{"id":107153,"date":"2026-10-31T21:11:58","date_gmt":"2026-10-31T21:11:58","guid":{"rendered":"https:\/\/site.itshrt.com\/worldnews\/trump-lawsuit-against-wall-street-journal-over-epstein-birthday-letter-dismissed-with-prejudice\/"},"modified":"2026-10-31T21:11:58","modified_gmt":"2026-10-31T21:11:58","slug":"trump-lawsuit-against-wall-street-journal-over-epstein-birthday-letter-dismissed-with-prejudice","status":"publish","type":"post","link":"https:\/\/site.itshrt.com\/worldnews\/trump-lawsuit-against-wall-street-journal-over-epstein-birthday-letter-dismissed-with-prejudice\/","title":{"rendered":"Trump lawsuit against Wall Street Journal over Epstein birthday letter dismissed with prejudice"},"content":{"rendered":"<p> <script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<\/p>\n<div id=\"\">\n<p>A multimillion-dollar defamation lawsuit by President Trump against The Wall Street Journal over a story reporting his ties to a birthday book for Jeffrey Epstein has been thrown out.<\/p>\n<p>In a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.693830\/gov.uscourts.flsd.693830.80.0.pdf*link=*7B*22role*22:*22standard*22,*22href*22:*22https:\/*storage.courtlistener.com\/recap\/gov.uscourts.flsd.693830\/gov.uscourts.flsd.693830.80.0.pdf*22,*22affiliate*22:*22*22,*22target*22:*22_blank*22,*22absolute*22:*22*22,*22linkText*22:*2220-page*20ruling*22*7D\" target=\"_blank\" rel=\"noopener\">20-page ruling<\/a>, U.S. District Judge Darrin Gayles in Miami dismissed the suit with prejudice on Saturday, ruling that Mr. Trump did not prove the defendants made defamatory statements with actual malice.<\/p>\n<p>He said the lawsuit was &#8220;grasping at straws&#8221; as it attempted to &#8220;manufacture&#8221; flaws in the WSJ&#8217;s investigative reporting.<\/p>\n<p>Actual malice requires that plaintiffs prove that statements made about a public figure were published with the knowledge that they were false, or with disregard for whether they are true or not.<\/p>\n<p>When a case is thrown out &#8220;with prejudice,&#8221; it cannot be refiled again, and the dismissal is permanent and incontrovertible.<\/p>\n<p>&#8220;President Trump will continue to press forward in his powerhouse lawsuit against the Wall Street Journal and all of the other defendants,&#8221; a spokesperson for Mr. Trump&#8217;s legal team told CBS News in a statement. &#8220;The President will continue to hold those who mislead the American People with Fake News and smears accountable for their actions.&#8221;\u00a0<\/p>\n<p>A source familiar with Mr. Trump&#8217;s legal strategy said that the decision will likely be appealed.<\/p>\n<p>The lawsuit was over a story the WSJ published last year describing a sexually suggestive letter that the paper said bore Mr. Trump&#8217;s name and was included in a 2003 album compiled for Epstein&#8217;s 50th birthday.<\/p>\n<p>The president dismissed the story as &#8220;FAKE&#8221; and <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-lawsuit-wall-street-journal-jeffrey-epstein-birthday-letter\/\" data-invalid-url-rewritten-http=\"\">filed a $20 billion lawsuit<\/a><\/span>\u00a0against the paper, its parent company News Corp, the company&#8217;s CEO, the reporters who wrote the story and Rupert Murdoch, News Corp&#8217;s chairman emeritus.<\/p>\n<p>House lawmakers later subpoenaed and <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/jeffrey-epstein-donald-trump-birthday-message-house-oversight\/\" data-invalid-url-rewritten-http=\"\">obtained<\/a><\/span>\u00a0a redacted version of the birthday book from Epstein&#8217;s estate, which <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/live-updates\/jeffrey-epstein-donald-trump-birthday-message-house-oversight\/\" data-invalid-url-rewritten-http=\"\">included the letter<\/a><\/span>\u00a0at the center of Mr. Trump&#8217;s lawsuit. Then-White House press secretary Karoline Leavitt <a href=\"https:\/\/x.com\/PressSec\/status\/1965146390348398627*link=*7B*22role*22:*22standard*22,*22href*22:*22https:\/*x.com\/PressSec\/status\/1965146390348398627*22,*22affiliate*22:*22*22,*22target*22:*22_blank*22,*22absolute*22:*22*22,*22linkText*22:*22said*22*7D\" target=\"_blank\" rel=\"noopener\">said<\/a>: &#8220;It&#8217;s very clear President Trump did not draw this picture, and he did not sign it.&#8221;<\/p>\n<p>In April, Gayles <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/trump-wall-street-journal-lawsuit-epstein\/\" target=\"_blank\" data-invalid-url-rewritten-http=\"\">dismissed the lawsuit<\/a><\/span>, saying the president&#8217;s legal team failed to clear the legal bar needed to establish their claim. He ruled that the president came &#8220;nowhere close&#8221; to showing the paper acted with &#8220;actual malice&#8221; toward him, the standard for bringing a defamation suit as a public
