While the agency has long said that it did not think evidence of Red 3 causing cancer applied to humans, officials said their hand was forced by a law requiring the agency to pull additives that are cancerous in animals.<\/p>\n<p>&#8220;The Delaney Clause is clear; the FDA cannot authorize a food additive or color additive if it has been found to cause cancer in humans or animals. Evidence shows cancer in laboratory male rats exposed to high levels of FD&amp;C Red No. 3,&#8221; said Jim Jones, the FDA&#8217;s deputy commissioner for human foods, referring to the law.\u00a0<\/p>\n<p>A post on <a href=\"https:\/\/www.fda.gov\/food\/hfp-constituent-updates\/fda-revoke-authorization-use-red-no-3-food-and-ingested-drugs\" target=\"_blank\" rel=\"nofollow noopener\">the FDA&#8217;s website<\/a> states that Red 3&#8217;s use in food or drugs &#8220;puts people at risk are not supported by the available scientific information.&#8221;<\/p>\n<p>Hundreds of food brands, including products ranging from candy and fruit cups to snack chips and tomato sauce, have contained Red 3 at some point, according to databases maintained by the\u00a0<a href=\"https:\/\/fdc.nal.usda.gov\/food-search\" target=\"_blank\" rel=\"nofollow noopener\">U.S. Department of Agriculture<\/a>\u00a0and the nonprofit\u00a0<a href=\"https:\/\/www.ewg.org\/foodscores\/products\/\" target=\"_blank\" rel=\"nofollow noopener\">Environmental Working Group<\/a>, as well as nutrition labels disclosed by food companies.<\/p>\n<p>Wednesday&#8217;s decision stems from a <a href=\"https:\/\/www.hfpappexternal.fda.gov\/scripts\/fdcc\/index.cfm?set=FAP-CAP&amp;id=CAP_3C0323\" target=\"_blank\" rel=\"nofollow noopener\">petition<\/a> filed by the Center for Science in the Public Interest and a number of other groups in 2022, calling for the additive to be pulled from the market. Food brands will have until January 2027 to stop using the dye.\u00a0<\/p>\n<p>The group has also championed a move by California <a href=\"https:\/\/www.cspinet.org\/press-release\/california-bans-red-3-and-other-unnecessary-food-additives-outpacing-fda\" target=\"_blank\" rel=\"nofollow noopener\">in 2023<\/a> to ban the food dye, which is already banned from use in cosmetics.\u00a0<\/p>\n<p>&#8220;The primary purpose of food dyes is to make candy, drinks, and other processed foods more attractive. When the function is purely aesthetic, why accept any cancer risk?&#8221; said Dr. Peter Lurie, president of the Center for Science in the Public Interest, in a <a href=\"https:\/\/www.cspinet.org\/press-release\/fda-moves-eliminate-carcinogenic-red-3-foods\" target=\"_blank\" rel=\"nofollow noopener\">statement<\/a>.\u00a0<\/p>\n<p>While the group has highlighted Red 3&#8217;s link to cancer in pushes to ban the additive, it is concerned over a different health concern \u2014 the possibility that artificial food dyes could be causing hyperactivity in children \u2014 that has fueled opposition to this and another dye <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/what-is-red-dye-40-effects\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">called Red 40<\/a><\/span> used in many U.S. food products.<\/p>\n<p>An influential <a href=\"https:\/\/oehha.ca.gov\/media\/downloads\/risk-assessment\/report\/healthefftsassess041621.pdf\" target=\"_blank\" rel=\"nofollow noopener\">review<\/a> by California&#8221;s Environmental Protection Agency of studies on synthetic food dyes, including Red 3, concluded in 2021 that colorants &#8220;can impact neurobehavior in some children.&#8221;<\/p>\n<h2>What foods and drinks contain Red 3?<\/h2>\n<p>Red 3 has been authorized for use in at least some foods by countries around the world, <a href=\"https:\/\/iacmcolor.org\/color-profile\/erythrosine-fdc-red-no-3\/\" target=\"_blank\" rel=\"nofollow noopener\">according to<\/a> the International Association of Color Manufacturers, under other names like erythrosine or E 127. In Europe, Red 3 is only <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A02008R1333-20231029\" target=\"_blank\" rel=\"nofollow noopener\">permitted for use<\/a> in cocktail cherries and candied cherries.<\/p>\n<p>In the U.S., Red 3 is used in some candies, including Jelly Belly&#8217;s <a href=\"https:\/\/www.jellybelly.com\/candy-corn-3-oz-grab-go-bag\/p\/98464\" target=\"_blank\" rel=\"nofollow noopener\">Candy Corn<\/a>, Tootsie&#8217;s <a href=\"https:\/\/tootsie.com\/qr\/059642903309\/\" target=\"_blank\" rel=\"nofollow noopener\">Dubble Bubble ball gum<\/a> and Ring Pop&#8217;s <a href=\"https:\/\/www.ringpopcandy.com\/products\/ring-pop\/\" target=\"_blank\" rel=\"nofollow noopener\">strawberry and berry blast flavors<\/a>. Other foods also use Red 3, like Del Monte <a href=\"https:\/\/www.delmonte.com\/products\/snacks\/fruit-cups-snacks\/cherry-mixed-fruit-fruit-cupr-snacks\" target=\"_blank\" rel=\"nofollow noopener\">cherry mixed fruit cups<\/a>, MorningStar Farms <a href=\"https:\/\/smartlabel.kelloggs.com\/Product\/Index\/00028989971951#nutrition\" target=\"_blank\" rel=\"nofollow noopener\">vegetarian Bacon Strips<\/a> and Pillsbury&#8217;s <a href=\"https:\/\/www.pillsbury.com\/products\/cookies\/ready-to-bake-cookies\/birthday-cake\" target=\"_blank\" rel=\"nofollow noopener\">birthday cake cookie dough<\/a>.<\/p>\n<p>Several drinks rely on Red 3 as well, among them Ensure&#8217;s <a href=\"https:\/\/www.ensure.com\/nutrition-products\/ensure-max-protein-shake\/creamy-peach?bvstate=pg:2\/ct:r\" target=\"_blank\" rel=\"nofollow noopener\">creamy peach nutrition shake<\/a> and Nesquik&#8217;s <a href=\"https:\/\/www.goodnes.com\/nesquik\/products\/strawberry-low-fat-milk-14-fl-oz-bottle\/\" target=\"_blank\" rel=\"nofollow noopener\">strawberry lowfat milk<\/a>.<\/p>\n<p>In a <a href=\"https:\/\/candyusa.com\/news\/nca-statement-on-red-dye-3\/\" target=\"_blank\" rel=\"nofollow noopener\">statement<\/a> Wednesday, the candy industry pledged to comply with the FDA&#8217;s guidance and safety standards. Industry groups have been calling on the agency to step up its regulation of food additives, citing concerns that a vacuum left by FDA inaction could lead to a frustrating patchwork of state laws for national food brands.<\/p>\n<p>&#8220;Our consumers and everyone in the food industry want and expect a strong FDA, and a consistent, science-based national regulatory framework. We have been saying for years that FDA is the rightful national regulatory decision maker and leader in food safety,&#8221; said the National Confections Association&#8217;s statement.<\/p>\n<p><span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-robert-f-kennedy-make-america-healthy-again\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">Robert F. Kennedy Jr.<\/a><\/span>, President-elect Donald Trump&#8217;s pick to head the federal department that will oversee the FDA, has been critical of the agency for not moving to curb use of certain food additives.\u00a0<\/p>\n<p>Kennedy and his allies have\u00a0<span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/rfk-jr-weighing-fda-crackdown-on-food-additives-under-trump\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">also called for<\/a><\/span>\u00a0tightening the FDA&#8217;s approach to regulating food additives, which critics have derided as a &#8220;loophole&#8221; allowing in concerning ingredients.
