It was <a class=\"css-yywogo\" href=\"https:\/\/scholar.google.com\/scholar_case?case=6793744138882117428&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ruled unconstitutional<\/a> in 1996 \u2014 by President Trump\u2019s sister.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump does not have much use for a lot of judges. Last week, for instance, he <a class=\"css-yywogo\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114183576937425149\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">called for the impeachment<\/a> of \u201cmany of the Crooked Judges I am forced to appear before.\u201d But he held his sister, <a class=\"css-yywogo\" href=\"https:\/\/www.fjc.gov\/history\/judges\/barry-maryanne-trump\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Judge Maryanne Trump Barry<\/a>, in high regard.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI will never forget the many times people would come up to me and say, \u2018Your sister was the smartest person on the Court,\u2019\u201d he <a class=\"css-yywogo\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/111410110304557818\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">posted on social media<\/a> when she died in 2023. \u201cI was always honored by that, but understood exactly what they meant \u2014 They were right! She was a great Judge, and a great sister.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">When Judge Barry considered <a class=\"css-yywogo\" href=\"https:\/\/codes.findlaw.com\/us\/title-8-aliens-and-nationality\/8-usc-sect-1227\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the 1952 law<\/a>, which the Trump administration has said will play a major role in its deportation plans, she asked whether it could be squared with the Constitution. \u201cThe answer,\u201d she wrote, \u201cis a ringing \u2018no.\u2019\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">At the time, Judge Barry was a federal trial judge, and so her ruling did not establish a precedent binding on other courts. In any event, an appeals court later reversed her decision, though on grounds unrelated to its substance.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But it remains the most thorough judicial examination of the constitutionality of the law, and other judges may find its reasoning persuasive.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The case involved Mario Ruiz Massieu, a former Mexican official whom the Clinton administration sought to deport to Mexico. The secretary of state at the time, Warren M. Christopher, told Mr. Ruiz Massieu precisely the same thing that <a class=\"css-yywogo\" href=\"https:\/\/www.washingtonpost.com\/documents\/8a3cbff6-4589-43e1-8455-042fa9555e3c.pdf?itid=lk_inline_manual_4\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Secretary of State Marco Rubio told Mr. Khalil<\/a>: \u201cYour presence or activities in the United States would have potentially serious adverse foreign policy consequences for the United States.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That sentence was chilling, wrote Judge Barry, who was appointed to the Federal District Court in New Jersey by President Ronald Reagan <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2015\/08\/19\/us\/politics\/familiar-talk-women-from-donald-trump-sister.html?_r=0\" title=\"\">after lobbying by<\/a> Mr. Trump\u2019s mentor and fixer, Roy M. Cohn.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The law, she wrote, \u201cconfers upon a single individual, the secretary of state, the unfettered and unreviewable discretion to deport any alien lawfully within the United States\u201d if \u201cthat person\u2019s mere presence here would impact in some unexplained way on the foreign policy interests of the United States.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">That violated the Constitution in at least two ways, Judge Barry wrote. First, she said, it was too vague to give notice to the people subject to it of what conduct it prohibited.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Under the law, she wrote, \u201call <em class=\"css-2fg4z9 e1gzwzxm0\">legal<\/em> aliens, whether here for a day or 50 years and visiting or resident in this country, must live in fear of the secretary of state informing them, at any time, that our foreign policy requires their deportation to a particular country for reasons unknown to them and beyond their control.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She emphasized that the law applied to, among others, \u201clifelong permanent residents.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cFor those who have been in this country for a substantial period of time,\u201d she wrote, \u201cit would mean the loss of all they had built for themselves here and an irreparable disruption of the lives they had established.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Barry offered a second reason for striking down the law, saying that it was an unconstitutional delegation of legislative power to the secretary of state, granting him complete discretion.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The law ran afoul, she wrote, of the nondelegation doctrine, which forbids Congress from giving too much leeway to executive branch officials with insufficient guidance. The doctrine has been largely dormant since 1935, when the Supreme Court used it to strike down New Deal laws. But members of the court\u2019s conservative majority have <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/18pdf\/17-6086_2b8e.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">expressed an interest<\/a> in reviving the doctrine.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The Supreme Court will hear arguments on Wednesday <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/22\/us\/supreme-court-fcc-agency-power.html\" title=\"\">on the scope of the doctrine<\/a> in an unrelated case.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Barry\u2019s ruling was reversed by the U.S. Court of Appeals for the Third Circuit, in Philadelphia, a court she would join in 1999 after being appointed by President Bill Clinton. The author of <a class=\"css-yywogo\" href=\"https:\/\/scholar.google.com\/scholar_case?case=7004697097821672875&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the appeal\u2019s court\u2019s opinion<\/a> was Judge Samuel A. Alito Jr., who would join the Supreme Court in 2006.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Alito did not address Judge Barry\u2019s constitutional rulings, saying instead that Mr. Ruiz Massieu had pursued his claims in the wrong forum. \u201cWe do not reach the merits of the constitutional questions decided by the district court,\u201d he wrote.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In later years, Judge Barry lamented her brother\u2019s policies, notably the separation of children from their migrant parents in his first administration. In <a class=\"css-yywogo\" href=\"https:\/\/www.washingtonpost.com\/politics\/maryanne-trump-barry-secret-recordings\/2020\/08\/22\/30d457f4-e334-11ea-ade1-28daf1a5e919_story.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">conversations surreptitiously taped<\/a> by her niece Mary L. Trump and published in The Washington Post, Judge Barry said she guessed her brother \u201chasn\u2019t read my immigration opinions.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\"
