Roberts Jr. makes a point of going to the State of the Union address. But he does not enjoy it, once calling it \u201ca political pep rally.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He was there again on Tuesday, accompanied by Justices Brett M. Kavanaugh and Amy Coney Barrett, both appointed by President Trump; Justice Elena Kagan, appointed by President Barack Obama; and Justice Anthony M. Kennedy, a Reagan appointee who retired in 2018.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cI\u2019m not sure why we are there,\u201d Chief Justice Roberts, who was appointed by President George W. Bush, said in 2010, adding: \u201cThe image of having the members of one branch of government standing up, literally surrounding the Supreme Court, cheering and hollering while the court, according to the requirements of protocol, has to sit there expressionless, I think, is very troubling.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">But the chief justice has continued to attend, while other members of the court have long ago stopped going. Justice Clarence Thomas, who has said that he could not abide <a class=\"css-yywogo\" href=\"http:\/\/www.nytimes.com\/2010\/02\/04\/us\/politics\/04scotus.html\" title=\"remarks at Stetson University School of Law\">\u201cthe catcalls, the whooping and hollering and under-the-breath comments,\u201d<\/a> has not gone for more than a decade.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Justice Samuel A. Alito Jr. called the addresses \u201cvery political events\u201d and \u201cvery awkward,\u201d adding, \u201cWe have to sit there like the proverbial potted plant most of the time.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He did speak, sort of, in 2010 in response to President Obama\u2019s criticism of the Citizens United campaign finance decision, then <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2010\/01\/22\/us\/politics\/22scotus.html\" title=\"\">just a few days old<\/a>. He mouthed the words \u201cnot true.\u201d He has not been back since.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Scholars have found that the likelihood of attendance declines with age and length of service.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Attendance in a justice\u2019s early years may be explained in part by loyalty and gratitude. As Justice Antonin Scalia once put it, it is easier to stay home \u201cwhen the president giving the State of the Union is not the man who appointed you.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The justices say that attendance can be stressful, largely because they must make careful and coordinated choices about what statements from the president are uncontroversial enough to warrant applause.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">That is hard, Justice Alito said, because presidents \u201cwill fake you out.\u201d They may start with something bland, he said, like, \u201c\u2018Isn\u2019t this the greatest country in the world?\u2019 \u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cSo you get up and you start to clap,\u201d he said, \u201cand the president will say, \u2018Because we are conducting a surge in Iraq\u2019 or \u2018Because we are going to enact health care reform,\u2019 and then you immediately have to stop.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">It was not always so. In 1964, President Lyndon B. Johnson said, \u201cLet this session of Congress be known as the session which did more for civil rights than the last hundred sessions combined.\u201d Five members of the Supreme Court, including Chief Justice Earl Warren, applauded.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">These days, Chief Justice Roberts <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2019\/09\/25\/us\/politics\/chief-justice-john-roberts-interview.html\" title=\"\">said in 2019<\/a>, the justices have to take pains to applaud only very occasionally. \u201cIt\u2019s not our job to express support for particular policy initiatives,\u201d he said. \u201cSo we do sit there like mannequins.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">He said the justices were not alone. \u201cThe Joint Chiefs of Staff are in the same position,\u201d he said. \u201cThey\u2019re sitting there like much better dressed mannequins.\u201d<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<p><script async src=\"https:\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6606220950177433\"\r\n     crossorigin=\"anonymous\"><\/script>\r\n<!-- ItShrt World News -->\r\n<ins class=\"adsbygoogle\"\r\n     style=\"display:block\"\r\n     data-ad-client=\"ca-pub-6606220950177433\"\r\n     data-ad-slot=\"1882483372\"\r\n     data-ad-format=\"auto\"\r\n     data-full-width-responsive=\"true\"><\/ins>\r\n<script>\r\n     (adsbygoogle = window.adsbygoogle || []).push({});\r\n<\/script>\r\n<br \/>\n<br \/><a href=\"https:\/\/www.nytimes.com\/2025\/03\/04\/us\/politics\/justices-can-find-these-speeches-to-congress-to-be-a-trial.html\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chief Justice John G.
