Mr. Musk and his associates have been involved in the effective shutdown of an entire agency, had a hand in thousands of federal workers losing their jobs and helped put millions of dollars in government funding and programs on the chopping block, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/06\/us\/politics\/trump-funding-freeze-states.html\" title=\"\">sowing chaos at home<\/a> and <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/article\/us-foreign-aid-freeze-explained.html\" title=\"\">around the globe<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Often, judges have sided with the scores of lawyers demanding clarity about what Mr. Musk and members of his team are doing, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/13\/us\/politics\/elon-musk-doge-records-questioning.html\" title=\"\">showing willingness to expedite the process<\/a> for groups challenging those actions to demand documents and written answers to questions about the details of the Musk team\u2019s operations.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In a filing on Wednesday, lawyers for the plaintiffs asked a judge to hurry along a case focused on how DOGE, which was first announced by Mr. Trump as a limited private-sector task force shortly after he won the election, came to exercise such dramatic influence over the federal government.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe entire thrust of this motion has been to get a definitive answer to one question,\u201d they <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276598\/gov.uscourts.dcd.276598.29.0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">wrote<\/a>. \u201cWhat is the Department of Government Efficiency?\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cOn the one hand, every public statement made about the leadership of DOGE agrees that Elon Musk is in charge of DOGE,\u201d the lawyers continued. \u201cOn the other hand, every time the government is required to file a sworn declaration on the subject, Musk is a simple adviser with no role in DOGE.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThis case as a whole hinges on the court\u2019s ability to reconcile these two positions,\u201d they added.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judges have so far tended to agree that the Department of Government Efficiency described in court filings bears little resemblance to the operation whose employees have on occasion physically forced their way into agencies as well as, most recently, the nonprofit <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/19\/us\/politics\/peace-institute-lawsuit-doge-trump.html\" title=\"\">Institute of Peace<\/a>. Mr. Musk has bragged about this no-holds barred approach, and Mr. Trump\u2019s allies in Congress and elsewhere have cheered it. Lawyers for the plaintiffs have seized on that dissonance, quoting the president, Republican lawmakers and the White House press secretary, Karoline Leavitt, all crediting Mr. Musk for significant moves.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In the government\u2019s telling, the group is an amorphous collective with no front office or organizational chart, led by <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/25\/us\/politics\/amy-gleason-doge-administrator.html\" title=\"\">Amy Gleason<\/a>, a former health care investment executive, and exists only as <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/21\/us\/politics\/doge-government-efficiency-trump-musk.html\" title=\"\">an evolution of the U.S. Digital Service<\/a>, a tech troubleshooting office created by former President Barack Obama.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">When early lawsuits attempted to stop the group\u2019s operatives, as outsiders, from accessing internal agency databases and looking through sensitive information about private citizens, the unit adjusted by simply having its staff members formally hired.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cEvery member of an agency\u2019s DOGE Team is an employee of the agency or a detailee to the agency,\u201d Ms. Gleason wrote in a <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.277646\/gov.uscourts.dcd.277646.24.2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">filing<\/a> on Wednesday. \u201cThe DOGE Team members \u2014 whether employees of the agency or detailed to the agency \u2014 thus report to the agency heads or their designees, not to me or anyone else at U.S.D.S.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Gleason also reiterated a distinction Mr. Trump had made in his <a class=\"css-yywogo\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/establishing-and-implementing-the-presidents-department-of-government-efficiency\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">executive order<\/a> establishing the office, hinting at a longer shelf life for its efforts. While the order established DOGE as a \u201ctemporary\u201d organization within the former digital service that would dissolve after 18 months, she stated that the office will live on as a permanent fixture within the White House that may continue its efforts after its initial blitz.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cU.S.D.S. is a permanent entity, whereas the U.S. DOGE Service Temporary Organization is, as its name suggests, a temporary entity with an expiration date of July 4, 2026,\u201d she wrote.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Musk, who the White House has said is serving as a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/05\/us\/politics\/elon-musk-special-government-employee-explainer.html\" title=\"\">special government employee<\/a> \u2014 a position with a strict 130-day limit \u2014 indicated in an <a class=\"css-yywogo\" href=\"https:\/\/www.youtube.com\/watch?v=T6DiMIJIvYw\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">interview<\/a> on Fox this month that he would stay involved with the administration for \u201canother year.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The conflicting statements and shifting goals have helped mask the real-world influence of Mr. Musk and some of his top deputies, such as <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/20\/technology\/elon-musk-steve-davis-doge.html?campaign_id=9&amp;emc=edit_nn_20250320&amp;instance_id=150493&amp;nl=the-morning&amp;regi_id=73336075&amp;segment_id=193937&amp;user_id=06df42642a140cd72088440ffa553416\" title=\"\">Steve Davis<\/a>. They have also made it exceedingly difficult for lawyers challenging Mr. Musk to nail down in court who was really behind some of the most destructive actions, such as mass firings or spending freezes.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Katie Miller, a spokeswoman for the operation, did not immediately respond to a request for comment about the apparent contradictions.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In other sworn statements, individuals within various agencies have often taken responsibility for implementing the DOGE team\u2019s stated goals on their own.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.576293\/gov.uscourts.mdd.576293.77.2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">one filed on Wednesday<\/a>, Jeremy Lewin stated that he would be taking over operations at the U.S. Agency for International Development after having helped carry out a review that led to the cancellation of more than 80 percent of the agency\u2019s contracts and planning a mass reduction in force. But he said all of that was done at the behest of Secretary of State Marco Rubio.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cNone of Elon Musk, U.S.D.S., or any U.S.D.S. employee has any formal authority over me,\u201d he stated.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Yet extensive <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/07\/us\/politics\/trump-musk-doge-power.html\" title=\"\">reporting<\/a> about the clash between Mr. Rubio and Mr. Musk over the agency\u2019s future, and Mr. Rubio\u2019s <a class=\"css-yywogo\" href=\"https:\/\/x.com\/marcorubio\/status\/1899021361797816325\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">own words<\/a>, suggested a different series of events.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThank you to DOGE and our hardworking staff who worked very long hours to achieve this overdue and historic reform,\u201d Mr. Rubio wrote on X earlier this month after announcing the cancellation of 5,200 U.S.A.I.D. contracts.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Federal judges have grown impatient with the apparently deliberate atmosphere of confusion and have taken steps to force more meaningful disclosures.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-7\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Noah Peters, a DOGE staffer stationed at the Office of Personnel Management, has been <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.444883\/gov.uscourts.cand.444883.145.0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ordered<\/a> to be deposed in Washington next week about his team\u2019s role in directing agencies to fire their probationary workers.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In another case focused on DOGE\u2019s <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/06\/us\/politics\/doge-african-aid-agency.html\" title=\"\">efforts to shutter the U.S. African Development Foundation<\/a>, Judge Richard J. Leon of the U.S. District Court for the District of Columbia <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.278118\/gov.uscourts.dcd.278118.15.0_2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ordered<\/a> three of Mr. Musk\u2019s lieutenants \u2014 Ethan Shaotran, Jacob Altik and Nate Cavanaugh \u2014 to prepare to give sworn testimony about their involvement in taking over the agency\u2019s office and changing the building\u2019s locks.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">And after a judge <a class=\"css-yywogo\" href=\"https:\/\/ecf.dcd.uscourts.gov\/cgi-bin\/show_public_doc?2025cv0511-18\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ruled<\/a> this week that <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/10\/us\/politics\/musk-doge-foia-lawsuit.html\" title=\"\">DOGE most likely qualifies<\/a> as an entity subject to transparency laws like the Freedom of Information Act, he ordered the office to begin processing documents a group had sued to obtain on an accelerated timetable, noting the office\u2019s \u201cunusual secrecy.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Two senior Democrats seized on that ruling, <a class=\"css-yywogo\" href=\"https:\/\/democrats-judiciary.house.gov\/uploadedfiles\/2025-03-17_raskin_connolly_foia_request.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">filing their own FOIA request<\/a> on Monday, focused on the numerous contradictions between Mr. Musk\u2019s comments about his team and the more arcane explanations the government has provided in court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">To comply with the judge\u2019s order about the earlier request, the government responded on Thursday with <a class=\"css-yywogo\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.277646\/gov.uscourts.dcd.277646.25.0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">an estimate<\/a> of the number of documents it would need to hand over to Citizens for Responsibility and Ethics in Washington, the group behind that lawsuit.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-8\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">By its initial tally, DOGE said it expected to process as many as 105,043 documents, which Judge Christopher R. Cooper said must begin on a rolling basis \u201cas soon as practicable.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Judge Cooper wrote that his decision to act quickly was based in part on concerns that Mr. Musk\u2019s team had been <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/12\/us\/politics\/elon-musk-doge-government-trump.html\" title=\"\">operating outside the normal constraints<\/a> on federal workers, communicating on encrypted platforms such as Signal and concealing its projects and goals from all but a handful of collaborators at each agency.
