Alphabet is the parent company of Google.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The company told employees that it would not \u201cannounce or maintain overbroad rules or policies that restrict your right to comment, internally or externally,\u201d about how the antitrust lawsuit targeting Google\u2019s search engine might affect the terms and conditions of their employment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Google\u2019s change of tune was part of a settlement overseen by the National Labor Relations Board. The union had filed an unfair labor practices complaint with the N.L.R.B. concerning Mr. Walker\u2019s note in August.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The agreement is another blow to <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/20\/technology\/google-antitrust-employee-messages.html\" title=\"\">Google\u2019s corporate policies designed to maintain secrecy<\/a>, which have been scrutinized amid the search case brought by the Justice Department. It also undercut Google\u2019s strategy to keep its business humming during the lawsuit \u2014 to have employees ignore the antitrust battle and remain focused on their work.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Walker, Google\u2019s president of global affairs, first told employees not to discuss the case when it was filed in October 2020, according to an email viewed by The Times.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt\u2019s important not to get distracted by this process, including not speculating on legal issues internally or externally,\u201d he wrote, instead directing employees to focus on building great products and services to help people.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He repeated the call in September 2023, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/09\/06\/technology\/modern-internet-first-monopoly-trial-us-google-dominance.html\" title=\"\">when the case went to trial<\/a>, and again in August, when Google lost that trial. The N.L.R.B. settlement concerned only that final note.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Two months later, Lee-Anne Mulholland, Google\u2019s vice president of regulatory affairs, tried to clarify that Mr. Walker\u2019s instructions referred to speaking on Google\u2019s behalf to the public.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThat was the basis of Kent\u2019s earlier request that Googlers refrain from commenting on\u201d the case, she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Courtenay Mencini, a Google spokeswoman, said the company disagreed with the N.L.R.B.\u2019s interpretation of its \u201creasonable request that employees not comment on a pending legal case on behalf of Google without approval.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cTo avoid lengthy litigation, we agreed to remind employees that they have the right to talk about their employment, as they\u2019ve always been free to and regularly do,\u201d she added.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/07\/technology\/trump-google-search-antitrust.html\" title=\"\">Justice Department has called for a breakup of Google<\/a>, including a divestment of Chrome, its popular web browser, among other remedies meant to restore competition in search. Amit P. Mehta, a federal judge, will decide what remedies to impose by August.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It has been hard to tune all of the legal machinations out, Stephen McMurtry, a senior software engineer at Google search and a member of the union, said in an interview.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cAmongst employees generally, there is fear of instability that the breakups could provide to our employment, working conditions, compensation, all sorts of things,\u201d Mr. McMurtry said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Like other large tech companies, Google has established a pattern of secrecy in its culture and corporate communications. After Microsoft\u2019s legal defense was hamstrung by damaging emails during its <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/11\/14\/business\/google-antitrust-microsoft-precedent.html\" title=\"\">antitrust trial a quarter century ago<\/a>, Google tried to learn from the company\u2019s example by telling employees not to say anything that might make the company\u2019s conduct sound anticompetitive.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Google also routinely discussed sensitive business matters in instant messages that were automatically deleted, though the company said it had handed over many chats to the Justice Department.<\/p>\n<\/div>\n<aside
