It comes four days after President Trump <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/20\/us\/politics\/trump-education-department.html\" title=\"\">signed an executive order<\/a> that directed the education secretary, Linda McMahon, to \u201ctake all necessary steps to facilitate the closure of the department.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The day after the order, Mr. Trump announced that the Small Business Administration would <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/21\/us\/politics\/trump-education-department-student-loans.html\" title=\"\">assume control<\/a> of the government\u2019s $1.6 trillion student loan portfolio, and that the Health and Human Services Department would oversee nutrition programs and special education services.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Education Department, created in 1979, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/20\/us\/can-trump-dismantle-education-department.html\" title=\"\">cannot be closed without Congress\u2019s consent<\/a>. The lawsuit argues that moves by the Trump administration since it came to power in January, including an effort to <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/11\/us\/politics\/trump-education-department-firings.html\" title=\"\">roughly halve the department\u2019s work force<\/a>, \u201cwill interfere with the department\u2019s ability to carry out its statutorily required functions.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ilana Krepchin, chairwoman of the Somerville, Mass., school committee, which is a plaintiff in the case, said that the Education Department is a \u201ccornerstone of equitable public education.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cDismantling it would cause real harm \u2014 not only to our students and schools, but to communities across the country,\u201d Ms. Krepchin said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Neither the White House nor the Education Department responded immediately to requests for comment on Monday.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The White House press secretary, Karoline Leavitt, said on Friday that the president was \u201cdoing everything within his executive authority to dismantle the Department of Education and return education back to the states while safeguarding critical functions for students and families such as student loans, special needs programs and nutrition programs.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She added that Mr. Trump recognized that \u201cCongress has a role to play in this effort, and we expect them to help the president deliver.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Republicans on Capitol Hill \u2014 including Senator Bill Cassidy of Louisiana, chairman of the Senate Committee on Health, Education, Labor and Pensions \u2014 have pledged to support the president\u2019s push. But rank-and-file lawmakers are expected to face significant pressure, both for and against the plan, before any vote is held.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Charles L. Welch, the president of the American Association of State Colleges and Universities, said last week that he was \u201cdismayed\u201d by Mr. Trump\u2019s order and urged lawmakers to, in effect, defy the White House and back preserving the department.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Education Department has limited power over what is taught in American classrooms. Its principal jobs are to distribute money to schools, enforce civil rights laws and run the federal student aid program for college students. It has historically played a large role in <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/12\/us\/education-department-cuts.html\" title=\"\">data collection and education research funding<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It is not clear when any legislation to close or rebuild the department might come to a vote. The plaintiffs in the lawsuit filed on Monday asked a judge to block the administration\u2019s interim campaign immediately.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion
