This entire case is based on speculation. Where is the admission? Where does she say that she did this?<\/p>\n<\/p><\/div>\n<div class=\"transcript-cue\">\n                                <strong class=\"transcript-cue__speaker\">SHANELLE KAUL:<\/strong><\/p>\n<p>00:01:09<\/p>\n<p class=\"transcript-cue__text\">Clancy&#8217;s high profile case ended in a mistrial in early September, with a deadlocked jury split 11 to 1. Her defense said she was suffering from postpartum psychosis but didn&#8217;t dispute that she committed the crime. In court, Tuesday, the state refuted Reddington&#8217;s new argument, calling it, quote, &#8220;Laughable.&#8221; The entire record is voluminous as to the information supporting the fact that she did this. So as we&#8217;re sitting here listening, Reddington knocks all of our socks off and says&#8211;<\/p>\n<\/p><\/div>\n<div class=\"transcript-cue\">\n                                <strong class=\"transcript-cue__speaker\">SHANELLE KAUL:<\/strong><\/p>\n<p>00:01:42<\/p>\n<p class=\"transcript-cue__text\">The hearing fueled even more speculation online. He is saying everything we&#8217;ve been saying. I just watched the hearing with Reddington, [LAUGHING] I feel so vindicated.<\/p>\n<\/p><\/div>\n<div class=\"transcript-cue\">\n                                <strong class=\"transcript-cue__speaker\">SHANELLE KAUL:<\/strong><\/p>\n<p>00:01:54<\/p>\n<p class=\"transcript-cue__text\">The case has been scrutinized on social media from the very beginning, and conspiracy theories have run rampant, claiming Clancy&#8217;s ex-husband, Patrick, was involved in the killings, which he&#8217;s denied. In an exclusive interview with 60 Minutes, he reflected on that. How do you respond to people who have that idea about you? It&#8217;s deeply harmful to the legacy of my children. It is a huge distraction from what really matters here, which is perinatal mental health. And it&#8217;s done real harm to real people, myself included, but also others. The two sides will be back and meet in court here in Plymouth in early November. That&#8217;s when the judge says he wants to discuss dates for a possible new trial. When asked about this yesterday, the DA said he has not yet decided whether or not the state is going to retry Lindsay Clancy on the same first-degree murder charges. We&#8217;ll also learn more at that upcoming hearing about the defense&#8217;s request to investigate the lone holdout juror. Gayle. All right, Shanelle, thank you very much. Joining us once again is CBS News legal analyst, Caroline Polisi. I couldn&#8217;t wait to hear what you have to say about this, because jaws literally dropped when we were watching yesterday on the TV. I think people were thinking, I want to know the strategy in your opinion. And if that was the case, why didn&#8217;t Mr. Reddington raise it earlier in the trial? Yeah, I really want to clarify this, because it&#8217;s a pretty nuanced legal argument. Kevin Reddington did not waltz into that courtroom proclaiming Lindsay Clancy&#8217;s innocence. He&#8217;s making a legal argument, and it goes to his what we call a Rule 25 motion for a directed verdict. But essentially, he&#8217;s arguing that the Commonwealth didn&#8217;t meet its burden of proof when it comes to proving that she actually committed the killings. And it goes to what was presented at trial. It&#8217;s not an argument in a vacuum. To be clear, guys, he&#8217;s not winning this motion. I personally feel that it was a shot across the bow to the Commonwealth. Remember, they haven&#8217;t said yet whether or not they&#8217;re going to move forward with a retrial, but he&#8217;s letting them know that he is going to put them to their burden. But why didn&#8217;t he raise it earlier. Caroline, during the trial? That&#8217;s a good trial. Well, they hadn&#8217;t presented the evidence until the trial, right? Well, it wasn&#8217;t a bifurcated trial. Again, it&#8217;s nuanced legally. But they made a strategy. Again, she didn&#8217;t admit to killing, to doing the killing so much as she didn&#8217;t contest that evidence. They made a strategy to move forward on the not guilty by reason of insanity claim. And so basically, what he&#8217;s arguing is now, he couldn&#8217;t argue that during the trial because the judge didn&#8217;t allow it to be by&#8211; How much of the court of public opinion has to do with this? Because this really took on a life of its own online. Right. And Basically, he raised every dog whistle there for those TikTok conspiracy theories. I mean, he talked about her core body temperature, he talked about the timeline, the email, this infamous email. I mean, if you&#8217;re into this case, all of the points that he made were what people have been talking about forever now. I think Kevin Reddington listens to the news. It&#8217;s pretty clear. Remember the first trial, he made a motion to bring a TikToker in, actually, to testify. It wasn&#8217;t granted but, I mean, he knows what&#8217;s up. Well, so now do the potential jurors, they also know what&#8217;s up after hearing what Kevin Reddington is suggesting. So the jury pool, it seems that the DA could be in check here. Do you think that means that this case will be retried? I don&#8217;t know. You hesitated. You did hesitate. I think it is going to be incredibly difficult to seat an impartial jury if there is a retrial. I mean, it just says, once again, when he was here, I said, I hope I never needed services, but if I do, he&#8217;s somebody I would call. He&#8217;s the guy. Even when he does a jaw-dropping thing like that, it shows he will really fight for his client. No doubt. Talk about zealous advocacy. You want him on your side. There you go. Caroline Polisi, we want you on our side. Yes.
