Alito Jr., the justices left in place, for now, an F.D.A. order that prohibited retailers from marketing flavored tobacco products, sending the case back to the U.S. Court of Appeals for the Fifth Circuit for further review.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Justice Alito wrote that the agency\u2019s denials of the applications were for the most part \u201csufficiently consistent\u201d with agency guidance on tobacco regulations. The justices rejected a ruling by the appeals court that the agency had acted arbitrarily and capriciously and had tried to change the rules in the middle of the approval process.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the opinion, Justice Alito highlighted the possible dangers of the flavored products appealing to middle and high school students, writing that \u201cthe kaleidoscope of flavor options adds to the allure of e-cigarettes and has thus contributed to the booming demand for such products among young Americans.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cFlavors lure kids, which is why Congress gave F.D.A. the authority to make science-based decisions on what is appropriate for our nation\u2019s health,\u201d said Erika Sward, the assistant vice president for nationwide advocacy at the American Lung Association, who applauded the court\u2019s ruling.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Tony Abboud, the executive director of the Vapor Technology Association, a trade group, said in a statement that he was \u201cdeeply disappointed\u201d by the ruling.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe future of flavored vaping now lies in President Trump\u2019s hands, and we urge him to fulfill his campaign promise to save flavored vaping \u2014 the most effective tool available to quit smoking deadly cigarettes,\u201d he said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The ruling was not quite a complete victory for the agency, which had not contested one aspect of the appeals court\u2019s ruling: that it should not have told the manufacturers that their marketing plans would be critical to their applications only to discount them. The agency argued that any error on that score was harmless. The Supreme Court instructed the lower court to reconsider that question.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The decision comes at a fraught turning point for the agency.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In recent months, leaders <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/09\/05\/health\/e-cigarettes-teenagers-vaping.html\" title=\"\">celebrated a 10-year low<\/a> in the percent of adolescents using e-cigarettes. The F.D.A. has attributed the decline <a class=\"css-yywogo\" href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-educational-efforts-prevented-nearly-450000-youth-starting-e-cigarette-use-one-year?utm_campaign=ctp-realcost&amp;utm_content=pressrelease&amp;utm_medium=email&amp;utm_source=govdelivery&amp;utm_term=stratcomms\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">to effective messaging<\/a> targeted at teenagers and to aggressive enforcement against those who market illicit vapes in flavors like Unicorn Shake and watermelon bubble gum.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The agency is also grappling with deep cuts to its tobacco division staff and its counterpart at the Centers for Disease Control and Prevention, which gathers data on youth tobacco use. Amid thousands of staff cuts, Brian King, the director of the F.D.A.\u2019s Center for Tobacco Products, was offered a new role in the Indian Health Service, with the option to work in Alaska or New Mexico \u2014 a tacit ouster.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Sward described the decimation of the federal tobacco control staff as \u201cChristmas Day for big tobacco.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThere is no one to keep the tobacco industry from flooding the market with its deadly products and no one left to count how many kids they addict,\u201d she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The decision on Wednesday is a \u201cringing validation\u201d of the F.D.A.\u2019s work, said Mitch Zeller, a former director of the agency\u2019s tobacco division who served during the first Trump administration and under Presidents Barack Obama and Joseph R. Biden Jr. But he said its timing \u2014 a day after the deep cuts \u2014 was ironic and boded poorly for the future of limiting youth tobacco use.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe Trump administration\u2019s destruction of the Food and Drug Administration and the Center for Tobacco Products, in particular, imperils the ability of the center to continue to do its job on behalf of the public health,\u201d he said.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">A 2009 law, the Family Smoking Prevention and Tobacco Control Act, requires makers of new tobacco products to obtain authorization from the F.D.A. According to the law, the manufacturers\u2019 applications must demonstrate that their products are \u201cappropriate for the protection of the public health.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The agency has denied many applications under the law, including the two at issue in the case before the justices, saying the flavored liquids presented a \u201cknown and substantial risk to youth.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The appeals court <a class=\"css-yywogo\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/21\/21-60766-CV3.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ruled last year<\/a> that the agency had changed the rules in the middle of the application process, accusing it of \u201cregulatory switcheroos\u201d that sent the companies \u201con a wild-goose chase.\u201d More formally, the court said the agency\u2019s actions had been arbitrary and capricious.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-1038\/303408\/20240319144123357_FDA%20v.%20Wages%20%20White%20Lion.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">asking the Supreme Court<\/a> to hear the case, <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/23-1038.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Food and Drug Administration v. Wages and White Lion Investments<\/a>, No. 23-1038, the agency\u2019s lawyers cited <a class=\"css-yywogo\" href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca4\/21-2077\/21-2077-2022-12-12.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">another appeals court<\/a> that had reached the opposite conclusion. The Fifth Circuit\u2019s decision \u201chas far-reaching consequences for public health and threatens to undermine the Tobacco Control Act\u2019s central objective of \u2018ensuring that another generation of Americans does not become addicted to nicotine and tobacco products,\u2019\u201d they wrote, quoting from the other appeals court\u2019s decision.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">What\u2019s next for federal tobacco regulation is uncertain. President Trump has suggested that he will <a class=\"css-yywogo\" href=\"https:\/\/www.wbur.org\/hereandnow\/2024\/10\/11\/trump-vaping\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">advance the interests<\/a> of adults who use e-cigarettes, many of whom also use flavored vapes.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Major tobacco companies, though, have complied with F.D.A. rules and gotten approval to sell more staid products, including tobacco and menthol-flavored e-cigarettes. At least one company, Reynolds American, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/26\/us\/politics\/trump-industry-promises.html\" title=\"\">has donated heavily<\/a> to Mr. Trump\u2019s campaign and has made it clear that it <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/10\/10\/health\/illegal-vapes-ecigarettes-fda.html\" title=\"\">wants the F.D.A. to crack down<\/a> on the flavored e-cigarettes pouring in from China and taking away its market share.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><script
