United States<\/a>, the July decision that gave him substantial immunity from prosecution. That citation was the first of nine. <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A790\/343108\/20250219093542259_24A790%20Reply.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">A second brief<\/a>, filed days later, cited the decision eight more times.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It was at first blush a poor fit. The issue in the new case, the first arising from a challenge to the administration\u2019s blitz of executive actions, was whether Mr. Trump could fire the leader of an independent agency without cause. It had nothing to do with prosecutions or immunity, presidential or otherwise.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But Mr. Trump\u2019s lawyers had good reason to rely on the decision. Its legacy, scholars say, will not be its three-part test for determining whether prosecutions of former presidents can proceed. It will be how the decision amplified presidential power just in time for a new administration determined to test its limits.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The decision, ostensibly about the important but limited question of immunity, contained \u201csome of the most far-reaching pronouncements about presidential power in the court\u2019s history,\u201d Jack L. Goldsmith, a law professor at Harvard and a former Justice Department official in the administration of President George W. Bush, wrote in \u201cThe Presidency After Trump v. United States,\u201d <a class=\"css-yywogo\" href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=5162059\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">a draft article<\/a> posted last week that is to be published in The Supreme Court Review.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The opinion, he added, \u201camounted to perhaps the most consequential disquisition ever on the law of the presidency.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Chief Justice John G. Roberts Jr., writing for the majority, made the case for a vigorous and energetic president whose core responsibilities cannot be constrained by Congress and the courts. \u201cUnlike anyone else,\u201d he wrote, \u201cthe president is a branch of government, and the Constitution vests in him sweeping powers and duties.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The recent briefs were filed in a case about whether Mr. Trump could fire Hampton Dellinger, who led a government watchdog agency, without complying with a statute that required the president to give a good reason.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. Dellinger\u2019s case is over. The Supreme Court <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/030625zr_1bn2.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">dismissed it as moot<\/a> on Thursday after he gave up his fight. The court had issued only <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a790_6i79.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">an interim ruling<\/a> in the meantime, one that did not grapple with implications of the immunity decision.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But the outsize role that the decision played in the government\u2019s briefs in the Dellinger case will doubtless recur in new cases that challenge Mr. Trump\u2019s executive orders claiming the power to fire all sorts of federal workers, restructure the government and freeze funds appropriated by Congress.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">As scholars digest and consider the immunity decision, some of them have started to conclude that its most important elements were largely overlooked when it landed last summer, as the presidential campaign was nearing its final stages.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Most people focused on the ruling\u2019s practical impact, which was to delay beyond Election Day Mr. Trump\u2019s trial on charges that he tried to overturn the 2020 election. That meant the public could not consider the evidence gathered by Jack Smith, the special counsel overseeing the prosecution, in time to take account of it at the polls. (Mr. Smith <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/11\/25\/us\/politics\/jack-smith-trump-election-documents-charges.html\" title=\"\">dropped the case<\/a> after Mr. Trump reclaimed the presidency.)<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Others focused on the three-part test announced in the majority opinion for deciding whether former presidents accused of committing crimes while in office may be prosecuted: absolute immunity for core duties, at least presumptive immunity for all other official conduct and no immunity for private acts.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That discussion was mostly cryptic and unsatisfying. If there was clarity, it was in the chief justice\u2019s discussion of the first category \u2014 absolute immunity. He wrote that the president had some exclusive responsibilities that could not be overridden by Congress.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">One was the freedom to fire many appointees for any reason at all. The other was to control the Justice Department\u2019s investigations and prosecutions.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Professor Goldsmith wrote that \u201cthese were the most far-reaching rulings in the decision.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Christine Kexel Chabot, a law professor at Marquette University, questioned the ruling\u2019s commitment to originalism, the mode of constitutional interpretation often favored by conservatives that seeks to determine the document\u2019s original public meaning.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe court\u2019s approach creates a far more powerful presidency than was ever recognized by the founding generation,\u201d she wrote in <a class=\"css-yywogo\" href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=5095985\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">an article<\/a> to be published in The University of Michigan Journal of Law Reform.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In all, Professor Goldsmith concluded, \u201cthe court has traditionally proceeded cautiously and carefully when marking out exclusive presidential power because the president is known to run hard with such power.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cBut it did the opposite in Trump,\u201d he wrote, referring to the decision. \u201cIt issued an incautious and uncareful ruling on broadly applicable exclusive presidential powers that presidents will use to their enormous new advantage vis-\u00e0-vis the other two branches, especially Congress, until the court, in more considered reflection, decides that it ruled imprudently and went too far.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\"
