Howell, appointed to the Federal District Court in Washington by President Barack Obama, excoriated Mr. Trump\u2019s vision of unchecked authority in her 36-page ruling, referring to a declaration he had made during the 2024 campaign that he would be a dictator <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/12\/05\/us\/politics\/trump-fox-news-abuse-power.html\" title=\"\">on \u201cDay 1\u201d<\/a> and to an image that the White House shared of Mr. Trump <a class=\"css-yywogo\" href=\"https:\/\/x.com\/WhiteHouse\/status\/1892295984928993698\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">wearing the crown of a king.<\/a><\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cA president who touts an image of himself as a \u2018king\u2019 or a \u2018dictator,\u2019 perhaps as his vision of effective leadership, fundamentally misapprehends the role under Article II of the U.S. Constitution\u201d Judge Howell wrote.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">She later continued that \u201can American president is not a king \u2014 not even an \u2018elected\u2019 one \u2014 and his power to remove federal officers and honest civil servants like plaintiff is not absolute, but may be constrained in appropriate circumstances, as are present here.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Wilcox did not immediately respond to a request for comment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Her <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/28\/us\/politics\/trump-nlrb-jennifer-abruzzo.html\" title=\"\">ouster<\/a>, in January, had the effect of paralyzing the N.L.R.B., which hears labor disputes, because it left the board with just two members \u2014 a Republican and a Democrat \u2014 and, by federal law, the board cannot act without a minimum of three members.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">She swiftly filed a lawsuit, one of several cases that could wind up before the Supreme Court as a test of the reaches of executive authority.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a lengthy hearing in the case on Wednesday, before the ruling, Judge Howell made a joke about the case\u2019s possible trajectory, saying that she understood that
