But it came about in an unusual way: The government <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.280590\/gov.uscourts.mad.280590.108.0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">asked the court to enter that very verdict<\/a> earlier on Friday so it could move ahead with an appeal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The decision nonetheless was an initial win for <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/interactive\/2025\/02\/13\/upshot\/nih-trump-funding-cuts.html\" title=\"\">a diverse assortment of institutions<\/a> that conduct medical research. After the Trump administration announced the policy change in February, scores of research hospitals and universities issued dire warnings that the proposal threatened to <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/07\/us\/politics\/medical-research-funding-cuts-university-budgets.html\" title=\"\">kneecap American scientific prowess and innovation<\/a>, estimating that the change could force those institutions to collectively cover a nearly $4 billion shortfall.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Under the Trump administration\u2019s plan, the National Institutes of Health could cap the funding it provides to cover the \u201cindirect costs\u201d of research \u2014 for things like maintenance of buildings, utilities and support staff \u2014 at 15 percent in the grants it hands out. Historically, when the agency awarded grants, it could <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/interactive\/2025\/02\/13\/upshot\/nih-trump-funding-cuts.html\" title=\"\">allocate close to 50 percent in some cases<\/a> to cover the indirect costs associated with a given study.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The Trump administration said it had conceived of the policy as a way of freeing up more federal dollars to pay for research directly \u2014 covering scientists\u2019 salaries or buying necessary equipment \u2014 as opposed to the many tangential costs that hospitals and laboratories incur in maintaining their facilities and other overhead expenses.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But critics described that reasoning as disingenuous, as the changes the administration had proposed would paradoxically force institutions to cover the bill, and most likely shed staff and scale down research projects in the process.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">During <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/21\/us\/politics\/judge-nih-medical-research-cuts-universities.html\" title=\"\">hearings<\/a> in February, lawyers described a dizzying array of laboratories under construction and clinical drug trials underway that institutions would be forced to abandon if they had to cover overhead costs on their own, more or less overnight.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Kelley had consistently agreed, ruling repeatedly that the policy appeared unnecessarily reckless and would inflict serious harm on important medical research. After initially <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/10\/us\/politics\/nih-trump-lawsuit-medical-research.html\" title=\"\">barring the Trump administration<\/a> from implementing the change in February, she <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/05\/us\/politics\/trump-nih-research-funding-cuts-blocked.html\" title=\"\">extended<\/a> her order twice while the lawsuit played out.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The government wrote that the case presented \u201cdispositive legal issues\u201d that it would address more fully when the case reached a court of appeals.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The decision also came as the scientific and research community was grappling with even more dire threats to its work from the <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/27\/us\/politics\/health-department-job-layoffs-rfk-jr.html\" title=\"\">avalanche of cuts<\/a> recently to the Department of Health and Human Services.
