Those states include California, Connecticut, Minnesota, New Jersey and Rhode Island.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Those Democratic-led states have sued major fossil fuel companies for allegedly deceiving the public for decades about the effects of their greenhouse gas emissions. The cases include a 2023 lawsuit <a class=\"css-yywogo\" href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-announces-lawsuit-against-oil-and-gas-companies\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">filed by California\u2019s attorney general<\/a> against five of the world\u2019s largest oil and gas companies, including BP and Exxon Mobil, and the American Petroleum Institute, a lobbying group that represents fossil fuel interests.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThis was never anything more than an attempt to run interference, help the defendants in our cases avoid accountability, and play politics with the Constitution,\u201d said Minnesota Attorney General Keith Ellison in a statement. He filed <a class=\"css-yywogo\" href=\"https:\/\/climatecasechart.com\/case\/state-v-american-petroleum-institute\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">his state\u2019s deception suit<\/a> in 2020.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Now, with the Supreme Court\u2019s official rejection, those cases can proceed.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">There are dozens of pending cases designed to force fossil fuel companies to pay monetary damages related to climate change, according to Michael Gerrard, the director of the Sabin Center for Climate Change Law at Columbia University.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In January, the Supreme Court signaled it might not agree with the effort by Republican attorneys general to block lawsuits like these, when the justices <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/13\/climate\/supreme-court-hawaii-climate-lawsuit.html\" title=\"\">denied an oil-industry request to review a Hawai\u2019i Supreme Court decision<\/a> that allows the state\u2019s climate deception lawsuit to go to trial.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Supporters of the effort have argued that the state cases are unconstitutional and could affect interstate commerce. \u201cEach individual state cannot set its own priorities to which commercial activities it will encourage or discourage,\u201d said Donald Kochan, a law professor for the Antonin Scalia Law School at George Mason University.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">For example, Mr. Kochan said, if one state wanted to encourage fossil-fuel production, its ability to do so could be affected if oil and gas prices rose because of the liability risk from the other states\u2019 lawsuits.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Legal experts have called the Republican-led effort in the Supreme Court unusual because it took aim at state claims before they had been addressed by state courts. Mr. Gerrard said in an email that, because of this, it would have been \u201csurprising\u201d for the nation\u2019s highest court to hear the arguments since it could open a Pandora\u2019s box for requests to prematurely end other kinds of litigation.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe Supreme Court is saying it\u2019s not going to interfere,\u201d he said, \u201cat least for now.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The lawsuits are separate from, but related to, a group of new climate \u201csuperfund\u201d laws that also aim to require polluters to account for the effect of their greenhouse gas emissions on their city, county, or state. They are called superfund laws because they are loosely modeled on the longstanding Superfund program to clean up toxic waste sites.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The first climate superfund law went into effect <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/05\/31\/climate\/vermont-law-fossil-fuel-climate-damage.html\" title=\"\">in Vermont last summer<\/a>, followed by <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/12\/26\/nyregion\/hochul-climate-change-superfund-law.html\" title=\"\">New York\u2019s version in December<\/a>. Both have faced legal challenges. A coalition of 22 states, led by West Virginia, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/06\/nyregion\/climate-change-superfund-act-lawsuit.html\" title=\"\">sued New York
