The president has threatened to <a class=\"css-yywogo\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114141533823019998\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">\u201clead the charge\u201d<\/a> against the re-election of the rare Republican who dares challenge his agenda, and the party has bent to his will at every turn.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump has <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/18\/us\/trump-executive-order-sec-ftc-fcc.html\" title=\"\">dismantled independent measures<\/a> of checks and balances, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/24\/us\/politics\/trump-fires-inspectors-general.html\" title=\"\">fired inspectors general<\/a> and installed <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/17\/us\/politics\/bongino-patel-fbi-trump.html\" title=\"\">loyalists<\/a> at the Justice Department willing to carry out his <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/03\/07\/us\/politics\/trump-2024-president.html\" title=\"\">campaign of retribution<\/a>. He has targeted <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/podcasts\/the-daily\/trump-big-law-firms-perkins-coie.html\" title=\"\">private law firms<\/a> with connections to those he views as political enemies and cowed previously skeptical or hostile business leaders into pledging public support, even as he has imprinted his \u201cMAGA\u201d stamp on the <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/23\/business\/trump-dei-corporate-reaction.html\" title=\"\">private sector by trying to dictate hiring practices<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">His efforts to reshape institutions in his image have not been limited to the government and policy. Mr. Trump has tried to spread his influence through the arts, as well, by making himself <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/arts\/music\/trump-kennedy-center.html\" title=\"\">chairman of the John F. Kennedy Center for the Performing Arts in Washington<\/a>.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">But Mr. Trump\u2019s latest target \u2014 the judiciary \u2014 has been described by constitutional scholars and historians as perhaps <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/19\/us\/politics\/trump-deportations-constitutional-crisis-impeachment.html\" title=\"\">the most alarming power play to date<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Trump administration brushed off an order by James E. Boasberg of the Federal District Court in Washington, who sought to pause the deportation of a group of migrants, many of whom received little to no due process. Administration officials said that most of the migrants were from Venezuela and that all of them were affiliated with gangs. But officials <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/us\/trump-deportations-venezuela-gang.html\" title=\"\">did not release the migrants\u2019 names or evidence<\/a> of their alleged crimes.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump has called for Judge Boasberg to be impeached, arguing on social media that \u201cif a President doesn\u2019t have the right to throw murderers, and other criminals, out of our Country because a Radical Left Lunatic Judge wants to assume the role of President, then our Country is in very big trouble, and destined to fail!\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The White House did not respond late Wednesday to a request for comment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump has never been consistent in his attacks on the judicial system generally and on judges in particular. Last week during a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/14\/us\/politics\/trump-speech-justice-department.html\" title=\"\">speech at the Department of Justice<\/a>, he suggested that criticism of Judge Aileen M. Cannon, the Florida jurist who dismissed the classified documents case against him last summer, may not be legal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But he has applied the same logic of fairness to court cases that he has to presidential elections: They\u2019re fair if he wins but not if he loses.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In one way or another, Mr. Trump has been a party to lawsuits going back to the 1970s, as a private developer and later as a candidate and president. When he has lost cases, he has tended to attack the judges in question as partisan activists or worse.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">When he wins, he praises the judge in question.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump\u2019s allies say he is using his power to enact an agenda that he promised during the campaign, and that he is executing Article II of the Constitution, which sets out the powers of the president.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cPresident Trump\u2019s doing the unthinkable in Washington \u2014 he\u2019s doing what he told Americans he was going to do, and he\u2019s doing it fast,\u201d said Mike Davis, founder of the Article III Project, a conservative advocacy group.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Still, a few traditionally right-leaning voices have expressed concern.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Wall Street Journal editorial page, for example, said Mr. Trump had campaigned on deporting gang members, \u201cbut it\u2019s still troubling to see U.S. officials appear to disdain the law in the name of upholding it.\u201d The New York Post ran a headline on its opinion page that said: \u201cTrump, don\u2019t heed the dangerous urge to attack the rule of law.&#8221;<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Both papers are part of the media empire of Rupert Murdoch, Mr. Trump\u2019s on-again, off-again ally.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The judiciary, created to provide checks and balances to both the executive and legislative branches, has only rarely faced such open defiance, experts say. Some of Mr. Trump\u2019s top lieutenants <a class=\"css-yywogo\" href=\"https:\/\/x.com\/cspan\/status\/1901723856152285503\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">have suggested he has a right to defy court orders<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cJudges aren\u2019t allowed to control the executive\u2019s legitimate power,\u201d Vice President JD Vance declared last month.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI don\u2019t care what the judges think \u2014 I don\u2019t care what the left thinks,\u201d Mr. Trump\u2019s border czar, Tom Homan, said this week during an appearance on \u201cFox &amp; Friends.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump\u2019s allies often point out that he is doing what he said he would do during his campaign, when his policy platform, Agenda 47, laid out an agenda of maximalist presidential power. He and his advisers believe he was stymied in his first term through investigations and a resistant federal bureaucracy.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-7\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Some of his closest allies, including Russell T. Vought, Mr. Trump\u2019s current and former director of the Office of Management and Budget, spent years preparing for the possibility of a second Trump presidency, searching for pockets of independence in the executive branch that could be seized.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Vought and other Trump allies have advocated a doctrine called the unitary executive, a legal theory that all power in the executive branch flows from the president.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe great challenge confronting a conservative president is the existential need for aggressive use of the vast powers of the executive branch to return power \u2014 including power currently held by the executive branch \u2014 to the American people,\u201d <a class=\"css-yywogo\" href=\"https:\/\/static.project2025.org\/2025_MandateForLeadership_CHAPTER-02.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Mr. Vought wrote<\/a> in the conservative blueprint for a Republican presidential transition, Project 2025. He added that it would take \u201cboldness to bend or break the bureaucracy to the presidential will.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One of the dozens of executive orders that Mr. Trump signed since taking office, which called for <a class=\"css-yywogo\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/ensuring-accountability-for-all-agencies\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">taking over \u201cindependent regulatory agencies,\u201d<\/a> asserted similar goals. \u201cFor the federal government to be truly accountable to the American people, officials who wield vast executive power must be supervised and controlled by the people\u2019s elected president,\u201d the executive order states.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-8\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Kenneth T. Cuccinelli II, a former acting deputy Homeland Security secretary in the first Trump administration and a contributor to Project 2025, said those who criticize Mr. Trump\u2019s use of executive power \u201care doing so primarily to weaken the presidency and this president in particular under the guise of \u2018conventional wisdom\u2019 that has no constitutional foundation.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-9\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Critics of how Mr. Trump is approaching his executive authority say the unitary executive theory does not mean that everything the president does is legal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ruth Ben-Ghiat,<strong class=\"css-8qgvsz ebyp5n10\"> <\/strong>a historian at New York University who studies fascism and authoritarianism, singled out what she said were some of Mr. Trump\u2019s most troubling behaviors: the expansion of executive power, the politicization of the other branches of government, the dismantling of an oversight and accountability structure, and the targeting of those who seek to hold the president and his allies accountable.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe ultimate beneficiary of the acts that we\u2019re seeing happen, whether it\u2019s with the judiciary or other agencies, is Trump himself, because it\u2019s an expansion of his personal power,\u201d she said. \u201cThe scale and the speed of what\u2019s going on is terrifying.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><script async
