{"id":14171,"date":"2025-03-19T22:54:43","date_gmt":"2025-03-19T22:54:43","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/u-s-institute-of-peace-sues-doge-and-trump-over-lawless-assault\/"},"modified":"2025-03-19T22:54:43","modified_gmt":"2025-03-19T22:54:43","slug":"u-s-institute-of-peace-sues-doge-and-trump-over-lawless-assault","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/u-s-institute-of-peace-sues-doge-and-trump-over-lawless-assault\/","title":{"rendered":"U.S. Institute of Peace Sues DOGE and Trump Over \u2018Lawless Assault\u2019"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">A federal judge on Wednesday declined to temporarily block the Trump administration and Elon Musk\u2019s government cost-cutting team from seizing control of an independent peace-promoting institute, which has accused the administration of mounting a \u201clawless assault\u201d against it.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The organization, the U.S. Institute of Peace, sued President Trump and others on Tuesday, asking the Federal District Court for the District of Columbia to intervene against what it said was an illegal \u201ctakeover by force.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a hearing on Wednesday, Judge Beryl Howell said she was \u201cvery offended\u201d by how Mr. Musk\u2019s team, the Department of Government Efficiency, had operated at the institute and how it \u201ctreated American citizens trying to do their jobs.\u201d Judge Howell expressed disbelief as she recounted the administration\u2019s use of multiple law enforcement agencies in its bid to gain access to the institute\u2019s headquarters \u201cwith the force of guns.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Judge Howell said she based her decision on the limits of the law, and that she was concerned the institute would not succeed on the legal merits of the case because the board members had filed suit in their official capacity. The White House dismissed them from those roles on Friday.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The move to gut the board, as well as the appointment of a new acting president, incited a standoff with the institute. It reached a peak on Monday when police officers helped <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/17\/us\/politics\/doge-musk-institute-of-peace.html\" title=\"\">evict staff members from the institute\u2019s headquarters<\/a> in Washington and allowed Mr. Musk\u2019s team and Trump administration officials to enter. <\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump signed an executive order last month directing the institute to reduce its operations to the \u201cstatutory minimum.\u201d But institute officials have said that Mr. Trump and Mr. Musk do not have the authority to dismantle the organization\u2019s operations because it is a congressionally chartered nonprofit that is not part of the executive branch.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the lawsuit, the institute said that the executive order incorrectly labeled the organization as a \u201cgovernment entity.\u201d The institute accused members of Mr. Musk\u2019s team and others of having \u201cplundered\u201d the agency\u2019s office \u201cin an effort to access and gain control of the Institute\u2019s infrastructure, including sensitive computer systems.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It also accused them of destroying documents, which a Justice Department lawyer, Brian P. Hudak, denied in court on Wednesday.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The Justice Department pushed back on claims the institute was not a government entity, and argued that the president did indeed have the power to remove members of its board even if the manner of firing them did not follow a process laid out in law. In response to the lawsuit, lawyers for the U.S. attorney\u2019s office in the District of Columbia argued that the institute could not file such a complaint because it had not been authorized by its new acting president, Kenneth Jackson, a State Department official.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Judge Howell pried at that question, asking Andrew Goldfarb, a lawyer who filed the complaint on behalf of the institute, \u201cWho\u2019s giving you as counsel the right to represent the U.S. Institute of Peace?\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a briefing on Wednesday, the White House press secretary, Karoline Leavitt, called the institute staff and the former acting president \u201crogue bureaucrats,\u201d and<span class=\"css-8l6xbc evw5hdy0\">  <\/span>said that the White House learned they were refusing to accept their ouster only after being informed by Mr. Musk\u2019s team and the State Department.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThis is what DOGE and this administration is facing: It\u2019s a resistance from bureaucrats who don\u2019t want to see change in this city,\u201d Ms. Leavitt said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The suit accuses Mr. Trump of not abiding by the 1984 legislation that created the institute as an independent nonprofit when the White House fired all but three members of its board on Friday. The remaining three board members \u2014 Secretary of State Marco Rubio, Defense Secretary Pete Hegseth and Peter A. Garvin, the president of National Defense University \u2014 then replaced the institute\u2019s acting president, George Moose, with Mr. Jackson.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Mr. Rubio, Mr. Hegseth and Mr. Garvin are also named as defendants, along with Mr. Jackson, who was involved in <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/us\/politics\/elon-musk-usaid-doge-unconstitutional.html\" title=\"\">the dismantling<\/a> of the U.S. Agency for International Development.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In Wednesday\u2019s hearing, Judge Howell said she had studied some of the numerous other challenges to Mr. Trump\u2019s attempts to wield the executive branch\u2019s <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/12\/us\/politics\/trump-policy-executive-orders-rulings.html\" title=\"\">dominion over the government<\/a> and gut agencies like <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/18\/us\/politics\/elon-musk-usaid-doge-unconstitutional.html\" title=\"\">U.S.A.I.D<\/a>. Some of those challenges have succeeded in curtailing Mr. Trump\u2019s reach.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She suggested the dispute between the administration and the institute should have been resolved in court, without the involvement of law enforcement.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The Metropolitan Police Department said that its officers were called to the institute on Monday afternoon by the U.S. attorney\u2019s office in Washington, an arm of the Justice Department, over reports that there were \u201cunauthorized individuals inside of the building that were refusing to leave.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The police department said documents were provided showing that Mr. Jackson \u201cwas lawfully in charge of the facility\u201d and officers left the scene once all those inside the building had left.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cAll that targeting, probably terrorizing of employees and staff at the institute when there are so many other lawful ways to accomplish the goals?\u201d Judge Howell said on Wednesday. \u201cWhy? Just because DOGE was in a rush?\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Hudak, the lawyer for the Justice Department, argued law enforcement had to get involved because the institute\u2019s staff had behaved like disgruntled employees who, despite being fired, locked themselves in the office and refused to leave.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The institute\u2019s office is on land owned by the Navy. But the organization said that its headquarters, a white glass-roofed building designed with five levels of window walls as a <a class=\"css-yywogo\" href=\"https:\/\/www.safdiearchitects.com\/projects\/united-states-institute-of-peace\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">symbol of transparency<\/a>, was funded by private donors.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><script async
