Roberts Jr. on Monday temporarily blocked a trial judge\u2019s order directing the United States to return a Salvadoran migrant it had inadvertently deported.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The chief justice, acting on his own, issued an \u201cadministrative stay,\u201d an interim measure meant to give the justices some breathing room while the full court considers the matter.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The order came just hours after the administration <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A949\/354843\/20250407103341248_Kristi%20Noem%20application.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">asked the court<\/a> to block the trial judge\u2019s order instructing the government to return the migrant, Kilmar Armando Abrego Garcia, by 11:59 p.m. on Monday.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Paula Xinis of the Federal District Court in Maryland had said the administration committed a \u201cgrievous error\u201d that \u201cshocks the conscience\u201d by sending Mr. Abrego Garcia, to a notorious prison in El Salvador last month.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In the administration\u2019s emergency application, D. John Sauer, the U.S. solicitor general, said Judge Xinis had exceeded her authority by engaging in \u201cdistrict-court diplomacy,\u201d because it would require working with the government of El Salvador to secure his release.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIf this precedent stands,\u201d he wrote, \u201cother district courts could order the United States to successfully negotiate the return of other removed aliens anywhere in the world by close of business,\u201d he wrote. \u201cUnder that logic, district courts would effectively have extraterritorial jurisdiction over the United States\u2019 diplomatic relations with the whole world.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A949\/354927\/20250407153131040_2025.04.07%20Respondents%20Opp%20to%20App%20to%20Vacate.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">In a response<\/a> to the court, Mr. Abrego Garcia\u2019s lawyers said their client \u201csits in a foreign prison solely at the behest of the United States, as the product of a Kafka-esque mistake.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">They added: \u201cThe district court\u2019s order instructing the government to facilitate Abrego Garcia\u2019s return is routine. It does not implicate foreign policy or even domestic immigration policy in any case.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sauer, the administration\u2019s lawyer, said it did not matter that an immigration judge had previously prohibited Mr. Abrego Garcia\u2019s deportation to El Salvador.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cWhile the United States concedes that removal to El Salvador was an administrative error,\u201d Mr. Sauer wrote, \u201cthat does not license district courts to seize control over foreign relations, treat the executive branch as a subordinate diplomat and demand that the United States let a member of a foreign terrorist organization into America tonight.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The administration contends that Mr. Abrego Garcia, 29, is a member of a violent transnational street gang, MS-13, which officials recently designated as a terrorist organization.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Xinis, who was appointed by President Barack Obama, said those claims were being based on \u201ca singular unsubstantiated allegation.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe \u2018evidence\u2019 against Abrego Garcia consisted of nothing more than his Chicago Bulls hat and hoodie,\u201d she wrote, \u201cand a vague, uncorroborated allegation from a confidential informant claiming he belonged to MS-13\u2019s \u2018Western\u2019 clique in New York \u2014 a place he has never lived.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Abrego Garcia\u2019s lawyers said there was no evidence that he posed a risk.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cAbrego Garcia has lived freely in the United States for years, yet has never been charged for a crime,\u201d they wrote. \u201cThe government\u2019s contention that he has suddenly morphed into a dangerous threat to the republic is not credible.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Just before the Justice Department asked the Supreme Court to weigh in, a three-judge panel of the U.S. Court of Appeals for the Fourth Circuit unanimously rejected the department\u2019s attempt to pause Judge Xinis\u2019s ruling.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca4.178258\/gov.uscourts.ca4.178258.13.0_2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a sharply worded order<\/a>, two judges likened Mr. Abrego Garcia\u2019s inadvertent deportation to an act of official kidnapping.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe United States government has no legal authority to snatch a person who is lawfully present in the United States off the street and remove him from the country without due process,\u201d wrote Judge Stephanie D. Thacker, who was appointed by Mr. Obama. \u201cThe government\u2019s contention otherwise, and its argument that the federal courts are powerless to intervene, are unconscionable.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Thacker wrote that Judge Xinis\u2019s order \u201crequires only that the United States government exercise the authority and control it must have retained over the detainees it is temporarily housing in El Salvador,\u201d adding that \u201crequiring that the government effectuate and facilitate Abrego Garcia\u2019s return is not a novel order.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Robert B. King, who was appointed by President Bill Clinton, joined Judge Thacker\u2019s opinion.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A third member of the panel, Judge J. Harvie Wilkinson III, issued a concurring opinion agreeing that no stay was warranted but stopping short of the majority\u2019s position that Judge Xinis had the power to tell the government to demand Mr. Abrego Garcia\u2019s return.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThere is no question that the government screwed up here,\u201d Judge Wilkinson wrote. But he drew a distinction.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt is fair to read the district court\u2019s order as one requiring that the government facilitate Abrego Garcia\u2019s release, rather than demand it,\u201d wrote Judge Wilkinson, who was appointed by President Ronald Reagan. \u201cThe former seems within the trial court\u2019s lawful powers in this circumstance; the latter would be an intrusion on core executive powers that goes too far.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Sauer said Judge Xinis\u2019s order was one in a series of rulings from courts exceeding their constitutional authority.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt is the latest in a litany of injunctions or temporary restraining orders from the same handful of district courts that demand immediate or near-immediate compliance, on absurdly short deadlines,\u201d he wrote.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a separate emergency application, the administration has asked the justices to weigh in on its effort to use the Alien Enemies Act of 1798 to deport Venezuelan migrants to the prison in El Salvador. The court has not yet acted on that application.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In filings to the court, the administration claimed that the migrants are members of Tren de Aragua, a violent street gang rooted in Venezuela, and that their removals are allowed under the act, which grants the president authority to detain or deport citizens of enemy nations.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The president may invoke the law in times of \u201cdeclared war\u201d or when a foreign government invades the United States.
