Sue President Trump Over Dismissals"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Two <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/technology\/trump-ftc-fires-democrats.html\" title=\"\">Democratic former members of the Federal Trade Commission<\/a> on Thursday sued President Trump over his decision to fire them from the agency, accusing him of an illegal overreach of executive power.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump fired the Democratic commissioners, Rebecca Kelly Slaughter and Alvaro Bedoya, on March 18, upending the consumer protection agency, which is typically run by three members from the president\u2019s party and two members from the opposing party.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a lawsuit filed in the United States District Court for the District of Columbia, lawyers for Ms. Slaughter and Mr. Bedoya argued that Mr. Trump\u2019s dismissals of them were without cause and violated federal law. They cited a <a class=\"css-yywogo\" href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/295\/602\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">1935 Supreme Court precedent<\/a> that said the president may not fire independent regulatory boards members solely over policy disagreements.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIn short, it is bedrock, binding precedent that a president cannot remove an F.T.C. commissioner without cause,\u201d the lawsuit said. \u201cThe president\u2019s action is indefensible under governing law.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The White House, which did not immediately respond to a request for comment, previously said that \u201cPresident Trump has the lawful authority to manage personnel within the executive branch.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The lawsuit was the latest legal battle to erupt over Mr. Trump\u2019s attempts to expand the power of the presidency. In recent months, more than 50 court rulings have in many cases temporarily halted actions taken by the administration, ranging from its <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/26\/us\/trump-deportations-flight-block-alien-enemies-act.html\" title=\"\">aggressive stance on deportations<\/a> to its firing of civil servants.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The legal battles have also affected regulators that Congress set up to be independent from direct White House control. While regulators are appointed by the president, many have traditionally had wide latitude to determine the direction of their agencies.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Mr. Trump earlier fired Gwynne Wilcox, a Democrat on the National Labor Relations Board, who was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/06\/us\/politics\/trump-nlrb-member-reinstated.html\" title=\"\">reinstated by a federal court<\/a> this month. The administration has appealed that ruling.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump also <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/18\/us\/trump-executive-order-sec-ftc-fcc.html\" title=\"\">signed an executive order last month<\/a> that affected the F.T.C., the Securities and Exchange Commission, the Federal Communications Commission and the National Labor Relations Board. The executive order instructed those agencies to submit proposed regulations to the White House for review, as well as declaring that they must accept as binding the interpretations of the law made by the president and the Justice Department, among other measures.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ms. Slaughter and Mr. Bedoya\u2019s lawsuit also named the two Republican F.T.C. commissioners \u2014 its chairman, Andrew Ferguson, and Melissa Holyoak \u2014 as defendants. They also named the agency\u2019s executive director David B. Robbins.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The 1914 law that established the F.T.C. says that commissioners can be removed from the five-member board for \u201cinefficiency, neglect of duty or malfeasance in office.\u201d The Supreme Court reinforced those protections in the 1930s when President Franklin D. Roosevelt tried to fire a member of the F.T.C.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In a letter sent on behalf of Mr. Trump last week informing one of the commissioners of the termination, the White House said that the protections established by the Supreme Court\u2019s ruling didn\u2019t apply to those who lead the F.T.C. today.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Ferguson said in a statement last week that he had \u201cno doubts\u201d about the president\u2019s constitutional authority to remove his colleagues. The F.T.C. did not immediately respond to a request for comment on the lawsuit.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In the lawsuit, lawyers for Ms. Slaughter and Mr. Bedoya said the two have been \u201cdenied access to their offices&#8221; and were now listed as former members of the commission on the F.T.C.\u2019s website. Their staff have also been put on administration leave, according to the lawsuit.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The F.T.C. has been responsible for some of the biggest showdowns between corporate America and the federal government. In April, the agency is scheduled to face off against Meta, the owner of Facebook, Instagram and other apps, at an antitrust trial over whether the tech giant illegally stifled nascent competitors when it bought Instagram and WhatsApp.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The F.T.C. has also filed lawsuits against Amazon, arguing it made it hard for consumers to cancel its Prime subscription service and squeezed small merchants that use its site.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Under Mr. Ferguson, the agency has increasingly turned its focus to the big online platforms\u2019 power over speech and discourse.
