{"id":14775,"date":"2025-03-22T21:25:11","date_gmt":"2025-03-22T21:25:11","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/with-new-decree-trump-threatens-lawyers-and-law-firms\/"},"modified":"2025-03-22T21:25:11","modified_gmt":"2025-03-22T21:25:11","slug":"with-new-decree-trump-threatens-lawyers-and-law-firms","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/with-new-decree-trump-threatens-lawyers-and-law-firms\/","title":{"rendered":"With New Decree, Trump Threatens Lawyers and Law Firms"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">President Trump broadened his campaign of retaliation against lawyers he dislikes with a new memorandum that threatens to use government power to punish any law firms that, in his view, unfairly challenge his administration.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The <a class=\"css-yywogo\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/preventing-abuses-of-the-legal-system-and-the-federal-court\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">memorandum<\/a> directs the heads of the Justice and Homeland Security Departments to \u201cseek sanctions against attorneys and law firms who engage in frivolous, unreasonable and vexatious litigation against the United States\u201d or in matters that come before federal agencies.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump issued the order late Friday night, after a tumultuous week for the American legal community in which one of the country\u2019s premier firms, Paul, Weiss, Rifkind, Wharton &amp; Garrison, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/21\/us\/politics\/paul-weiss-trump.html\" title=\"\">struck a deal with the White House<\/a> to spare the company from a punitive decree issued by Mr. Trump the previous week.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Vanita Gupta, who as a civil rights lawyer and a former Justice Department official has both sued the government and defended it in court, said Mr. Trump\u2019s memo \u201cattacks the very foundations of our legal system by threatening and intimidating litigants who aim to hold our government accountable to the law and the Constitution.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The president has long complained that Democratic-leaning lawyers and law firms have pursued what he calls \u201clawfare\u201d in the form of investigations and lawsuits against him and his allies that he claims are motivated by politics. Since being sworn into office he has targeted three firms, but the new memo seems to threaten similar punishment for any lawyer or firm who raises his ire.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump\u2019s memorandum argues the steps are necessary to ensure \u201caccountability\u201d in the legal profession.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">After Mr. Trump issued an order suspending security clearances for Paul Weiss lawyers, and sharply limiting their employees from entering government buildings or getting government jobs, the firm agreed to a series of commitments to get the president to cancel the order.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">As part of the deal, the firm said it would provide $40 million in legal services to causes Mr. Trump has championed, including his task force to combat antisemitism.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Perkins Coie, another firm <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/06\/us\/politics\/trump-perkins-coie.html\" title=\"\">targeted by Mr. Trump<\/a>, chose a different tack \u2014 <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/11\/us\/politics\/perkins-coie-sues-trump.html\" title=\"\">suing him in federal court<\/a> and getting a temporary restraining order against the president.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Trump\u2019s attacks on law firms, and Paul Weiss\u2019s decision to sue for peace rather than fight it out in court, have sent <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/21\/business\/paul-weiss-trump-reaction.html\" title=\"\">shock waves through the legal community<\/a>. The sweeping nature of the president\u2019s latest demand comes as he has also stepped up his public attacks on judges and the very notion that the courts can tell him what to do or not do.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The executive branch \u201cshould neither fear nor punish those who challenge it and should not be the arbiter of what is frivolous \u2014 there are protections in place to address that,\u201d Ms. Gupta said. \u201cThis moment calls for courage and collective action, not capitulation, among lawyers and the legal profession.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It also comes amid a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/us\/politics\/trump-venezuela-deportations-doj-court-order.html\" title=\"\">showdown<\/a> between a federal judge in Washington and the administration over the president\u2019s invocation a week ago of the Alien Enemies Act, which he used to immediately <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/17\/us\/politics\/timeline-trump-deportation-flights-el-salvador.html\" title=\"\">send more than 100 Venezuelan migrants<\/a> he said were gang members to a large prison complex in El Salvador.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Civil rights activists say the deportations violated the law, and that the administration\u2019s <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/17\/us\/politics\/trump-deportation-flights-hearing.html\" title=\"\">refusal to give clear answers<\/a> on its conduct flouts the very premise of the U.S. court system.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One law firm that is suing the administration over its policies said it would not back down in the face of threats from the White House.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The leaders of Keker, Van Nest &amp; Peters, a San Francisco firm that has sued over the Trump administration over its immigration raids, called Mr. Trump\u2019s latest memorandum \u201cinexcusable and despicable.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cOur liberties depend on lawyers\u2019 willingness to represent unpopular people and causes, including in matters adverse to the federal government,\u201d the firm said in a statement. \u201cOur profession owes every client zealous legal representation without fear of retribution, regardless of their political affiliation or ability to pay.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The firm also encouraged other lawyers to join a nationwide effort to submit a \u201cfriend of the court\u201d brief in the Perkins Coie lawsuit against Mr. Trump.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump\u2019s Friday night memo, titled \u201cPreventing Abuses of the Legal System and the Federal Court,\u201d complains that lawyers have long engaged in unethical conduct in opposing him, or opposing deportations. The memo also suggests that the Trump administration will make disciplinary referrals against lawyers who pursue cases without merit \u201cparticularly in cases that implicate national security, homeland security, public safety, or election integrity.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump also used the announcement to attack one particular lawyer by name, Marc Elias.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Elias previously worked at Perkins Coie, and has long represented Democrats. Mr. Trump blames Mr. Elias, among others, for a dossier of unsubstantiated allegations about his links to Russia that was investigated by the F.B.I. in 2016 and 2017.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cPresident Trump\u2019s goal is clear. He wants lawyers and law firms to capitulate and cower until there is no one left to oppose his administration in court,\u201d Mr. Elias said in a written statement. He added, \u201cThere will be no negotiation with this White House about the clients we represent or the lawsuits we bring on their behalf.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\"
