But the court <a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/about\/how-the-court-works\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">cannot enforce its rulings<\/a> and relies on its member states to detain people who are accused of crimes.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The court draws its jurisdiction from the Rome Statute, a treaty <a class=\"css-yywogo\" href=\"https:\/\/asp.icc-cpi.int\/states-parties\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ratified by 125 countries<\/a>. The statute formally commits its signatories to arrest a wanted person who enters their soil, but members do not always comply.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The court is based in The Hague, a Dutch city that is a hub for international law and justice. The International Court of Justice, which handles civil disputes between countries and is part of the United Nations, is also based there.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The I.C.C. cannot try any suspects in absentia. Instead, it relies on member states to enforce its rulings with actions like making arrests, freezing assets and surrendering suspects to The Hague, where the I.C.C. has a detention center.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Former President Rodrigo Duterte of the Philippines is currently in I.C.C. custody after being <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/10\/world\/asia\/icc-philippines-rodrigo-duterte.html\" title=\"\">arrested in March by Filipino authorities on charges of crimes against humanity<\/a>.<\/p>\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-36aed23d\">Which countries are not members of the court?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">Some of the world\u2019s most powerful countries, including the United States, China, Russia, India and Israel, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/21\/world\/middleeast\/us-icc-member-countries.html\" title=\"\">are not members<\/a> of the court. They do not honor its arrest warrants or hand their citizens over for prosecution.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Hungary would be the first European Union country to withdraw from the court. Under the Rome Statute, Hungary\u2019s decision would not take effect for a year.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cHungary remains under a duty to cooperate with the I.C.C.,\u201d Fadi El Abdallah, the court spokesman, said in a statement on Thursday.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/situations\/burundi\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Burundi<\/a> and the <a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/news\/situation-philippines-rodrigo-roa-duterte-icc-custody\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Philippines<\/a> have both pulled out of court, in response to the I.C.C. prosecutor opening an investigation against their leaders. The court has said that Mr. Duterte is being prosecuted because the offenses he is accused of took place before his country\u2019s withdrawal took effect, although his lawyers have contested that argument.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<h2 class=\"css-13o6u42 eoo0vm40\" id=\"link-6bc125bd\">Who has the I.C.C. pursued?<\/h2>\n<p class=\"css-at9mc1 evys1bk0\">The court says that it has issued 60 arrest warrants.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">About half of those people are \u201cat large,\u201d like <a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/defendant\/netanyahu\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Mr. Netanyahu<\/a>. Others are either dead, like <a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/defendant\/muammar-gaddafi\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Col. Muammar el-Qaddafi<\/a>, the former leader of Libya, or detained, like <a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/philippines\/duterte\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Mr. Duterte<\/a>.<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-711a7daf\"><span>Israel and Gaza<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">In November, the court issued arrest warrants for the <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/22\/world\/middleeast\/israel-icc-jurisdiction-explained.html\" title=\"\">leaders of Israel and Hamas<\/a>. On the Israeli side, the warrants were for Mr. Netanyahu and his former defense minister, Yoav Gallant.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The court also issued a warrant for Muhammad Deif, a Hamas leader, who was later <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/30\/obituaries\/muhammad-deif-hamas-dead.html\" title=\"\">killed in an Israeli strike<\/a>.<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-6a6c16d\"><span>Russia<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">The court <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/03\/17\/world\/europe\/putin-icc-arrest-warrant-war-crimes.html\" title=\"\">issued arrest warrants<\/a> for President Vladimir V. Putin and another Russian official in 2023. It argued that they both bore criminal responsibility for the abduction and deportation of Ukrainian children after Russia\u2019s full-scale invasion of Ukraine in 2022. It has also issued arrest warrants for four other Russian officials.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Putin made his first visit to an I.C.C. member state in September, but the country, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/09\/02\/world\/europe\/putin-mongolia.html\" title=\"\">Mongolia<\/a>, warmly welcomed him with a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/09\/03\/world\/asia\/putin-mongolia-icc-arrest.html\" title=\"\">red carpet<\/a>.<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-2f9571\"><span>Kenya<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">William Ruto, the president, was charged in 2011 with <a class=\"css-yywogo\" href=\"https:\/\/www.icc-cpi.int\/kenya\/rutosang\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">crimes against humanity<\/a> and other offenses tied to post-election <a class=\"css-yywogo\" href=\"http:\/\/www.nytimes.com\/2007\/12\/31\/world\/africa\/31kenya.html\" title=\"\">violence<\/a> in 2007 and 2008. The court dropped the case in 2016.<\/p>\n<h3 class=\"css-15h6bi9 e1gnsphs0\" id=\"link-36b2fc\"><span>Sudan<\/span><\/h3>\n<p class=\"css-at9mc1 evys1bk0\">Omar Hassan al-Bashir, who was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2019\/04\/11\/world\/africa\/omar-bashir-sudan.html\" title=\"\">deposed as president<\/a> in 2019 after three decades in power, is the subject of court warrants in 2009 and 2010 for crimes in the western region of Darfur. He traveled to South Africa in 2015 in defiance of the I.C.C. warrant <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2017\/07\/06\/world\/africa\/icc-south-africa-sudan-bashir.html\" title=\"\">but was not arrested<\/a> there.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The I.C.C. also charged other Sudanese officials with crimes in Darfur.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. al-Bashir also faces <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2020\/07\/21\/world\/africa\/sudan-omar-hassan-al-bashir-coup-trial.html\" title=\"\">charges in Sudan<\/a> that relate to the coup in 1989 that pushed him to power.
