Mr. Trump is already undercutting the separation of powers at the heart of the constitutional system, they say, and the right question now is how it will transform the nation.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cIf anyone is being detained or removed based on the administration\u2019s assertion that it can do so without judicial review or due process,\u201d said <a class=\"css-yywogo\" href=\"https:\/\/www.law.columbia.edu\/faculty\/jamal-greene\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Jamal Greene<\/a>, a law professor at Columbia, \u201cthe president is asserting dictatorial power and \u2018constitutional crisis\u2019 doesn\u2019t capture the gravity of the situation.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump raised the stakes on Tuesday by calling for the impeachment of the judge who issued the order, James E. Boasberg of the Federal District Court in Washington, describing him <a class=\"css-yywogo\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/114183576937425149\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">on social media<\/a> as a \u201cRadical Left Lunatic.\u201d <\/p>\n<p class=\"css-at9mc1 evys1bk0\">The president did so even as the issues at hand<span class=\"css-8l6xbc evw5hdy0\">  <\/span>have just started to be tested in a case that seems headed to the Supreme Court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A few hours later, Chief Justice John G. Roberts Jr. issued an unusual statement, seemingly prompted by such exhortations, and perhaps by the filing of articles of impeachment against Judge Boasberg by a Republican member of the House.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cFor more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision,\u201d the chief justice said. \u201cThe normal appellate review process exists for that purpose.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In an appearance on Fox News, Mr. Trump noted that the chief justice had not mentioned him by name. Still, the dueling statements, coming on top of the lower court showdown over the deportations, fueled a sense that the clash long predicted between Mr. Trump and the federal judiciary had been fully engaged.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\"><a class=\"css-yywogo\" href=\"https:\/\/www.law.uchicago.edu\/faculty\/huq\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Aziz Huq<\/a>, a law professor at the University of Chicago, said that assessing whether a given development is a constitutional crisis is \u201cgenerally unhelpful.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI think it\u2019s more useful to say that this is moving us into a completely different kind of constitutional order, one that\u2019s no longer characterized by laws that bind officials and that can be enforced,\u201d Professor Huq said. \u201cThe law, in other words, becomes a tool to harm enemies, but not to bind those who govern. That is a quite different constitutional order from the one that we\u2019ve had for a long time.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The contested directive was issued at a hearing on Saturday by<span class=\"css-8l6xbc evw5hdy0\">  <\/span>Judge<span class=\"css-8l6xbc evw5hdy0\">  <\/span>Boasberg. It sought to pause the removal of more than 200 migrants said to be members of a Venezuelan gang to El Salvador, after Mr. Trump invoked the wartime authorities of the Alien Enemies Act of 1798 to order them deported. The Trump administration ignored the order, issued from the bench, to return planes in the air to the United States.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cHowever that\u2019s accomplished, whether turning around a plane or not embarking anyone on the plane or those people covered by this on the plane, I leave to you,\u201d Judge Boasberg told a government lawyer. \u201cBut this is something that you need to make sure is complied with immediately.\u201d <\/p>\n<p class=\"css-at9mc1 evys1bk0\">The planes kept flying. <\/p>\n<p class=\"css-at9mc1 evys1bk0\">At a hearing on Monday, another government lawyer said the administration was not bound by the oral order, however specific, but only by a docket entry summarizing it in general terms, without reference to the planes but starting with the phrase \u201cas discussed in today\u2019s hearing.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The administration may well win before the justices on the underlying issues in the case, which involve difficult constitutional questions about presidential power over national security and immigration. But those issues are separate from the current one: Must the president obey court orders he contends are wrong while he appeals them?<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Karoline Leavitt, the White House press secretary, defended the administration\u2019s conduct <a class=\"css-yywogo\" href=\"https:\/\/x.com\/PressSec\/status\/1901584664906682833\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">on social media.<\/a><\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe administration did not \u2018refuse to comply\u2019 with a court order,\u201d she wrote, adding that \u201cthe written order and the administration\u2019s actions do not conflict.\u201d She did not address whether the administration had complied with the judge\u2019s oral directive.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Ms. Leavitt added that Judge Boasberg had overstepped his authority. \u201cA single judge in a single city cannot direct the movements of an aircraft carrying foreign alien terrorists who were physically expelled from U.S. soil,\u201d she said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">All of that may be so, but Judge Boasberg\u2019s oral order was not hard to understand.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">If there was authentic doubt about what Judge Boasberg meant, legal experts said, the better practice would have been to seek clarification or to appeal.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt should go without saying that, at the Justice Department, the rule of the road is that, in the absence of a true emergency, the government complies with judicial orders, even if the orders are patently lawless, until it can get them reversed \u2014 either by the issuing judge or a higher court,\u201d Andrew C. McCarthy, a former federal prosecutor, wrote in the right-leaning <a class=\"css-yywogo\" href=\"https:\/\/www.nationalreview.com\/corner\/trump-admin-defying-judge-over-hearing-about-its-earlier-defiance\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">National Review<\/a>. \u201cIt\u2019s all right to complain bitterly about court orders, but they are not to be ignored, much less knowingly flouted.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The administration has chosen a different path, Mr. McCarthy argued. \u201cThe government seems to be intentionally instigating fireworks,\u201d he wrote. \u201cThat seems like a terrible legal strategy, but it may be winning politics \u2026 at least for a little while,\u201d he added, using ellipses for emphasis.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In 1967, in a case involving the Rev. Dr. Martin Luther King Jr., <a class=\"css-yywogo\" href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/388\/307\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">the Supreme Court ruled<\/a> that he and several colleagues were not entitled to test the constitutionality of a legally questionable court order barring them from demonstrating by marching in Birmingham, Ala.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The right approach, Justice Potter Stewart wrote for the majority, was to ask the courts to have the injunction clarified, modified or dissolved. \u201cIn the fair administration of justice,\u201d he wrote, \u201cno man can be judge in his own case, however exalted his station, however righteous his motives.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-7\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The lawyer representing the government at Monday\u2019s hearing had another argument: that Judge Boasberg was powerless to order the planes to turn around once they had left American airspace. That assertion was also labeled unconvincing by many legal experts.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe administration has this completely wrong,\u201d <a class=\"css-yywogo\" href=\"https:\/\/tlblog.org\/hannah-l-buxbaum\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Hannah L. Buxbaum<\/a>, a law professor at Indiana University, wrote in <a class=\"css-yywogo\" href=\"https:\/\/tlblog.org\/district-courts-order-in-the-venezuelan-deportees-case-was-not-extraterritorial\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a blog post<\/a>. \u201cThe judge is ordering the administration to take action inside the United States \u2014 that is, to instruct the planes to turn around. That instruction will in turn cause something to happen elsewhere (the pilots will change course), but that doesn\u2019t make the order impermissibly extraterritorial.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It is routine, she added, for judges to order people in the United States to cause things to happen abroad, like turn over evidence or assets.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-8\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Professor Huq acknowledged that there was \u201coften some uncertainty about exactly what compliance with a court order against an agency requires.\u201d <\/p>\n<p class=\"css-at9mc1 evys1bk0\">But there are limits, he added. \u201cThe Trump administration is pushing that uncertainty to a breaking point,\u201d he said, \u201cjust as it has pushed the idea that the executive has to comply with statutes to a breaking point.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Pamela S. Karlan, a law professor at Stanford, said the development was emblematic of how the Trump administration had acted in its first months in office.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe problem with this administration is not just acute episodes, like what\u2019s happening with Judge Boasberg and the Venezuelan deportation,\u201d Professor Karlan said. \u201cIt\u2019s a chronic disrespect for constitutional norms and for the other branches of government.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Asked whether the nation had reached a tipping point plunging it into a constitutional crisis, Professor Karlan questioned the premise. \u201c\u2018Tipping point\u2019 suggests a world in which things are fine until suddenly they\u2019re not,\u201d she said. \u201cBut we\u2019re past the first point already.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-9\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The administration\u2019s maximalist view of presidential power, amplified by its lawyers, could spiral as Mr. Trump acts without restraint, Professor Greene said.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cAn executive branch that operates without internal legal constraint but solely on the basis of its ability to get away with things, whether politically or legally, is itself sufficient to produce a constitutional crisis,\u201d he said. \u201cA president who does whatever he wants until someone stops him is a constitutional crisis whether or not he is sometimes stopped.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Trump has not been shy about claiming power. \u201cHe who saves his Country does not violate any Law,\u201d he <a class=\"css-yywogo\" href=\"https:\/\/x.com\/realDonaldTrump\/status\/1890831570535055759?lang=en\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">wrote on social media<\/a> last month.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The administration sometimes seems to be speaking to two audiences at once. In court, it says it is complying with the letter if not the spirit of judicial orders. In public communications, the administration and its allies adopt the language of defiance, notably by attacking judges.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But in other settings, Mr. Trump has defended judges from what he called illegal criticism. Last week, <a class=\"css-yywogo\" href=\"https:\/\/rollcall.com\/factbase\/trump\/transcript\/donald-trump-speech-department-of-justice-march-14-2025\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">in remarks at the Justice Department<\/a>, he said that \u201cit has to be illegal, influencing judges.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-10\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">He was mostly defending Judge Aileen M. Cannon of the Southern District of Florida, who had dismissed one of the criminal cases against him. But he spared a thought for the Supreme Court.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThey don\u2019t want bad publicity, and it\u2019s truly interference in my opinion,\u201d he said of criticism of the court. \u201cAnd it should be illegal, and it probably is illegal in some form. There\u2019s no difference than speaking to a judge or shouting to a judge or doing whatever you have to do in a courthouse.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion
