Instead, Mexico argues the majority of guns found at Mexican crime scenes come from the United States. It seeks some $10 billion in damages from U.S. gun makers.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The dispute comes before the justices at a time of heightened tension between the two countries as the Trump administration <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/01\/us\/politics\/canada-mexico-china-trump-tariffs.html\" title=\"\">leans on Mexico<\/a> to crack down on illegal migration and cartel organizations. Tariffs on imported goods from Mexico are scheduled to go into effect on Tuesday \u2014 the same day the justices are set to consider the guns lawsuit.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">President Trump has cited drug trafficking from Mexico as one of the factors driving the decision to impose tariffs. His administration has taken a number of steps to push back on the cartels, including <a class=\"css-yywogo\" href=\"https:\/\/www.state.gov\/terrorist-designations-of-international-cartels\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">designating more than a half-dozen<\/a> of the criminal groups as foreign terrorist organizations. That move could result in <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/21\/us\/politics\/trump-drug-cartels-terrorist-mexico.html\" title=\"\">penalties<\/a>, including criminal charges, for companies found to be entangled with the cartels, but it has also raised concerns from the Mexican government of a potential violation of Mexico\u2019s sovereignty.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Lawyers for Mexico argue that U.S. manufacturers and gun dealers are complicit in what they call an <a class=\"css-yywogo\" href=\"https:\/\/www.cbsnews.com\/news\/damming-the-iron-river-mexico-legal-battle-to-stop-gun-trafficking-from-us-60-minutes-transcript\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">\u201ciron river\u201d<\/a> of firearms pouring into the country and arming cartels. They point to strict controls on gun purchases in Mexico, where civilians are not allowed to purchase the types of rapid-fire, powerful military-style weapons favored by the cartels, as evidence that as many as half a million firearms are smuggled from the United States into Mexico each year.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cIt is far easier and far more efficient to stop the crime gun pipeline at its source and to turn off the spigot,\u201d said Jonathan Lowy, president of Global Action on Gun Violence and a longtime litigator against the gun industry who has worked on the case on behalf of Mexico.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The gun makers, joined by a slew of gun groups including the National Rifle Association, have argued the lawsuit would undermine gun rights in the United States.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cMexico has extinguished its constitutional arms right and now seeks to extinguish America\u2019s,\u201d the N.R.A. said in a <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-1141\/310430\/20240522135935043_23-1141%20-%20NRA%20-%20Amicus%20Brief.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">brief<\/a> in support of the gun makers. \u201cTo that end, Mexico aims to destroy the American firearms industry financially.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The case may be viewed skeptically by the Supreme Court, where the 6-3 conservative supermajority has worked to <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">expand gun rights<\/a>. But at a time when Mr. Trump has targeted the country, it has offered a forum for Mexico to publicize its counter case that U.S. gun manufacturers share the blame for cartel violence. The Mexican government has also <a class=\"css-yywogo\" href=\"https:\/\/www.npr.org\/2024\/02\/23\/1233577074\/mexico-sues-arizona-gun-shops-trafficking-firearms-across-the-border\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">sued several gun stores<\/a> in Arizona and could expand the effort by filing additional suits.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">At a <a class=\"css-yywogo\" href=\"https:\/\/globalinitiative.net\/analysis\/trafficking-and-diversion-of-firearms-in-latin-america-responses-reform-and-responsibility\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">conference<\/a> last month in Latin America, Pablo Arrocha, a legal adviser for Mexico\u2019s foreign ministry, <a class=\"css-yywogo\" href=\"https:\/\/amp.cnn.com\/cnn\/2025\/02\/26\/americas\/mexico-supreme-court-gun-lawsuit-latam-intl\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">said<\/a> that two lawsuits filed so far marked only the beginning of a broader legal strategy to push back against the flow of guns across the border.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">For years, Mexico has pushed the United States to do more to curtail the trafficking of American manufactured guns over the border. When Mr. Trump <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/live\/2025\/02\/03\/us\/trump-tariffs\" title=\"\">announced<\/a> he would delay tariffs against Mexico earlier this month, both nations had agreed to address their respective concerns: Mexican authorities promised to work to stem the flow of drugs across the border while U.S. authorities would try to combat gun trafficking.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In recent days, there have been signs of improving relations between the two countries, including when the Mexican government <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/27\/us\/politics\/mexico-cartel-sheinbaum-trump.html\" title=\"\">this week sent<\/a> to the U.S. nearly 30 top cartel operatives wanted by the American authorities. But inside the White House, Mr. Trump\u2019s advisers remain split over whether to take more substantial action in Mexico, including carrying out <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/27\/world\/americas\/mexico-trump-cartels-washington.html\" title=\"\">military strikes against Mexican drug cartels<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A White House spokesman did not respond to a request for comment.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mexico first <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2021\/08\/04\/world\/americas\/mexico-lawsuit-gun-companies.html\" title=\"\">sued<\/a> multiple gun companies in 2021, arguing that the cartel bloodshed was \u201cthe foreseeable result of the defendants\u2019 deliberate actions and business practices.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A trial court judge dismissed the case, finding it was barred by a <a class=\"css-yywogo\" href=\"https:\/\/www.congress.gov\/bill\/109th-congress\/senate-bill\/397\/text\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">2005 federal law<\/a> that limits litigation against gun manufacturers and distributors and has provided immunity from actions brought by the families of people killed and injured by their weapons.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">A unanimous panel of judges of the U.S. Court of Appeals for the First Circuit, in Boston, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/01\/22\/us\/politics\/appeals-court-mexico-lawsuit-gunmakers.html\" title=\"\">overturned<\/a> that decision. They found that the lawsuit met the criteria for a part of the law allowing for litigation in cases where knowing violations of firearms laws are a direct cause of the plaintiff\u2019s injuries.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-6\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">Gun makers asked the justices to hear the case, <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/23-1141.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Smith &amp; Wesson Brands v. Estados Unidos Mexicanos<\/a>, No. 23-1141. Lawyers for Smith &amp; Wesson <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-1141\/307919\/20240418143513080_S_W%20Cert%20Petition.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">argued<\/a> Mexico had presented a legal theory that was an \u201ceight-step Rube Goldberg, starting with the lawful production and sale of firearms in the United States and ending with the harms that drug cartels inflict on the Mexican government.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The lawyers contend the gun makers acted lawfully in the United States and cannot not be held responsible for illegal cartel behavior in Mexico. They cited a <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2023\/05\/18\/us\/politics\/supreme-court-google-twitter-230.html\" title=\"\">2023 Supreme Court case<\/a> in which the court <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-1496_d18f.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">ruled unanimously<\/a> that social media companies could not be sued for aiding terrorism because they hosted posts from ISIS.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">A trial court judge <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/04\/us\/supreme-court-mexico-lawsuit-gun-makers.html\" title=\"\">dismissed<\/a> Mexico\u2019s case against six of the defendants on other grounds, leaving the Supreme Court\u2019s decision in the case to apply to claims against Smith &amp; Wesson, a gun manufacturer, and Interstate Arms, a wholesaler.<\/p>\n<p class=\"css-798hid etfikam0\">Zolan
