venue is improper in the District of Columbia,\u201d according to the court\u2019s order, which was brief and unsigned, as is typical in such emergency applications.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The justices ordered that the Venezuelan migrants must be told that they were subject to removal under the Alien Enemies Act \u201cwithin a reasonable time\u201d for them to challenge their removal before they are deported. That finding could impose significant new restrictions on how the Trump administration might attempt to use the act in the future.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">President Trump wrote on social media that he viewed the decision as a victory.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe Supreme Court has upheld the Rule of Law in our Nation by allowing a President, whoever that may be, to be able to secure our Borders, and protect our families and our Country, itself,\u201d Mr. Trump posted on his Truth Social account. \u201cA GREAT DAY FOR JUSTICE IN AMERICA!\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Justice Sonia Sotomayor wrote in dissent that the majority\u2019s legal conclusion was \u201csuspect,\u201d adding that the court had intervened to grant the administration \u201cextraordinary relief\u201d without mentioning \u201cthe grave harm\u201d that the migrants would face if they were \u201cerroneously removed to El Salvador.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe court should not reward the government\u2019s efforts to erode the rule of law,\u201d Justice Sotomayor wrote.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She was joined in dissent by the court\u2019s two other liberal justices, Elena Kagan and Ketanji Brown Jackson. Justice Amy Coney Barrett joined in part.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a separate dissent, Justice Jackson sharply criticized the court\u2019s decision to act on the emergency docket, where cases are typically heard quickly and without oral argument and full briefing.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cAt least when the court went off base in the past, it left a record so posterity could see how it went wrong,\u201d Justice Jackson wrote, citing <a class=\"css-yywogo\" href=\"http:\/\/www.law.cornell.edu\/supremecourt\/text\/323\/214\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Korematsu v. United States<\/a>, a notorious 1944 decision by the court upholding the forcible internment of Japanese Americans during World War II.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cWith more and more of our most significant rulings taking place in the shadows of our emergency docket, today\u2019s court leaves less and less of a trace,\u201d Justice Jackson wrote. \u201cBut make no mistake: We are just as wrong now as we have been in the past, with similarly devastating consequences.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for the migrants challenging their deportations were \u201cdisappointed\u201d that they would \u201cneed to start the court process over again\u201d in a different court, but counted the ruling as a win, said Lee Gelernt, a lawyer for the American Civil Liberties Union.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Gelernt said that \u201cthe critical point is that the Supreme Court rejected the government\u2019s position that it does not even have to give individuals meaningful advance notice so they can challenge their removal under the Alien Enemies Act.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He added, \u201cThat is a huge victory.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The case is perhaps the most high-profile of the nine emergency applications the Trump administration has filed with the Supreme Court so far, and it presents a direct collision between the judicial and executive branches.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The administration had asked the justices to weigh in on its effort to use the Alien Enemies Act, a 1798 law, to deport more than 100 Venezuelans it claims are members of Tren de Aragua, a violent street gang rooted in Venezuela. The administration argues that their removals are allowed under the act, which grants the president authority to detain or deport citizens of enemy nations. The president may invoke the law in times of \u201cdeclared war\u201d or when a foreign government invades the United States.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">On March 14, Mr. Trump signed a proclamation that targeted members of Tren de Aragua, claiming that there was an \u201cinvasion\u201d and a \u201cpredatory incursion\u201d underway. In the proclamation, Mr. Trump claimed that the gang was \u201cundertaking hostile actions\u201d against the United States \u201cat the direction, clandestine or otherwise\u201d of the Venezuelan government.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Lawyers representing some of those targeted challenged the order in federal court in Washington.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That same day, planeloads of the deportees were sent to El Salvador, which had entered an agreement with the Trump administration to take the Venezuelans and detain them.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A federal judge, James E. Boasberg, directed the administration to stop the flights. He subsequently issued a written order temporarily pausing the administration\u2019s plan while the court case proceeded.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The administration appealed Judge Boasberg\u2019s temporary restraining order, and a divided panel of three appellate court judges in Washington sided with the migrants, keeping the pause in place. One judge wrote that the government\u2019s deportation plan had denied the Venezuelans \u201ceven a gossamer thread of due process.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">At that point, the Trump administration asked the Supreme Court to weigh in, arguing in <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A931\/354225\/20250328102104004_24a%20Trump%20v.%20JGG.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">its application<\/a> that the case presented \u201cfundamental questions about who decides how to conduct sensitive national-security-related operations in this country.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for the migrants <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A931\/354494\/20250401111703480_2025.04.01%20AEA%20Stay%20Opp%20FINAL%20Opp.%20only%20pdfA.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">responded<\/a> sharply, arguing that the temporary pause by Judge Boasberg was \u201cthe only thing\u201d standing in the way of the government sending migrants \u201cto a prison in El Salvador, perhaps never to be seen again, without any kind of procedural protection, much less judicial review.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The American Civil Liberties Union and Democracy Forward, the groups representing the Venezuelan migrants, said the president had bent the law in an \u201ceffort to shoehorn a criminal gang\u201d into the wartime law in a manner that was \u201ccompletely at odds with the limited delegation of wartime authority Congress chose to give him through the statute.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for the migrants said the deportees sent to El Salvador \u201chave been confined, incommunicado, in one of most brutal prisons in the world, where torture and other human rights abuses are rampant.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Trump administration replied on Wednesday <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A931\/354573\/20250402092551698_JGG_Reply_4.2_Final.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">in a brief<\/a> that contended that the government was not denying that the Venezuelan migrants should receive \u201cjudicial review.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThey obviously do,\u201d the acting solicitor general, Sarah M. Harris, wrote.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Rather, the government argued, that \u201cthe pressing issues right now are \u2018procedural issues\u2019 about where and how detainees should challenge their designations as enemy aliens.\u201d Ms. Harris argued that the migrants should have filed their legal challenge in Texas, where they had been detained before the deportation flights, rather than in Washington.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She asked the justices to lift the temporary block on Mr. Trump\u2019s order, calling the pause \u201can intolerably long time for a court to block the executive\u2019s conduct of foreign-policy and national-security operations.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Harris claimed that the migrants\u2019 lawyers had offered a \u201csensationalized\u201d narrative.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She added that the government denied that the migrants might face torture in El Salvador, writing that the
